Republic of the Philippines Department ef the Interior and Local Government NATIONAL POLICE COMMISSION Makati, Metro Manila MEMORANDUM CIRCULAR__95-05 REGULATING THE RE-APPOINTMENT OF PNP OFFICERS AND MEMBERS WHO HAVE RESIGNED FROM THE SERVICE OR FILED A CERTIFICATE OF CANDIDACY FOR AN ELECTIVE PUBLIC OFFICE. SURJEDT 70 : CHIEF, PNP, REGIONAL DIRECTORS AND OTHERS CONCERNED WHEREAS, under Section 66, Article IX, of Batas Pambansa Blg. B81, as implemented by the COMELEC Resolution No. 2337, dated January 7, 1992, “any person holding a public appointive office or position, including active members of the Armed Forces of the Philippines, and officers and employees in government-owned or controlled corporations. shall be considered ipso facto resigned from his office upor the filing of his certificate of candidacy"; WHEREAS, in relation to the foregoing, Section paragraph (2), Book V, of the Revised Administrative Code hes the follawing limitations "No candidate who has lost in any election shall, within one year after election, be appointed to any office in the Government or any government— owned or controlled corporation or in any af its subsidiarie: WHEREAS, quite a number of PNP officers and members have resigned from the service, either to run for an elective public office ar solely by reason of adventurism in the guise of looking for "greener pastures", here or abread, and thereafter they seek re-appointment back te the police services WHEREAS, the re-appointment ef PNP officers and member’ who have resiqned under the aforementioned circumstances is inimical to the service, since they have already manifested their lack of interest to the police profession when, given an option to remain, they opted to leave the police organization and preferred to join a more lucrative employments NOW, THEREFORE, this Commission, in the exercise of its administration and control functions over the PNF, hereby directs and enjoins: cea) No PNP officer or member, who has resigned either to run for an elective public office or accept a more lucrative employment, shall be allowed re-entry into the police service, except when there is a shortage ot personnel and there is no other equally qualified applicant available within and outside the police organization. Re-appointment of PNP officers and members who have resigned under the aforementioned circumstances, when warranted under the foregoing conditions, shall be subject ta prior approval by this Commission.
