No, 278/2012.—In oxercise of the powers conferred by sb.ecetion (1) of section 30 read with sections 47A to 47F and section 76 of the Ké Forest Act, 1961 (Act 4 of 1962). the Government of Kerala hereby make the Following rules, namely:— cia Rus: 1. Definitions.—(1) I these rules, unless the context otherwi requires (0) “Act” means the Kerala Forest Act, 1961 (Act 4 of 1962) {0} ‘Comimittee” means a committee. authorised by the Government under the proviso to sub-seetion (2) of section 4M of the Act (c}_ “Tee" means the smount of fee spectied in these rules; (2) ‘firm’ means the form appended to these roles; (2) “licence” means the licence issued by the Authorised Officer under the provisions of section 47C of the Act; (1) ‘price® means the rate For sandalwood and sandalwood oil fixed by the Governmeit from time to time as provided under section 47E of the Act; (g) ‘Depot Officer’ means the officer in charge of the sandalwood depots (hy "Sehedule’ means the schedule sppended to these Rules; 4) “section’ means section of the Kerala Forest Act, 1961 (Aot 4 of 1962), (2) Words and expressions used but not defined in these rules, but fined in the Act shall have the same meatings respectively assigned to them inthe Act 3. (1) The Commitee shall on receipt of the application from the Authorised, Officer inspect the land and the sandal tree mentioned in the appliation and forward a report containing their observations and recommendations to the ‘Authorised Officer within thirty days. + @)_On'receipt of the report of the Commitee, the Authorised Offieor shall, within fifteen doys, pass orders granting oF rejecting permission and in che cease of rejecting permission, the reasons thereof shall be communicate in ‘wnting 4. Grant of licence for transporting sandalwood or sandabwond of 2G) Application for licence for the transport of sandalwond shall he * submitted in Form Il along with a fee at the rate specified in the Schedule to the Authorised Officer who shall, on receipt of such ‘aypa.cation inspect or cause such inspection. to verify the genuineness oF the cerntents of the application and if he is satisfied, issue a licence in Porm IV appended to these rules, within thiety days from the date of receipt of the agplication. In case the epplicaton is rejected, the same shall be intimated to the sagplieaat in waiting, . (2) Licence under sub-rule (1) for transporting sandalwood and sandalwood cil in excess of pennitied quantity as provided under sub-section (I) of section 47C may be issued to those mentioned under the frst ani second Iroviso to sub-section (1) af section 47C on payment of licence fos at the rites specified in the Schedule, (3) _In the case of ficenses issued under this rule, the soute of transport shall invariably be noted in the licence with a specific instruction to get the raterials checked at the forest check posts or forest oflices enroute D (4) In granting the licence, the Aurhorised Officer shall have due regsrd to the following matters, namely:—- © capacity of the applicant to fulfill the puspose for which licence is granted with efitence to he fattoris, eqiipmnent, ‘production and suitability of promises for such business. i) past record of the applicant as a dealer oF manufacturer in the ‘business which he desires to carry on: and (ii) whether the applicant was involved it or coavieted of any offence under any of the forest laws for the time hein, in Fee. (6) Where the Authorised Officer: refuses to grant licenes, he shall record reasons for the same in writing and, communicate the same to the + applicant within thirty days of receipt of the application, 8. Fower to search the premises—The authorised Officer or any officer ‘uthorised-by him, may, at any time, enter the premises where sandalwood or sandalwood oil ate stored by a licensee with'a view to ascertain the geruineness of the sandalwood or sandalwood oil stored. 16, Authorised Officer to take possession of excess sandalwood or sandalwood oil.—(1) ‘The Authorised Officer shall an receint of such sandalwood or sandalwood cil surrendered under section 47D in the manner provided in rule 13, ascertain the genuineness of ownership, quantity and quality of sandalwood so surrendered through any Government controlled scientific institutions/taboratories and take action to issue licence For the permitted quantity of sandalwood or sandalwood oil. (2) The Authorised Officer shall take over the exeess quantity of sandalwood or sandalwood oi! on payment of the value thereof, as may be fixed by Government fiom time to time, by cheque after deducting the working charges, transport charges and other incideotal expenses, if any, incurred for the same within fifteen days from the date of surrender. (3) The sandalwood or sandatwood oil surrendered to the Authorised Officer and for which payment has been made shall be the property of the ‘overninent ond shall he disposed of ss per rules. 12. Frocurement of sandalwood or sandutwood olf by licensees — Vi) A licensee under these rules may purchase er procure sandalwood ‘oc sandalwood oil by the following means, namely: ul () Avction sale: in the Marayoor Sandal Depot or any depai ‘owned by the Slate Government. (i) Avotion sale by any other State Government or any agency authorised by i ii) Avtborised outlets of Kerala Forest Development Corporation. Explanatory Note (This does not form part of the notification, but is intended to indicate ts general purport.) ‘The Kerala Forest Act, 1961 (4 of 1962) has been amended by Act 8 of 2010 to incorporate special provision for the protection of sandal trees and also penal provisions for offences related to smuggling, storage and transport of sandalwood.
