ULP:

bargain collectively.
For workers: Inimical to the legitimate interest of the management

2 liabilities/penalty:
Criminal - this may be instituted even before a final judgment of the ULP case.
Prejudicial question does not apply
Civil

Period of prescription of the criminal aspect is suspended while the admin


investigation applies.
Findings in the admin investigation is not binding in the criminal case
Elements of ULP
