(1) Kind reference may please be made to the letter dated: 16-02-2020
received from Sri D.Mallikarjuna Pillai, Asst. Wireman O/o DY.E.E(Elec)-I,
TTD, Tirupati. In the said letter he has stated that, while he was attending
his duties at Street lights near Divyaramam on 15-02-2020, he faced
electrical shock and fallen down and his right hand wrist was severely
injured and went to TTD Central Hospital, Tirupati for treatment. After
first-aid they referred to SVIMS, Tirupati. In SVIMS, Tirupati he had taken
preliminary diagnosis and confirmed severe injury to his right hand wrist
and advised to take further treatment from Orthopaedic Surgeon.
(2) Accordingly he taken treatment in Suraksha Hospital, Tirupati and
the doctor has advised to take bed rest from 16-02-2020 to 20-03-2020
vide Medical certificate dt:16-02-2020 and he has requested the
Authorities to grant the Medical Leave as Special Disability Leave for 33
days (16-02-2020 to 20-03-2020) as the accident was happened while on
duty, according to the rules stipulated under FR. 83 (1) of A.P.
Fundamental Rules.
(3) Consequently, he has joined in his duties after availing the Medical
Leave on Special Disability Leave on 21.03.2020 F.N, the fitness
certificate dated: 20.03.2020 issued by the Dr.B.Hemakumar Reddy,
Orthopaedic Surgeon, Suraksha Hospital,Tirupati is placed below perusal.
The FR 83 (1) as follows:
(i) Subject to the conditions hereinafter specified the State
Government may grant Special Disability Leave to a Government
Servant Whether, permanent or temporary, who is disabled by
injury intentionally inflicted or caused in, or in consequence of the
due performance of his official duties or in consequence of his
official position.

(ii) Such leave shall not be granted unless the disability manifested
itself within three months of the occurrence to which it is attributed
and the person disabled acted with due promptitude in bringing it to
notice. But the President of India, if he is satisfied as to the cause
of the disability, may permit leave to be granted in cases where the
disability manifested itself more than three months after the
occurrence of its cause.

(iii) The period of leave granted shall be such as is certified by a


Medical Board in the case of Gazetted Government servants and
Civil Surgeons in the case of Non-Gazetted Government servants
to be necessary. It shall not be extended except on the certificate of
a Medical Board in the case of Gazetted Government servants and
Civil Surgeons in the case of non-Gazetted Government servants
and shall in no case exceed 24 months.

(4) As per the above rule position, the incumbent has brought the
occurrence of the accident within the period of three months to the notice
of the Leave sanctioning Authorities, hence the leave availed by the
incumbent can be granted as Special Disability Leave, as per the above
said rules.

(5) In view of the above, the Medical Leave from 16-02-2020 to 20-
03-2020 (33 Days) availed by Sri D.Mallikarjuna Pillai, Asst. Wireman O/o
DY.E.E (Elec)-I, TTD, Tirupati, may please be granted as “Special
Disability Leave” as per the above rules stipulated under FR No. 83 (1) as
the incumbent met with an accident while on duty.
