People v Chaw Yaw Shun

Facts: The lifeless body of Hector Crisostomo, an officer of Presidential Fact-Finding Committee was
found in his sedan car. He was shot 3 times on the head.
Capt. Dionisio Carasig, intimated that the recent car deal of Crisostomo with Victorio Alvarez may have
connection with the killing.

Alvarez got arrested after testing positive with gun powder residue. He made a tape-recorded statement
admitting he alone killed Crisostomo, following a handwritten note the following day stating that a
certain Johnny was the one who shot Crisostomo. A day after, he stated George Chua (Chaw Yaw Shun)
participated in the crime, and promised him P32K plus 400/month.

When Chua was interrogated, he denied the allegations. He was them brought to PC headquarters
where he made a written confession of the order for killing Crisostomo.

Chua appealed on the guilty verdict and claimed his confession was obtained thru force.

Issue: WON Chua’s confession is admissible

Ruling: No. A confession which is induced by torturing the accused or personal violence for the purpose
of obtaining confession is not admissible.

The court noted the medical reports of 3 doctors who examined Chua found that the injuries of Chua
could not have been self-inflicted.
