Once clear and the vehicle was out of this officer's sight, RBPD dispatch radioed this officer and advised the above vehicle was just reported stolen. The caller and owner of the vehicle, Nicole Sestito, mother of the driver Carmen Rivera, reported the car stolen by Rivera. At that time, | advised additional officers via radio of the last known location and direction of travel. Within a minute or two, officers were able to locate the accused vehicle and driver. Pil. Kennedy #198 advised dispatch he located the accused in the area off@MMF. Bergen PL. | responded to the scene and observed Pl. Kennedy attempting to speak to Rivera who was stil sitting inside the vehicle rolling her drivers window up. Ptiwm. Altimari #223 was also on scene standing near Ptl. Kennedy. After arriving on scene | took a moment to calll dispatch and get further details regarding the reported stolen vehicle. Once the information was confirmed, | exited my vehicle and made contact with Carmen Rivera who was now outside the vehicle standing near the rear. It shall be noted Mykayla Sestito (passenger of vehicle) was also standing near. It shall also be noted Rosemarie Sestito had exited her residence at@@M——E Bergen Pl and began acting in a disorderly manner yelling towards Rivera, "Why do you have Alex's Car?" | advised Rivera she was going to be detained and it appeared as if she began to walk away from this officer. | reached out and grabbed hold of Rivera's arms pulling her back towards me. There, | placed Rivera in handcuffs and again advised she was only being detained and not under arrest at that time due to reports of the stolen vehicle. After detaining Rivera, Rosemarie continued to yell stating," This cop putting cuffs on her" and " She just tumed eighteen years old!" It shall be noted Rosemarie had no involvement with the initial incident. Ptlwm. Altimari advised Rosemarie multiple times to cease her actions, which she failed to do so. At that point, Altimari advised she was going to detain Rosemarie. This officer assisted Altimari by holding Rosemarie's arm while Altimari applied handcuffs to her wrists. While doing so, Michael Ballard exiteqJJJE. Bergen PL. yelling towards officers "Get your hands off my wife!” Altimari placed Rosemarie inside patrol unit 107. Ballard then approached the scene in the direction of his wife, attempting to force his way around this officer. Ballard was advised by this officer to, “Step back." Ballard responded by yelling, "I'm a councilman" and threatened to call media and administration. Again, Ballard was advised multiple times to back up away from officers. Ballard continued yelling and eventually returned to his property. Lt. Sardo arrived on scene and spoke to Ptlwm. Altimari who advised Rosemarie was detained in the rear of her patrol vehicle. Rosemarie was released and Lt. Sardo accompanied her to her residence. Once the scene was in order, | spoke to Rivera who was compliant and sitting on the curb. While officers waited for Nicole Sestitio to respond to the scene, | took another moment to explain the situation and why Rivera was detained. Nicole Sestitio and her son, Alejandro Rivera, arrived shortly after. Nicole advised she wished to pursue complaints against Carmen for unlawfully taking the vehicle as she was not given permission to be in possession of same. Alejandro Rivera, when asked by Nicole Sestito, advised he did not grant Carmen permission to take possession of the vehicle. As the investigation continued, it was found Alejandro sent a text message to Carmen allowing her to utilize the vehicle to drive to a store and purchase tampons. Nicole was advised the incident would be documented and she had the right to pursue complaints if she wished. Nicole cleared the scene in a separate vehicle. Arrangements were made to have Carmen spend the night at Ballard's residence to eliminate any further incidents at home. It shall be noted this officer activated MVR 113 just prior to detaining Rivera and stopped prior to Alejandro taking possession of the vehicle. MVR 113 and 109 footage was saved to a DVD and entered into property (#RB-0044179). Nothing further to report at this time. 27. I assisted with a search of the area for a vehicle that was reportedly taken without the owner's permission, It should be noted that Ptl. Shea #222 had just released the vehicle and driver in question from a motor vehicle stop moments prior to dispatch advising the owner wishing to report it stolen. Pt. ‘Kennedy #198 advised that he located the vehicle on E. Bergen PL, where I was nearby and responded to assist. I approached the scene and noticed Ptl. Kennedy at the window of the vehicle where he was interacting with the ‘female driver, who was still inside the vehicle in the driver's seat. I observed the responses from the female driver to bbe confrontational and uncooperative. I exited my vehicle to assist Ptl. Kennedy. Shortly after, Ptl. Shea arrived on scene to assist. The driver exited the vehicle and placed the keys on the rear trunk of the vehicle and walked to an area on the sidewalk where there were two other subjects acquainted with the driver. I noticed one of the female subjects on the sidewalk was becoming antagonistic towards the female driver by making derogatory statements about her mother, who was the reporting party and owner of the vehicle. The statements were causing the female driver, identified as Carmen Rivera, to become upset and irate. The second ‘female subject was identified as Mykayla Sestito. At this time, an older female subject began shouting from the residence located aM. Bergen, I turned around sand noticed the female subject approaching Officers and Rivera. I asked Carmen and Mykayla who the female subject was and Carmen advised “her aunt”. The Aunt approached Carmen and began shouting at her. Carmen began to cry hysterically and shout back in response. It was evident that the scolding her Aunt was giving her was escalating the situation rather than diffusing. The Aunt was asked to refrain and step back, however she refused and continued yelling at Carmen, I then escorted the female subject away from the scene and attempted to diffuse the situation and explain the circumstances to her, however the female subject continued to shout at Officers and increase the tension at the scene, The female was asked again to calm down, but she then began walking away threatening to go inside and get her husband to further escalate the situation. At this time, for Officer safety and the safety of the civilians at the scene, the female subject was detained. Out of concern that the female subject would invite others to interfere with Police investigation and further escalate the situation, the female subject was detained. The subject was detained by being placed in handcuffs by myself and escorted to the rear of my patrol car where she was advised that she was, not under arrest and placed inside the rear of my patrol vehicle. Shortly after, LT. Sardo #194 arrived on scene to assist. After LT. Sardo was advised that the female subject ‘was was not under arrest, but detained LT. Sardo asked me for my handcuff key and assisted the female subject, from the rear of my patrol car. LT. Sardo removed her handcuffs and escorted her into her home at QQ. Bergen PL [At this time, the owner of the vehicle in question arrived on scene and was advised of the process to sign complaints against her daughter, Carmen, for taking the vehicle without permission by Ptl. Shea. Carmen was released from the scene and the vehicle driven by a licensed driver. Prior to clearing the incident, I was called to the porch of the female resident by LT. Sardo where he was standing with the female subject whom I earlier detained. Upon approaching the female subject, she identified herself to me as “Rose” and started a conversation with me regarding the incident. She identified herself as a councilman's wife and attempted to justify her actions at the scene and eluded to the idea that a curtesy should have been given to her due to her position and status in the community. I understood and listened to Rose's perspective and politely tried to reach commonality and empathy between both of our positions. At this point, I did not wish to continue the exchange with Rose and I ended the conversation and with the permission of LT. Sardo, I returned to my patrol car to carry out the remainder of my shift [No further action necessary and nothing further to report. P. KENNEDY #198 On this date at approximately 20:39 hours | was on patrol in marked patrol vehicle 6409. While patrolling near the intersection of Maple Ave. and Wikoff Pl. | heard Ptlm. Tanner Shea clear from a traffic stop that he had initiated near the intersection of Broad St. and Reckless Pl. Several seconds later | heard Police Dispatch radio Pim, Shea to inquire if he still had the vehicle he had stopped a silver Honda Accord (NJ. Reg 989 in sight. Police Dispatch was advising that the owner of the vehicle was attempting to report it stolen. Ptim. Shea responded that he had lost sight of the vehicle. At that time myself along with Ptlw. Altimari began to check the area surrounding area near the intersection of Broad St. and Leroy PI. where the vehicle was last observed by Ptlm. Shea. Approximately one to two minutes later | observed the vehicle parked curbside in the area of. Upon approaching the vehicle | observed a female standing curbside next to the vehicle who appeared to be speaking to someone inside of the vehicle. | observed the brake lights of the vehicle to be illuminated. | immediately exited my patrol vehicle and walked up along the drivers side of the parked vehicle. | recognized the female standing next to the vehicle as Mykayla Sestito who | am familiar with. | asked the female driver who was identified as Carmen Rivera what the situation was with the vehicle and if she was permitted to possess it at the current time. Rivera stated that her brother Alejandro Rivera gave her permission to use the vehicle to go to the store. Rivera stated that her mother Nicole Sestito was the registered owner of the vehicle, but that her brother is the main driver of the vehicle. While speaking with me Rivera seemed agitated and at one point attempted to roll up the driver's side window while | was speaking to her. At that time Ptiw. Altimari and Ptim. Shea had arrived on scene. Ptiw. Altimari approached the vehicle and remained with Carmen Rivera who was currently seated in the driver's seat. | approached Ptim. Shea who was still in his patrol vehicle gathering further information on the status of the vehicle from Police Dispatch. Ptim. Shea advised me that the mother of Carmen Rivera (Nicole Sestito) who ‘owns the vehicle was requesting to report the vehicle stolen out of this jurisdiction. Sestito was advising that her daughter was not permitted to operate the vehiole and she had taken it without her consent from their residence at QMS. Ptim. Shea advised me that Sestito had stated to Police Dispatch that she wished to sign a complaint against her daughter (Carmen Rivera) for taking the vehicle without her consent. Nicole Sestito and her son Alejandro Rivera were said to be on their way to the scene to retrieve the vehicle. At that time Carmen Rivera was advised that her mother had attempted to report the vehicle stolen. Carmen was advised that she could no longer operate the vehicle. She had exited the vehicle and was now standing on the sidewalk. Ptim. Shea and myself attempted several times to explain the situation to Carmen. She became visibly angry and attempted to walk away from Ptim. Shea. He advised her that she was being detained until her mother arrived on scene. This was so she could be spoken to by the officers on scene regarding the incident and complaints she wished to sign. Carmen began to ory and yell at Ptim. Shea. Ptim. Shea advised her once again that she was not free to leave at this time. Ptim. Shea advised Carmen to remain calm but she continued to yell at him and at one Point appeared to attempt to step away from him. At that time PtIm. Shea placed Carmen in handcuffs due to her behavior. Carmen then began to yell louder and requested that Mykayla Sestito go get her aunt who was identified as Rosemarie Sestito who lives at@—@ Bergen PI. Sestito approached from her residence appearing irate. Sestito demanded to know why Carmen was in police custody. Rosemarie Sestito approached and began to first talk to Carmen and then began to yell at her asking why she had taken the vehicle. Carmen continued to cry while Sestito questioned her. Rosemarie Sestito was advised several times to calm down and to back away from Carmen and the officers on scene, She comntinued to yell abusive language at Ptim. Shea and Ptlw. Altimari. At that time Sestito was advised to go back across the street to her property due to her irate conduct. She was clearly obstructing the investigation with her disorderly behavior specifially by standing in the roadway yelling and screaming at the officers on scene. Sestito was advised several more times to back away by Ptim, Shea and Ptlw. Altimari. Sestito continued to refuse, yelling verbal abuse along with stating that she was the wife of a councilman. At that time | was speaking with Carmen Rivera who was seated on the curb next to the parked vehicle. | was attempting to calm her down and once again explain what was happening. At that point I heard Sestito continuing to yell at and argue with officers Shea and Altimari. | could hear the officers ordering her to back away as she was clearly causing the situation to escalate. As | tumed around | observed Ptlw. Altimari placing Sestito in handcuffs. While doing so | could hear a male subject who was identified as Michael Ballard yelling at officer Altimari to take her hands off of his wife. He abruptly approached officers Shea and Altimari as they were handcuffing Sestito. Officer Shea ordered Mr. Ballard several times to back away and he refused to do so, Yelling, “"'m a councilman!" At that time | approached Mr. Ballard who was still standing in the center of the roadway yelling. | advised him to calm down and to step back. | asked him to step to the side and speak to me. I calmly advised Mr. Ballard that | would explain the situation to him. He continued to raise his voice stating that he was going to contact Police Chief McConnell along with the media. At that time Ballard walked out of the roadway, away from me and back onto his property stating he was going to call the Police Chief. At this time Lt. Sardo arrived on scene and began to speak to Mr. Ballard in front of his residence. Several minutes later Police Chief McConnell arrived on scene. He also went to Ballard's residence to speak with him. Iremained on scene and spoke to the owner of the vehicle in question Nicole Sestito along with her son Alejandro Rivera who had just arrived. Nicole Sestitio stated that her daughter Carmen Rivera is fully aware that she is not to use the vehicle. Sestito stated that her daughter took the vehicle keys without her brother's knowledge while he was taking a shower. Sestito stated that she was not at home at the time the vehicle was taken by Carmen. Nicole Sestito stated that she would respond to The Red Bank Municipal Court on the following date to sign complaints against her daughter for taking the vehicle. She stated that she had been experiencing similiar ongoing issues with Carmen that have led her taking legal action against her. Sestito was advised that a report regarding the incident would be completed and that she could come to The Muncipal Court to sign a complaint against her daughter at her convenience. At that time the vehicle was released to Sestito who left the area with her son. Carmen Rivera stated that she was going to remain at Mr. Ballard's residence for the evening in order to avoid further issues with her mother. At that time I cleared from the call End of report. During which time, | was wearing my Class A Summer Uniform and was operating marked patrol vehicle 6404. At approximately 8:39 PM, | was at Red Bank Police Headquarters when | heard Ptim. Tanner Shea #222 clear from a traffic stop in the area of Broad St and Reckless PI. Seconds later, | heard Ptim. Francesco Metta #230, who was assigned to police dispatch for the shift, radio Ptim. Shea from Headquarters. Ptim, Metta advised Ptim. Shea that the vehicle which he cleared from the traffic stop with was being reported as stolen by the registered owner. | then heard Ptim. Shea advise other units that he had lost sight of the vehicle and requested assistance in locating same. Patrol units saturated the area and the vehicle was ultimately located on E. Bergen Pl just east of Maple Ave by Ptim. Patrick Kennedy #198. Shortly thereafter, Ptim. Kennedy requested via radio, that | meet with the patrol units at their location. As | was responding, Ptim. Shea also requested | respond, during which time | could hear yelling in the background of the radio transmission. ‘At approximately 8:44 PM, | arrived on scene where | observed the driver of the vehicle in question, Carmen Rivera, detained on the side of the road by Ptim. Shea. During this time, Councilman Michael Ballard was walking from the sidewalk area towards his residence located at @l Bergen PI. | called for him, however; he appeared to be irate and continued to walk inside his residence. There were also two other subjects in the middle of the roadway video recording the officers on their cell phones where officers were conducting their investigation into the potential theft of a motor vehicle. The two subjects were identified as Isaiah Sestito and Mykayla Sestito. | approached them and kindly asked them to move off to the sidewalk, out of the roadway, as they continued recording for their safety. | then met with Pt. Kristin Altimari #223 who informed me of the details surrounding the investigation. Ptlw. Altimari stated that Rivera was detained until the owner of the vehicle arrived on scene to see if she wished to pursue the matter with criminal complaints. Ptiw. Altimari also stated that she detained Rosemarie Sestito who involved herself into the ongoing investigation by running out of, her house and yelling at the officer's in a disorderly manner during the performance of their duties. Rosemarie Sestito was also yelling at her niece, Carmen Rivera, further aggravating the situation. After being briefed, and Ptiw. Altimari confirming that Rosemarie was not under arrest, | released Rosemarie and walked her to her residence to speak with her and Councilman Ballard, During this time, Police Chief Darren McConnell #173 arrived on scene and accompanied us inside the home. While inside Rosemarie was complaining about the manner in which officers spoke to her and the way she was detained along with the amount of police vehicles that responded to a motor vehicle stop. Rosemarie also complained about her 18-year-old niece getting placed in handcuffs in an aggressive manner. explained to Rosemarie that she should not have gotten involved in the investigation. | also explained that several units were assisting in locating the vehicle because the call for service was for a theft of a motor vehicle not a motor vehicle stop.
