Short Title. 1. These Rules may be cited as the

SUPREME COURT (COUNSEL’S FEES IN


CAPITAL TRIALS) RULES.

Fees of 2. Whenever counsel is assigned by the Court or the Chief Justice or


Court. other Judge thereof to defend any person charged with a capital offence who
has not the means to retain and pay for the services of counsel, the honorarium
which the Court or the Chief Justice or other Judge may authorise to be paid
under section 194 (2) of the Indictable Procedure Act to counsel so assigned
shall be ascertained according to the following scale:

77 of 1996. For Retainer ………………………………………... $500.00

77 of 1996. In respect of each day on which Counsel in pursuance


of such assignment appears in Court and conducts
the defence before a jury …………………………..... $100.00

77 of 1996. So however that the total of all fees paid under this
rule in respect of any one trial shall not exceed ………$1000.00

INDICTABLE PROCEDURE (FORMS) RULES.

Forms. 2. The forms set out in Part I and Part II of the Schedule are prescribed
pursuant to section 197 of the Indictable Procedure Act, for use respectively
in a preliminary inquiry into, and at the trial of, a crime, and like appropriate
forms may be used in cases not provided for in these Rules.

following defamatory matters concerning the said C. D.)

1. Do you know that in the year 1900 your friend C. D. was


employed by the firm of Randalls and that his accounts were discovered to be
all wrong:
(Meaning thereby that C. D. was guilty of acts of dishonesty and falsification of
accounts whilst he was in the employ of Randalls.)

2. When the defalcations were discovered and a warrant was


applied for he fled to Guatemala.
(Meaning thereby that the said C. D. was a fugitive from justice.)

3. Subsequently he appears to have returned to Belize for he was


found to be keeping a disorderly house in Corozal.
(Meaning thereby that the said C. D. had committed the criminal offence of
keeping a disorderly house.)

1. On the day of ,2 , C. D. received the


sum of $10.00 from T. S. and on the day of
,2 , C. D. received the sum of $3,000.00 from C. F. and the sum of
$1,500.00 from W. D. on behalf of his employers Randalls which he fraudulently
omitted to enter in their books or to account for in any way.

2. On the day of ,2 soon after C. D.’s


defalcations were discovered and a warrant was applied for against him upon
charges of embezzling his employer’s money and falsifying their
books, C. D. left Belize for Guatemala.

3. On the 20th August and on other days in the year 2 C. D.


kept a house at Corozal for the purpose of betting, contrary to
and A. B. states it was for the public benefit that the
defamatory matters charged in the said indictment should be published by
means of the fact that C. D. was at the time of the publication thereof a candidate
for the public office of City Councillor in the City of Belize.
