1. The proposed amendments are in two categories as below.

i. SBD amendment for GST

ii. SBD amendment for PBMC   

i. SBD amendment for GST


SBD amendment for provision of rate quotation exclusive of GST,The proposed amendments are as
below, the proposed amendment to existing clauses is highlighted in red color.

 Clause 13.3

13.3      All duties, taxes (other than GST, as  applicable) , royalties and other levies payable by the
Contractor under the Contract, or for any other cause, shall be included in the rates, prices, and total
Bid price submitted by the Bidder.

Clause 41.1

41.1     The rates quoted by the Contractor shall be deemed to be inclusive of the sales and other
levies, duties, royalties, cess, toll, taxes of Central and State Governments, local bodies and
authorities that the Contractor will have to pay for the performance of this Contract. The Employer
will perform such duties in regard to the deduction of such taxes at source as per applicable law.

41.1 The rates quoted by the contractor shall deemed to be exclusive of the Goods and Services Tax
(GST) and all taxes falling within the preview of GST-Act 2017 but including labour cess, other levies,
duties, royalties, cess, toll, taxes of local bodies and authorities that the contractor will have to pay
for the performance of this contract. The employer will perform such duties in regard to the
deduction of such taxes including GST at source, require deductions in this reference will be made as
per applicable law.

41.1(a) GST as per prevailing rate on last date of bid submission (presently @ 12%) shall be paid on
the whole work carried out, while making the payment.

Section 7

3.         The rates and prices tendered in the priced Bill of Quantities shall, except in so far as it is
otherwise provided under the Contract, include all constructional plant, labour, supervision,
materials, erection, maintenance, insurance, profit, taxes (other than GST , as applicable) and duties,
together with all general risks, liabilities and obligations set out in the Contract.

ii. SBD amendment for PBMC


A. There are various clauses in present SBD , which caters for payment for routine maintenance and
some of them requires amendments to cater for PBMC, Performance evaluation , marking system
and e-Marg. The relevant clauses are mentioned as below, the amendment to SBD is attached as
draft  , highlighting changes in red color for easy identification.

B. The existing SBD clauses are

P-34  - Clause 29.1,P-62- clause 32.3,32.4,P-63- clause 34.2,P-64- Clause 38.2,P-65 - Clause 39.4,P-66-
Clause 43.1,P-77 -Clause 4

Amendments proposed:
26.1 Within the time stated in the Contract Data, the Contractor shall submit to the
Engineer for approval a Programme showing the general methods, arrangements, order, and
timing for all the activities in the Works, for the construction of works. After the completion
of the construction works, the programme for the Routine Maintenance Work, showing the
general methods, arrangements, order and timing for all the activities involved in the Routine
Maintenance will also be submitted by the Contractor to the Engineer for approval. The
programme for Routine Maintenance will be submitted in each year for the period of
Maintenance.

32.4 The routine maintenance standards shall meet the following minimum requirements:-

(i) Potholes on the road surface to be repaired soon after these appear or brought
to his notice either during the Contractor’s monthly inspection or by the
Engineer.

(ii) Road shoulders to be maintained in proper condition to make them free from
excessive edge drop offs, roughness, scouring or potholes.

(iii) Cleaning of surface drains including reshaping to maintain free flow of water.

(iv) Cleaning of culverts and pits for free flow of water.

(v) Maintenance of road signs, pavement markings and other traffic control
devices

(vi) Any other maintenance operation required to keep the road traffic worthy at all
times during the maintenance period.

(vii) Maintenance of Cross -Drainage works.

32.6 The Engineer may issue notice to the Contractor to carry out maintenanceremovalof
defects or deficiencies in maintenance, if any, noticed in his inspection, or brought to his
notice. The Contractor shall remove the defects and deficiencies within the period specified
in the notice and submit to the Engineer a compliance report.

38.2 The payment to the Contractor will be as follows for routine maintenance:
The payment for routine maintenance of roads to the Contractor is
performance based  and at per km per year rate as provided in the contract-
a) Payment for routine maintenance will be performance based. For
certification of payment of routine maintenance, the engineer shall
determine whether the contractor has actually achieved compliance to
the Service Quality Level (and other requirements) specified in the
Scope of Work, with reference to 100 point (hundred point)
performance indexes assigned to various maintenance activities as
given in the contract data of GCC and the engineer shall certify the
amount to be paid to the contractor. If contractor has not corrected a
Defect pertaining to the Defects Liability Period or attended
maintenance work under clause 32 of these conditions, to the required
standard and performance index is below 80 points (eighty points) no
payment will be released for that period even if such maintenance is
attended in subsequent months. If performance index is 100 points full
payment, at the approved rate, shall be released. If performance index
is between 80 to 100, proportionate deduction in payment will be made
for the works not attended during that period.
b) For performance evaluation and payment of routine maintenance
individual road shall be the unit. Evaluation shall be done separately
for every km or part thereof (segment wise) and weighted average of
marks obtained shall be considered while making payment.
c) If any two segments get less than 80 marks or any particular segment
continuously gets less than 80 marks, the payment for whole road
shall be denied. 

Note: The performance evaluation of road will be done for each KM or part of
it, as the rates for maintenance are per KM basis. In addition to above general
criteria of payment based on marks obtained in performance evaluation, there
are other conditions also, like if two or more KM segment of road remains
unsatisfactory in consequent PEs etc. For detsils, bidders to refer the latest
SOP issued by NRIDA on Performance Based Maintenance Contract as
applicable on the day of bid submission .The PBMC system is a web based
system called e-Marg of latest version. The bill submissions by the
contractors, Performance evaluation , photographic records, payment etc is on
e-Marg and contractor is supposed to be well versed with the system. The
performance evaluation and marking system is broadly as per the SOP issued
by NRIDA and final marking is subject to the entire satisfaction of the
engineer , who has full authority to asses and give marks in PE.

(d) The Contractor shall submit to the Engineer a bill every month for the routine
maintenance of the roads from the date the maintenance period starts i.e. from
completion date as defined in Clause 1.1, it will be supported with a copy of
the record of the Contractor’s monthly inspection and other instructions
received from the Engineer. The performance evaluation on maintenance
condition of every road shall be done bi-monthly.

(e) The payment will be made Six monthly for the monthly bills received and as
certified by the Engineer based on performance by the Contractor.
(f) If the bill for a month is not received from the Contractor by the 10 th day of the
succeeding month or/ and if the Engineer has not certified that the Contractor
has carried out the maintenance work for defects/deficiencies brought to his
notice under clause 32.6 within specified period, no payment will become due
to the Contractor for that month.

(g) If the Contractor has failed to carry out the maintenance within the period
specified by the Engineer, no payment of any kind will be due to the
Contractor for that month.

39.4 Payment for the routine maintenance of the roads will be made Six Monthly for
the satisfactory maintenance of the Works and based on the monthly bills submitted
by the Contractor as per Clause 38.2 above and certified by the engineer, within 15
days of the date of each certificate

If performance of contractor during the period under consideration fulfils less than 80 out of
100 points, no payment will be made to the contractor for that period. If performance index is
