HL at, 979(@) Arete 27 aATeK, 2003 ate rst. 2804(@) are 3 Adare, 2009 aret Fare Ty A MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION ‘New Delhi, the 25th March, 2015 $.0. 1396(E)—whereas by notification number S.0. 763(E) dated the 14% September, 1999 (hereinafter referred to as the said notification) notifications 8.0. 979(E) dated the 27* August, 2003 and S.O. 2804 (E) dated the 3" November, 2009, the Central Government issued directions for restricting the excavation of top soil for manufacture of bricks and promoting utilisation of fly ash in the manufacture of building materials and in construction activities with a specified radius of one hundred kilometers from coal or lignite based thermal power plants; ‘And whereas, vide the said amendment notification number S.0.804(E) dated the 3" November, 2009, timeline to achieve the target of hundred per cent utilisetion of fly ash by thermal power plants was specified; ‘And whereas, itis observed that the thermal power plants are yet to achieve the target of hundred per cent utilisation of fly ash and the unutilised fly ash quantum is continuously increasing; And whereas, itis observed that the construction agencies are not using fly ash and fly ash based products in their construction projects; ‘And whereas, itis felt that there is an urgent need (o provide additional measures for utilization of fly ash and fly ash based products in the country; ‘And whereas, the issue has been examined by the Government of India in the Ministry of Environment and Forests and the Central Government is of the opinion that the said notification needs to be amended; ‘And whereas, clause (a) of sub-rule (3) of nile 5 of the Environment (Protection) Rules, 1986 provides that whenever the Central Government considers it expedient to impose prohibition or restrictions on the locations of any industry or the carrying on of processes or operations in any area, it may give notice of ts intention to do s0; ‘Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (¥) of sub-section (2) of the section 3; and section 5 of the Environment (Protection)Act, 1986 (29 of 1986), the following farther amendments, which the Central Government proposes to make in the said notification is hereby published as required by clause (a) of sub-rule(3) of rule 5 of the Environment (Protection) Rules, 1986 for the information of the public likely to be affected thereby; and notice is hereby given that the said draft amendment notification will be taken into consideration on or after the expiry of the period of sixty days from the date on which copies of the Official Gazette, in which this notification is published, arc made available to the public; Objections or suggestions, if any, may be addressed to the Secretary, Ministry of Environment, Forest and Climate Change, 4" Level, Prithvi Block, Indira Paryavaran Bhawan, Jorbagh Road, New Delhi-110003, or electronically at e-mail address: basinha@gov.in, sharad,sapra@nic.in, The objection or suggestion, which may be received from any person with respect to the said draft amendments within the period specified above, will be taken into consideration by the Central Government. DRAFT AMENDMENTS 1. Inthe said notification, in paragraph 1,~ (@ in sub-paragraph 1(A), for the words “hundred kilometers”, the words “five hundred kilometers” shall be substituted: 4 THE GAZETTE_OF INDIA: EXTRAORDINARY [Parr ll—sec. 30) (b) in sub-paragraph (3), for the figures and letters “100 km.” the words and letters “five hundred kilometers” shall be substituted; (©) jin sub-paragraph (5), for the words “hundred Kilometers”, the words “five hundred Kilometers” shall be substituted. @_in sub-paragraph (7), for the words “hundred Kilometers”, the words “five hundred Kilometers” shall be substituted. 2. In the said notification, in paragraph 2, after the sub-paragraph (7) the following sub-paragraphs shall be inserted, namely:— “(8) Every coal or lignite based thermal power plants shall, (A suitable date prospective to final notification is to be specified) upload the stock of each type of fly ash available with them on their website and, thereafter shall update the stock position for each type of fly ash at least once in every fortnight. (9) A radius of hundred Kilometers from a coal or lignite based thermal power plant, the cost of transportation of fly ash for building and road construction projects shall be borne by such coal or lignite based thermal power plant andthe cost of transportation beyond a radius of hundred Kilometers and upio five luudred kilometers shall be shared equally between the user construction agency engaged and the coal or lignite hased thermal power plant. (10) The coal or lignite based thermal power plants within a radius of five hundred kilometers shall bear the entire cost of transportation of fly ash to the site of road construction: projects under Pradhan Mantri Gramin Sadak Yojna and asset creation programmes of the Government involving construction of buildings, road, dams and embankments” In the said xotification, in paragraph 3, after the sub-paragraph (7) the following sub-paragraph shall be inserted, namely:— : “(8) It shall be the responsibility of all State Authorities approving various construction projects fo ensure that Memorandum of Understanding or any other arrangement for using fiy ash or fly ash based products is made between the thermal power plants and the construction ageney or contractors.” INo. 9-8/2005-HSMD} BISHWANATH SINHA, Jt Secy.
