STATEMENT OF PROBLEM

What are the crimes against the body of the person of the highest degree and under what
circumstances does Culpable Homicide amounts to Murder under Section 300 of IPC

OBJECTIVES OF STUDY

1. To understand the scope of Section 300 of IPC.


2. To understand the scope of Culpable Homicide amounting to murder.
3. To understand essentials/ingredients constituting offence of Murder under IPC
4. To Research about the topic with help of latest case laws and judgments.

HYPOTHESIS

Offences against human body are of certain degrees which result in certain fatalities.
The highest degree of the offence is of the offence of “Murder” which is defined
under section 300 of IPC. Murder is Culpable Homicide in an aggravated degree.
Culpable Homicide is defined under Section 299 of IPC as when the act is done with
intention of causing death or causing a bodily injury is likely to cause death. Section
300 of IPC defines Murder. Culpable Homicide amounts to murder when the act is
committed with an intention to cause death. The act is done with the intention of
causing such bodily injury which the offender has knowledge that it would result in
death.
The person has the knowledge that his act is dangerous and would cause death or
bodily injury but still commits the act, this would amount to murder.
Hence every Murder is a Culpable Homicide but every Culpable homicide is not a
Murder. A case of culpable homicide is murder if it fall any of the four clauses of
Section 300.
