AFFIDAVIT OF UNDERTAKING

I, LUISITO M. TIJING, of legal age, Filipino and a resident of

Dumaguete City, after having been sworn to in accordance with law hereby
depose and state that:

1. I am the General Manager of PhilSouth Builders [“PhilSouth” for

brevity];

2. At around 6:31 in the morning of 29 September 2018, a traffic accident

transpired involving a Black/Red Baja-Kawasaki Motorcycle with Plate
No. 070104 driven by Allan B. Casipong which collided with a Sinotruk
Truck with Plate No. 130105 and Chassis No. LZZ5BLSD5HA255850
owned by PhilSouth Builders and driven by Dionald Bacang Caingcoy;

3. Because of such incident, authorities impounded the Sinotruk Dump

Truck owned by PhilSouth;

4. The Sinotruk is a duly registered vehicle. As proof hereof, a machine

copy of its Certificate of Registration and Official Receipt from the
Land Transportation Office is hereto attached as Annex “A” and “B”,
respectively;

5. Mr. Dionald Bacang Caingcoy is likewise a licensed driver. As proof

hereof, a copy of his temporary driver’s license issued by the Land
Transportation Office is hereto attached as Annex “C”;

6. I hereby undertake to produce the said vehicle upon request of

authorities if such will be needed for further investigation or
proceedings;

7. This affidavit is executed to support the request for release of the

impounded vehicle, the same being a duly registered vehicle driven by
a duly licensed driver, and not being an instrument of the commission
of any crime, and to attest to the truth of the foregoing and for
whatever legal purpose and intent it may serve.
