issued with reference to a request for examination dated 16/03/2015.The last date for filing a response to the
Examination Report (i.e. a period to comply with all the requirements raised in this examination report) is six
months from the date on which the first statement of objections is issued to the Applicant.

Claim(s) (1-3) lack(s) novelty, being anticipated in view of disclosure in the document cited above under
reference D1 for the following reasons:
The subject matter as disclosed in claims 1-3 of the instant application does not constitute an invention under
section 2(1)(j) of the Patents Act, 1970 (as amended) as it lacks novelty in view of teachings from the cited
document D1 (Publication number: US20030085621A1, Potega et al.).

Regarding subject matter of independent claim 1, Smart Configurable Analog Input Acquisition module for
airborne system which can be adapted to various airborne platforms.(refer D1: paragraphs [0492, 0499] and also
paragraphs [0335-0339])
The "Signal Conditioning Block" [1] which is used to interface external analog signals and the inside electronics.
(refer D1: paragraphs [0004, 0110, 0136])
The "Configuration Block" which is used to configure the signal conditioning block to make it adaptable to
different types of analog input signals. (refer D1: paragraphs [0378, 0394])

Regarding dependent claim 2, Signal Conditioning Block claimed in claim 1) of Smart Configurable Analog
Acquisition Module. (refer D1: paragraphs [0004, 0110, 0136])

Regarding dependent claim 3, Configuration Block claimed in claim 1) of Smart Configurable Analog Acquisition
Module for making the circuit adaptable to different types of avionics analog signals. (refer D1: paragraphs
[0378, 0394])

Hence, claims 1-3 do not meet the requirement of section 2(1)(j) of The Patent Act, 1970 (as amended) since
these features are directly derivable from the cited prior art document D1.

(I) ऊपर उ रत द तावेज़(ज ) के संदभ D1 मे प अ यापन(न ) को यान मे रखते हए, िन निलिखत कारण से दावा(व ) (1-3) मे आिव कारी
कदम क कमी है
Claim(s) (1-3) lack(s) inventive step, being obvious in view of teaching (s) of cited document(s) above under
reference D1 for the following reasons:
The same reasoning as given in novelty is also applicable for inventive step.
Hence, claims 1-3 also lack inventive step and they do not meet the requirement of section 2(1)(ja) of The Patent
Act, 1970 (as amended) since the features encompassed by the said claims are directly derivable from the cited
prior art document D1. Hence, combined with common general knowledge in the art, the instant application
constitutes a subject matter which makes the alleged invention a matter of routine experiment for a person skilled
in the art.

(3).पकटन क द ता /SUFFICIENCY OF DISCLOSURE:

(I) िविनदश पूणतयाः व िवशे षकर आिव कार तथा इसके संचालन तथा िविध के िन पादन के संबंध मे िववरण नह देते ह
The complete specification does not fully and particularly describe the invention and its operation and the method
by which it is to be performed in respect of:
The instant application does not meet the requirements of section 10(4)(a) of the Patents Act, 1970 (as
amended) because the invention and its operation or use and the method by which it is to be performed is neither
fully nor particularly described in the complete specification. The complete specification should disclose the best
method of performing the invention, which is known to the applicant and for which he is entitled to claim
protection. There are certain disclosures regarding the claimed features of the alleged invention which are
neither clear nor succinct, and also no inference can be drawn on how these particular features are being
achieved using what functional and structural embodiments.
The features “inbuilt health monitoring” disclosed in the abstract and the description is neither fully nor
particularly described in the complete specification on how the same is implemented and how it enhances the
reliability of the circuit.
Further, the description fails to disclose “Signal conditioning block” on how it is working as an “interface between
external analog signals and the inside electronics”? How the said block provides a “wide bandwidth to the input
analog signal”?
Further, the “configuration block is used to configure the signal conditioning block to make it adaptable to
different types of analog input signals.” The description also does not disclose how the same is achieved.

(II) सार /Abstract:

The terms “configurable design”, “enhances” and “reliability” used in the abstract shall be replaced with a
suitable terms which correctly define the technical abstract of the invention.

(4). ेत /SCOPE:
(I) दावा(वे) 1-3 आिव कार के उस ेत िजस के िलए संर ण का दावा िकया गया है उसे िन निलिखत कारण से प रभािषत नह करता(ते) है.
Claim(s) 1-3 does/do not define the scope of invention for which the protection is claimed for the following
reasons:
The term(s) “smart”, “configurable”, and “adapted/adaptable” as used in claims 1-3 are vague and ambiguous.

There is no clear inference that can be drawn from the said terms regarding their structural and functional
aspects. Therefore, by using the said vague terms, claims 1-3 encompass technical characteristics which are not
supported by the description as required, and its scope is broader than justified by the description.

(5). प ता एवं संि ता /CLARITY AND CONCISENESS:

(I) दावा(वे) 1-3 के संबंध मे प प से परीभािषत नह ह.
Claim(s) 1-3 are not clearly worded in respect of:
1. The terms "hard wired nature", “cater(ing)”, “adaptable” and “driven” used in the description are vague and
leave the reader in doubt as to the meaning of the technical feature to which they refer. There is also no
clarity regarding the technical features claims 1-3 encompass in respect of the terms “smart”, “configurable”,
and “adapted/adaptable”. Clarification is required.
2. The vague and imprecise statement in the description in the last paragraph implies that the subject-matter
for which protection is sought may be different to that defined by the claims, thereby resulting in a lack of
clarity of the claims when the description is used to interpret the claims. Such statement should therefore be
amended to remove this inconsistency.
3. Claims 2-3 (being omnibus claims) are not clear in respect of expression “Refer Fig.1”. This statement
makes the claims ambiguous and vague. Also said expression makes it difficult to ascertain the subject
matter for which protection is sought and hence do not fulfill the requirements of section 10(4)(c) of the
Patents Act, 1970 (as amended).
4. Each claim should be in a single sentence as directed by the requirements for “Structure of Claims” in the
latest manual of Patent Office Practice and Procedures.

(6).प रभािषकता /DEFINITIVENESS:

(I) दावा(वे)1-3 िन निलिखत कारण से आिव कार को पया प से परीभािषत नह करता(ते) ह
Claim(s) 1-3 do not sufficiently define the invention for the reasons as follows:
1. “Signal Conditioning Block” as disclosed in the detailed description of the invention is indefinitive as it is
unclear how the circuit is capable of accepting inputs between “-10 to +32V for AC or DC, upto 1.5 mA of
current input and 4 MHz of frequency input,” thereby rendering the subject matter of claims 1-2 indefinitive
in view of said feature.
2. “Configuration Block” as disclosed in the detailed description of the invention is indefinitive as it is unclear
how it is adaptable to different types of analog input signals and how on the basis of received software
command it configures the “signal conditioning block” with the help of switches. Hence, the subject matter of
claims 1,3 are indefinitive in view of the said feature.

Detailed description of the invention (refer point 7 of the description) recites “…Smart analog Acquisition Circuit
is having three main blocks…” whereas only 2 such blocks have been described. Needs clarification.

All documents and copies of the documents, except affidavits and drawings, filed with patent
office, under clause (d) of sub-rule (1) of rule 9 of the Patents Rules, 2003 (as amended),
shall contain the numbering to every fifth line of each page of the description and each page
of the claims at right half of the left margin.
