SCHEME FOR GRANTING FINANCIAL ASSISTANCE TO THE MEMBERS


OF HCBA NAGPUR, DURING LOCKDOWN PERIOD 03/05/2020 to 17/05/2020

A) In view of the Lockdown declared by the Government due to the spread of


Coronavirus in the country, w.e.f. 21st March 2020 to 3rd May 2020 and in
view of the possibility of further extention of lockdown for further period
during the month of May 2020, the Executive Committee of the High
Court Bar Association, Nagpur ( HCBA) has passed a unanimous
resolution to frame a scheme for providing financial assistance to the
members who are in need of financial assistance during the lockdown
period.

SCHEME FOR FINANCIAL ASSISTANCE TO NEEDY LAWYWERS DURING


COVID -19 PENDAMIC INDUCED LOCKDOWN -

The TERMS AND CONDITIONS OF THE SCHEME are as follows :

1. This scheme shall remain in force only during the Lockdown period AND,
even during the Lockdown period, the implementation and continuation
of this Scheme will be the sole decision of the Executive Committee of the
High Court Bar Association.
2. The Executive Committee has the entire discretion to decide the quantum
of amount, to be disbursed at a time, to the applicant member.
3. A member desiring to avail the facility of financial assistance will have to
submit a duly signed application, in the prescribed form, to the office of
HCBA, on or before 15 May 2020.
4. The application shall be scrutinized by the committee of HCBA and the
decision of committee on any application shall be final.
5. The Scheme is applicable only to members of HCBA, Nagpur.
6. The benefits of financial assistance under the scheme are available only
to members of HCBA, Nagpur subject to fulfillment of terms and
conditions prescribed in the scheme.
7. The members of HCBA who have an active practice of not more than
seven (7) years on the date of application, are eligible for the benefits
under the scheme.
8. The benefits under the present Scheme, is a onetime measure and the
eligible member can avail the same only once.
9. Two or more members belonging to the same family will not be entitled to
separate benefits ; eg if Father and son both are members, only one
application shall be entertained.
10. The amount of financial assistance under this scheme shall not
exceed Rs.4000/- per head.
11. In case it is reveled that the applicant member has availed financial
assistance from any other Association or Organisation, the committee
may decide to grant benefit , only to the extent of achieving the total
quantum decided by this scheme, as an exceptional case. ( For instance, in
case a member has availed financial assistance of Rs.2000/- from any
other Association or Organisation, then the committee may consider to
grant financial assistance of Rs.2000/- only, to achieve total amount of Rs.
4000/-)
12. The benefit of financial assistance be given to the Members of
HCBA, who are facing financial problems and who have no source of
income other than practice as an Advocate or any other source of income
for their family.
13. The applicant member should declare that there is no other source
of income either from his spouse or parents or children AND that the
family members of the applicant are dependant upon him/her.
14. The applicant member should declare that he/she does not have any
money in savings account or Fixed Deposits in his name or in the name of
any other family member .
15. The committee members will check the credentials of the applicant,
either by contacting the Advocates/Members whose reference is given in
the application or by way of any other means.
16. The amount will be disbursed by way of transfer of amount to the
account of the applicant member by RTGS/Fund transfer etc. If this kind
of transfer of money is not possible then the amount can be disbursed by
issuing an Account payee cheque in the name of applicant member. The
amount shall not be disbursed by cash.

17. In the event the lockdown is lifted, the benefits under this scheme
shall not be granted. The Scheme shall operate for the period during
which the Third Lockdown (03/05/20120 to 17/05/2020) is in force.
B) The record of the applications with attached documents and the details of
the amount disbursed to the members will be maintained as record of
HCBA.
C) The High Court Bar Association has introduced this Scheme as an urgent
and extraordinary measure and the Executive Committee shall have the
discretion either to continue or to modify the entire scheme or any terms
of this Scheme, at any time.
