Subject: Examination report under sections 12 & 13 of the Patents Act, 1970 and the Patents Rules, 2003.
1. उपयु आवेदन के संदभ मे परी ण रपोट ( अथात, एक व िनयम, 2003 (यथा संशोिधत) के िनयम 24-ख(3) म िविनिद आपि य का
पथम कथन ) इसके साथ संल न है यह रपोट परी ण हे तु अनुरोध िदनांक 16/03/2015 के उ र मे जारी क गयी है परी ण रपोट का
उ र दािखल करने क अंितम ितिथ (अथात, इस रपोट म लगाई गयी सभी आव यकताओं के अनुपालन क अविध) आवेदक को आपि य का
पथम कथन जारी होने क ितिथ से छः माह है
Please find enclosed herewith an Examination Report ( i.e. a first statement of objections as specified in Rule
24-B(3) of The Patents Rules, 2003 (as amended) ) in respect of above-mentioned application. This report is
issued with reference to a request for examination dated 16/03/2015.The last date for filing a response to the
Examination Report (i.e. a period to comply with all the requirements raised in this examination report) is six
months from the date on which the first statement of objections is issued to the Applicant.

The instant application shall be deemed to have been abandoned under Section 21(1) of The Patents Act, 1970,
unless all the requirements raised in this report are complied with in the period as specified in Rule 24-B (5) of
The Patents Rules, 2003 (as amended).

Act:
(1).नवीनता / NOVELTY:
(I) ऊपर उ रत द तावेज़ के संदभ (1-3) मे िदये गए पकटन के पूवानुमान को यान मे रखते हए, िन निलिखत कारण से दावा(व ) (1-3) मे
नवीनता क कमी है /
Claim(s) (1-3) lack(s) novelty, being anticipated in view of disclosure in the document cited above under
reference D1 for the following reasons:
The subject matter as disclosed in claims 1-3 of the instant application does not constitute an invention under
section 2(1)(j) of the Patents Act, 1970 (as amended) as it lacks novelty in view of teachings from the cited
document D1 (Publication number: US20030085621A1, Potega et al.).
Regarding subject matter of independent claim 1, Smart Configurable Analog Input Acquisition module for
airborne system which can be adapted to various airborne platforms.(refer D1: paragraphs [0492, 0499] and also
paragraphs [0335-0339])
The "Signal Conditioning Block" [1] which is used to interface external analog signals and the inside electronics.
(refer D1: paragraphs [0004, 0110, 0136])
The "Configuration Block" which is used to configure the signal conditioning block to make it adaptable to
different types of analog input signals. (refer D1: paragraphs [0378, 0394])
Regarding dependent claim 2, Signal Conditioning Block claimed in claim 1) of Smart Configurable Analog
Acquisition Module. (refer D1: paragraphs [0004, 0110, 0136])
Regarding dependent claim 3, Configuration Block claimed in claim 1) of Smart Configurable Analog Acquisition
Module for making the circuit adaptable to different types of avionics analog signals. (refer D1: paragraphs
[0378, 0394])
Hence, claims 1-3 do not meet the requirement of section 2(1)(j) of The Patent Act, 1970 (as amended) since
these features are directly derivable from the cited prior art document D1.

Claim(s) 1-3 does/do not define the scope of invention for which the protection is claimed for the following
reasons:
The term(s) “smart”, “configurable”, and “adapted/adaptable” as used in claims 1-3 are vague and ambiguous.

There is no clear inference that can be drawn from the said terms regarding their structural and functional
aspects. Therefore, by using the said vague terms, claims 1-3 encompass technical characteristics which are not
supported by the description as required, and its scope is broader than justified by the description.
All documents and copies of the documents, except affidavits and drawings, filed with patent
office, under clause (d) of sub-rule (1) of rule 9 of the Patents Rules, 2003 (as amended),
shall contain the numbering to every fifth line of each page of the description and each page
of the claims at right half of the left margin.
The title of the invention must be included in abstract and abstract should be prepared in
Format of accordance with rule 13(7) (a) of the Patents Act (as amended), 1970.

The features illustrated in the drawings shall be followed by their respective reference signs

Drawings should be duly signed by the authorized agent / applicant and the name of the
applicant must be mentioned at the top left corner. The Drawings referred to in the
specification should be prepared in accordance with the instructions contained in the Rule
Format of 15 of the Patent Rules, 2003(as amended).

Drawings shall be on standard A4 size sheets with a clear margin of at least 4 cm on the top
and left hand and 3cm at the bottom and right hand of every sheet under sub-rule (4) of rule
15 the Patents Rules, 2003 (as amended).
No descriptive matter shall appear on the drawings as required by the provisions of sub-rule
(7) of the rule 15 of the Patents Rules, 2003 (as amended).
All the forms, documents, and drawings shall be duly signed by the applicant or his
authorized patent agent.

Applicant Form 2 Para 6 of Patents Act, 1970 (as amended).
