24-B(3) of The Patents Rules, 2003 (as amended) ) in respect of above-mentioned application. This report is
issued with reference to a request for examination dated 18/04/2016.The last date for filing a response to the
Examination Report (i.e. a period to comply with all the requirements raised in this examination report) is six
months from the date on which the first statement of objections is issued to the Applicant.

Claim(s) (1-6) lack(s) inventive step, being obvious in view of teaching (s) of cited document(s) above under
reference D1-D3 for the following reasons:
Without prejudice to other objections, the apparatus claims 1-6 of the present application does not meet the
criteria u/s 2(1)(ja) of the Indian Patents Act, 1970 (as amended) from the disclosed subject-matter of Documents
D1-D2.
Document D1 discloses a mobile phone is provided with an upper housing coupled to a lower housing with free
opening/closing via a hinge. A board housing recess is formed on the front face of a middle casing of the lower
housing and an antenna housing recess is formed on the back face [abstract]. It provides a mobile wireless
device having a built-in antenna in the housing, comprising the housing having a first resin casing in which a first
housing recess which houses a circuit board and a second housing recess which houses the antenna are
separately formed, the first housing recess is covered with a second resin or metal casing with the circuit board
housed therein, the second housing recess is covered with a third resin casing with the antenna housed therein
[para 0007].
Document D2 discloses a battery cover locking device and a mobile communication terminal having the same,
comprising: a main body; An electronic device coupled to the main body and including a battery cover to protect a
battery mounted on the main body, the electronic device comprising: a locking unit formed between the main body
and the battery cover to couple the battery cover to the main body [abstract]. It relates to a battery cover locking
device and a mobile communication terminal having the same, and more particularly, a battery cover for coupling
or detaching a battery cover coupled to the main body. Two methods are largely used to couple the battery cover
of the soft pack battery to the main body of the electronic device. The first method is a hook method, in which
hooks corresponding to the body of the electronic device and the battery cover are respectively formed to be
coupled to each other. To release this coupling, the entire battery cover must be pressed so that the hooks are
spaced apart from each other. The second method uses a spring and forms a locker that is elastically supported
by the spring on the main body of the electronic device and forms a hook that is coupled to the locker on the
battery cover. In order to release the coupling, the hook must be released by pressing the locker against the
elastic force of the spring. The locking unit is formed between the main body of the electronic device and the
battery cover to couple the battery cover to the main body. The battery cover protects a battery mounted on the
main body from the outside. The unlocking unit is mounted to the battery cover and releases the locked state
between the battery cover and the main body by the locking unit when the user operates. The unlocking unit is
mounted on the battery cover; the battery cover has a different distance from the main body according to the
capacity of the battery may have an unlocking unit having a size corresponding to the interval. Accordingly, as the
size of the battery cover is changed, there is no problem of structural inconsistency in the locking device that
occurs when the battery cover and the main body are engaged. The locking unit includes a main body locking
part formed on the main body and a cover locking part formed on the battery cover. The cover locking portion is
formed at a position corresponding to the main body locking portion and is locked to the main body locking
portion. Accordingly, the battery cover is to be kept locked without being separated from the main body.
Document D3 discloses a battery cover locking mechanism, which is used for locking a battery cover on a panel.
The battery cover locking mechanism comprises an elastic body arranged on the panel and an operating piece,
wherein the elastic body is wavy strip-like, and has a plurality of crests; the battery cover is locked with the panel

and pressed against the crests of the elastic body through the operating piece; and when the battery cover and
the operating piece are unlocked, the elastic body bounces the battery cover. The battery cover locking
mechanism has a simple structure and can conveniently open a cover body [abstract].
The technical features proposed in the claims 1-6, hence cannot be considered to add anything new or inventive
to the technical features as disclosed in the prior art, and are seen as mere modification, which is obvious to a
person skilled in the art.
Hence, it may be said that the present claims 1-6 do not meet the requirements of inventive step of The Indian
Patents Act, 1970 (as amended).

Claim(s) 1-6 are not clearly worded in respect of:
1. The independent claims do not clearly state the problems of the prior art, and the solution put forth by the
present invention. They do not clearly bring out the inventive feature of the present invention.
2. To meet the requirements of section 10(4) of The Indian Patents Act, 1970 (as amended) in combination with
rule 13 of The Indian Patent Rules, 2003 (as amended), the independent claim(s) should be cast in such a way
that those features which are in combination to those features of the prior art should be placed in the
‘characterizing’ part of the claim(s). The characterization part shall clearly bring out the inventive feature of the
alleged invention.
3. The vague and imprecise term ‘spirit’ in the description in the last paragraph implies that the subject-matter for
which protection is sought may be different to that defined by the claims, thereby resulting in a lack of clarity of
the claims when the description is used to interpret the claims. Such a statement should, therefore, be amended
to remove this inconsistency.
4. Distinguishing the features with regard to prior literature is necessary to examine technical advancement over
the prior art.

The Indian Patents Act, 1970 (as amended) along with a marked-up copy and in proper format indicating the
portion (page no. and line no.) of the complete specification as filed on which these amendments are based on.
Further, the pages wherever amendments are carried out need to be freshly typed on white pages and to be filed
in duplicate. Reasons for making such amendments shall also be mentioned clearly.
2. It may be noted that the examination has been done on the basis of all the electronically uploaded documents
in the e-module only.
3. All the submitted documents and forms have been presumed as originally signed by the authorized signatory
under the provisions of the Patents Act, 1970 (as amended). If not, then submit the original signed copy of the
same failing to which the document may not be considered filed.
