JUDICIAL AFFIDAVIT
I, GUIAMALIA KENENGKO, of legal age, Filipino,
married to the respondent, and a resident of #3 Notre Dame
Avenue, Cotabato City, after having been duly sworn in
accordance with law, hereby depose and state:
I, GUIAMALIA KENENGKO, of legal age, Filipino,
married to the respondent, and a resident of #3 Notre Dame
Avenue, Cotabato City, after having been duly sworn in
accordance with law, hereby depose and state:
I, JOMAR ROBLO, of legal age, Filipino, and a resident of Aquino
Avenue, Poblacion San Pascual, Batangas, witness for the prosecution in this
case, states under oath that:
1. I am the husband of Cecile Hernandez;
2. The lawyer who conducted my examination is Atty. Jermane Delos Santos
of the Public Attorney’s Office, Batangas City;

3. I answered all her questions voluntarily, to the best of my knowledge and


fully conscious that I do so under oath and may face criminal liability for
false testimony and perjury;
5. PURPOSE OF OFFER

The testimony of the witness is being offered to for the following


purposes:

1.1 To prove that I have no criminal intent to kill my own wife


in the evening of March 15, 2020.

6. QUESTIONS AND ANSWERS

6.1 Q. Please state your name and other personal circumstances


for the record.
A. I, JOMAR ROBLO, of legal age, Filipino, and a
resident of Aquino Avenue, Poblacion San Pascual, Batangas.

6.2 Q. Are you the same JOMAR ROBLO, who is charge of this
case?
A. Yes, ma’am.

6.3 Q. Do you know a person name Cecile Hernandez?


A. Yes, ma’am.

6.4 Q. How are you related to her?


A. She is my wife, maam.

6.5 Q. Where were you last March 15, 2020 at about at around 6:45
in the evening?
A. I was at my home in Aquino Avenue, Poblacion San
Pascual, Batangas

6.6 Q. Can you describe your house?


A. Our house was a one (1)-storey building and had an open
sala, a kitchen, and one (1) bedroom maam.

6.7 Q. What happen in your home, if any?


A. I went home to ate dinner with my family and to ask a small
amount of money from my wife. But she refused.

6.8 Q. What did you do after?


A. We had some argument on that matter and started to raise
our voice.

6.9 Q. What happened after?


A. She pushed me in the corner of our bedroom.

6.10 Q . What happen after you were pushed, if any?


A. I immediately stood up and said that if I get hurt I will punch
her.

6.11 Q. What happened after?


A. I closed the door in or bedroom.

6.12 Q. What happen next, if any?


A. We talked in a calmly manner and sorted the problem. I
asked for her forgiveness and understanding that the same will
ot happen anymore. And then walked out of the room.

6.13 Q. What did you do after?


A. I tell to my children “Oh hayaan nyo muna ang nanay ninyo
magpahinga. Wag muna kayo papasok sa kwarto”.

6.14 Q. What happened after that?


A. I went straight to the kitchen. And I called guila, my
daughter to fix the rice cooker as the same is not operating.

6.15 Q. What did you do after?


A. I went back to our room.

6.16 Q. What happened after that?


A. I saw cecile hanging on the ceiling on top of the bed. Her
body was somewhat bent with her feet touching the bed

6.17 Q. What did you do after?


A. I slipped out the knot and laid the body of my wife on the
bed and I started to cry out loud.

6.18 Q. What happened after that?


A. Our neighbours then began gathering in our house. And so
guila begged them for some help, to which Maan “aling
Ligaya” Chavez responded and call the police hotline.

6.19 Q. What happen after she called the police?


A. We subsequently call an amubulance.

6.20 Q. What happened next?


A. My wife was then immediately rushed to Bauan Doctor
Hospital. She was immediately attended by Dr. Abude, but to
no avail as she was already declared as dead on arrival.

6.21 Q. What happened after that?


A. I was invited by the police officers to San Pascual Police
Station.

6.22 Q. What happened next?


A. Then, I left at the hospital

Attorney’s Office, Batangas City, District Office hereby declare under oath that I
am the counsel for the complainant who supervised the witness in the execution of
this judicial affidavit: and that I have faithfully caused the recording of the answer
of the witness on the above questions which were profounded and that neither I,
nor any person present or assisting me has coached the witness in his answer.
