PART I – ABOUT THE CITIZEN’S CHARTER


INTRODUCTION

Good governance is essential for sustainable development, both


economic and social. The essential aspects pointed as elements of good
governance are transparency, accountability and responsiveness of the
administration. The “Citizen’s Charters initiative” is a response to the pursuit of
viable solution which a citizen encounters, day in and day out, while dealing with
local government in providing public services.

This Guidebook is a tool developed purposely to conform to the provision


of Republic Act No. 9485, otherwise known as the Anti-Red Tape Act of 2007
which requires all government agencies including local government units to set
up their own service standards known as the Citizen’s Charter. It is also founded
on the premise that the government as an institution provides and facilitates
numerous essential public services– one, that is distinguished to be not only
effective and efficient but transparent. It is hope that this mechanism empowers
the public in citizenry by promoting transparency, accountability, honesty in
service delivery.

Component of the Citizen’s Charter

The Malay Citizens Charter is composed of six–part information


composed of the following:

a. Map of the Municipal Government Offices;

b. Vision and Mission;

c. The Municipal Government Frontline Services which are divided into


two (2) major frontline service categories, the Economic and Related
Services and Social and Related Services. The Economic and
Related Services contains list of services rendered in the areas of
Business and Investment, Infrastructure, Agriculture, Transport and
Traffic Management, Livelihood and Employment, and other Related
Service while the Social and Related Services contains a list of

services along the areas of Administration, Civil Registration,


Legislative, Local Planning, General Services, Health, Real Property
Assessment, Social Welfare, Tourism and Solid Waste Management;
and

d. Service Standards and Performance Pledges.– The service standards


provides information about the service, the requirements involved, fee
or charges (if necessary, the procedures involved, the time needed to
do the service and the person responsible in delivering the service.
Aside from which, the Municipal Government commits to adhere on
the provisions of Republic Act No. 9485, particularly Section 8 and 9
of the said Act. The performance pledge on the other hand, expresses
the commitment of the service provider.

e. Complaints and Redress Mechanism.– The Municipal Government


through its officials and employees shall guarantee the delivery of the
service as promised in the Citizen’s Charter. For this purpose,
feedback mechanisms shall be provided but not limited to the
establishment of information or service desk, putting–up of suggestion
boxes in offices, and making accessible customers feedback form.

f. In the event that the customer is not satisfied with the level of service
performance, a complaint may be brought to the notice of their
respective Head of Office for immediate redress. If the complaint is
not rectified to satisfaction, the matter may be brought to the attention
of the Municipal Mayor.

Uses of the Citizen’s Charter

The Citizen’s Charter is designed to serve at least two (2) major uses.
First, it serves as a citizen’s guide to public services and second it serves as a
manual of operations for the local government employees and staff.

As a Citizen’s Guide to Public Services, the Malay Citizen’s Charter


provides information that will facilitate public’s transaction with ease. It helps the
public, as client of LGU’s services, identify the right office to approach when
obtaining a particular service, what requirements to bring and what systems and
procedure to observe. On the other hand, as Manual of Operations, it serves a
guide in the performance of their mandated duties and functions in the delivery of

a frontline service. I will also serve as a reference in determining work and the
level of performance expected from the service.

Benefits of the Citizen’s Charter

The concept of Citizen’s Charter enshrines the trust between the


Municipal Government as the service provider and the public as users. More than
just a mere guidebook, a manual of operations or an expression of commitment,
the Citizen’s Charter must be recognized as a leap towards the envisioned state
of being a ‘premier destination”.

Since the Charter promises the highest standards for service delivery, it
offers a wide range of benefit both for the local government and the user. For the
user, it guarantee customer satisfaction, equal treatment in accessing the
service, right to manifest complaints and demand for redress, and provided
opportunity for people participation in service improvement. The Municipal
Government likewise reaps benefit, among others are: (1) Efficient procedures
will result to less cost of public service delivery; (2) Defined systems and
procedures will lessen discretion of service providers which oftentimes are the
source of graft and corruption; (3) Provision of feedback mechanisms if taken
positively will most likely result in improving service delivery; and (4) Service
standards provides basis for assessing performance useful in human resource
development function, such as career advancement, rewards and incentives,
capacity development, among others.

It is with fervent hope that this document serves the very purpose of
improving the quality and reach of services delivered by the municipal
government.

APPLYING/RENEWING A BUSINESS PERMIT


ABOUT THE SERVICE

All enterprises are required to secure a Business License and Mayor's Permit, and
pay business taxes and other regulatory fees before the start of commercial
operations.

The application forms, together with the list of requirements, are now ready in the
Licensing Office so to provide business owners and operators with ample time to
prepare the necessary requirements to avoid penalties and/or surcharges for
delayed transactions. For inquiries, please contact the Licensing Office through

PAYING REAL PROPERTY TAXES


ABOUT THE SERVICE

OWNERS of land and buildings have to pay real property taxes annually. Taxes
are percentages of the property’s taxable value.

Real Property tax payments are made at the Land Tax Division of the Municipal
Treasurer’s Office. Taxpayers may choose to pay on an annual or quarterly basis.
Discounts are given to those who pay in advance.

PAYING TRANSFER TAXES


ABOUT THE SERVICE

TRANSFER TAXES are paid for transactions involving transfer of ownership of


real property.

The tax should be paid within 60 days from the date of execution of the deed as
regards sales, barter, donation or any mode of transferring ownership or from the
date of the decedent’s death, in case of transfer by succession. Penalties and
interests are imposed after the lapse of the 60-day period.

BUSINESS ESTABLISHMENTS that have closed or ceased to exist, or whose


ownership has changed, must file with the Office of the Mayor, through the

This should be done to update the municipal government’s records and to avoid
accumulation of defaulted tax obligations and penalties.

ABOUT THE SERVICE

One of the services being rendered by the Office of the Municipal Building Official
is the issuance of Building Permit.

In order to obtain the permit, the applicant shall file an application therefor in writing
with the Office of the Building Official.

● Fire Evaluation Report


● BRTF Certificate of Compliance (25+5 for beachfront projects and
Preliminary Compliance for all start-up or new constructions including
additions and expansions for non-occupancy permit holders) or Addendum
Certificate for previously issued compliance certificates opting for changes or
amendments in plans.
● ECC or CNC or amended ECC or CNC, when applicable
● Special Land Use Permit or FLAGt for forest lands or wetlands.

All motorized vehicles operating in Boracay Island must secure a Special Permit

ABOUT THE SERVICE

Section 4 of Municipal Ordinance No. 254, Series of 2007, requires all project
proponents, contractors, hotel or resort or business establishment proprietors
and/or operators to secure a certification from the Municipal Public Employment
Service Office of LGU-Malay certifying that the provisions of the same Ordinance
has been complied. The PESO Certification shall form part of the requisites to be

REGISTRATION OF BIRTH, MARRIAGE CERTIFICATES


AND DEATH CERTIFICATES
ABOUT THE SERVICE

Republic Act 3753 mandates the establishment of a civil register in the Philippines
where acts, events, legal instruments and court decrees concerning the civil status
of person shall be recorded.

The birth of the child, being a vital event of a person, shall be registered within
thirty (30) days from the time of birth in the office of the Civil Registrar of the
municipality where the birth occurred.

For ordinary marriage, the time for submission of the Certificate of marriage is
fifteen (15) days following the solemnization of marriage while for marriage exempt
from license requirement, the prescribed period is thirty (30) days, at the place
where the marriage was solemnized.

While it shall be the responsibility of the nearest relative or spouse who has
knowledge of the death to report the same within forty-eight (48) hours if the
deceased died without medical attendance.

The Health Officer shall examine and sign the death certificate and direct the
registration of the death certificate to the Office of the Civil Registrar within the
reglementary period of thirty (30) days.

APPLYING FOR MARRIAGE LICENSE


ABOUT THE SERVICE

Where a marriage license is required, each of the contracting parties shall file
separate sworn application for such license with the proper local civil registrar of
the place where either or both of the contracting parties reside.

The local civil registrar concerned shall enter all applications for marriage files with
him in a registry book strictly in the order in which the same are received.

When the license is issued, the same shall be valid in any part of the Philippines
for a period of one hundred twenty (120) days from the date of issue, and shall be
deemed automatically cancelled at the expiration of said period if the contracting
parties have not made use of it.

ABOUT THE SERVICE

These services are available as per requst of the MHO and request from other
clinics/hospitals.

REQUIREMENT(S)

For blood chemistry examinations, advise patient to observe NPO (Nothing per
Orem or “Mouth”) or fasting prior to testing.
For routine microscopy, instruct patient for proper specimen collection.
For water analysis, instruct client for proper procedures of water sampling.

SCHEDULE OF EXAMINATIONS

 For blood chemistry, schedule is 7:00 to 8:30 a.m. every Wednesday


 For routine microscopy, schedule of receiving of specimen is 8:00 a.m. to 10:00
a.m. and 1:00 p.m. to 4:00 p.m. daily. Specimens coming beyond this time are
advised to come back the next day.
 Prenatal laboratory requests are accommodated on Fridays, 8:00 to10:00 a.m.
and 1:00 to 4:00 p.m. (MHO Main) and Wednesdays from 8:00 a.m. to 10:00
am. (MHO Annex)
 Sanitary Permits laboratory requirements are accommodated every Mondays,
Tuesdays, Thursdays and Fridays from 8:00 a.m. to 10:00 a.m.

The Municipal Health Office (MHO) is a Newborn Screening Facility in compliance


with Republic Act 9288, Newborn Screening Act of 2004. A public health program
at early identification of infants who are affceted by certain
genetic/metabolic/infectious conditions which could lead to significant reduction of
morbidity, mortality, and associted disabilities in affacetd infants.

Newborn age 24 hours to 72 hours may avail of the service.

ABOUT THE SERVICE

Section 202 of Republic Act 7160. Any person, natural or juridical, owning or
administering real property or his authorized representative is required to file a
sworn statement declaring the true current and fair market value of his property,
whether previously declared or undeclared, taxable or exempt, with the provincial,
city or municipal assessor where the property is located once every three (3) years
during the period from January first (1 st) to June thirtieth (30th) commencing with
calendar year 1992.

Section 203 of Republic Act 7160. Duty of Person Acquiring Real Property or
Making Improvement Thereon. Any person, who acquires any kind of real property
or his authorized representative, shall file a sworn statement declaring the true
current and fair market value of the subject property with theaAssessor where the
property is located within sixty (60) days from date of execution of the deed of sale
or conveyance.

ABOUT THE SERVICE

Republic Act 7610 mandates the DSWD to issue a travel clearance to


unaccompanied minors traveling abroad or a written permit or justification from the
child’s parents or legal guardians (Article IV, Section 8a) as a measure to protect
children and prevent trafficking.

MECHANISM, AND DIRECTORY
The Municipal Government through its officials and employees shall
guarantee the delivery of the service as promised in the Citizen’s Charter. For
this purpose, feedback mechanisms shall be provided but not limited to the
establishment of information or service desk, putting–up of suggestion boxes in
offices, and making accessible customers feedback form.

In the event that the customer is not satisfied with the level of service
performance, a complaint may be brought to the notice of their respective Head
of Office for immediate redress. If the complaint is not rectified to satisfaction, the
matter may be brought to the attention of the Municipal Mayor.

AN ORDER REORGANIZING THE STEERING COMMITTEE AND TASK


FORCE FOR THE REVISION OF THE MALAY CITIZEN’S CHARTER.

WHEREAS, local government units have been mandated by R.A. 9485,


otherwise known as the Anti-Red Tape Act of 2007, to set up systems and
procedures, service standards and commitments in the delivery of basic frontline
services to be known as the Citizen’s Charter;

WHEREAS, pursuant with this policy, the Malay Citizen’s Charter was first
established through Executive Order No. 198, Series of 2009, and consequently
approved and adopted by the Sangguniang Bayan by virtue of Municipal
Ordinance No. 280 in September, 2009;

WHEREAS, with the staffing changes and additional frontline services introduced
in the past years, there is a need to revisit the Malay Citizen’s Charter, which
likewise call for the reorganization of the Steering Committee and Task Force
created for the purpose;

NOW THEREFORE, by virtue of the powers vested upon me as the Local Chief
Executive of the Municipality of Malay, I hereby order the following:

Section 1. Reorganization of the Steering Committee for the revision of the


Malay Citizen’s Charter. The Steering Committee is hereby reorganized with
the following composition:

Section 2. Terms of Reference for the Steering Committee. The Steering


Committee shall perform the following functions:

 Act as the LCE’s advisory council in the overall direction and supervision of
the Citizen’s Charter initiative’s implementation;
 Assist the LCE in setting the goals and objectives of the Citizen’s Initiative;
 Assist the LCE in the review and refinement of the Citizen’s Charter;
 Lead in advocating and lobbying for the institutionalization of the Citizen’s
Charter to the Sangguniang Bayan through an appropriate ordinance.

Section 3. Reorganization of the Task Force on the revision of the Citizen’s


Charter. The Task Force is hereby reorganized with the following composition:

lead in the review of their offices’ frontline services in terms of procedure,
requirements, charges and fees, in the setting of new service standards and
in the conduct of consultative meetings with the consumers or beneficiaries of
the services provided by their departments;
 The Department Heads shall also be in charge of writing their offices’ new
procedures, list of requirements, and schedule of charges and fees for
submission to the Task Force Head;
 The Task Force Head shall see to it that standards and deadlines with regard
to the Citizen’s Charter preparation are met, assume responsibility for the
review, consolidation and finalization of the published form of the Charter;

 The Deputy Heads, shall assist the Task Force Head in the review and
consolidation of the Department’s outputs, as well as in the finalization of the
Charter.

Section 5. Effectivity. This Executive Order shall take effect immediately.

AN ORDINANCE PRESCRIBING FOR SYSTEMS AND PROCEDURES,


SERVICE STANDARDS AND COMMITMENTS IN THE DELIVERY OF
MUNICIPAL GOVERNMENT FRONTLINE SERVICES TO THE PUBLIC
THROUGH THE ADOPTION OF THE CITIZEN’S CHARTER OF THE
MUNICIPALITY OF MALAY–A GUIDEBOOK FOR MUNICIPAL GOVERNMENT
FRONTLINE SERVICES.

SECTION 1. Short Title.– This Ordinance shall be known as The Citizen’s


Charter of the Municipality of Malay – A Guidebook for Municipal Government
Frontline Services.

SECTION 2. Purpose.– This Ordinance is enacted in pursuance to the provision


of Republic Act No. 9485, otherwise known as the Anti-Red Tape Act of 2007
which requires all government agencies including local government units to set
up their own service standards known as the Citizen’s Charter. It is also founded
on the premise that the government as an institution provides and facilitates
numerous essential public services– one, that is distinguished to be not only
effective and efficient but transparent. Therefore, not only is this legislative
measure timely but a paramount policy that brings reform in public service.

SECTION 3. Declaration of Policies.– It is hereby declared the policy of the


Municipal Government of Malay to bring about pro–active and responsible
governance by promoting transparency, accountability, honesty and proper
management of the local government affairs and properties. Towards this end, it
shall endeavor to:

a. Adopt a continuous and progressive system of public service delivery


which will generate customer satisfaction;

b. Create an environment conducive to the promotion of responsible and


responsive delivery of services to the public; and

c. Establish a feedback mechanism that would ensure the practicability


of the systems and procedures involved in the delivery of frontline
services.

SECTION 4. Citizen’s Charter: Definition, Nature and Scope.– (a)


Definition.– Citizen’s Charter is an official document, a service standard, or a
pledge, that communicates, in simple terms, information on the services provided
by the Municipal Government through its existing offices, units or sections. It
describes the step–by– step procedure for availing a particular frontline service,
and the guaranteed performance level that the public may expect from the
service.

(b) Nature and Scope.– The Malay Citizens Charter herein referred to is a
written document, crafted by the Municipal Steering Committee created through
Executive Order No. 198, issued by the Municipal Mayor.

The Malay Citizen’s Charter is a tool through which the quality of public service
can be improved by letting them know of the frontline service delivered by the
offices/units/sections of the Municipal Government, procedures involved in
delivering the service, and what the public should expect and how to seek
remedy if the service standard set is not met.

SECTION 5. Component of the Citizen’s Charter.– The Malay Citizens Charter


is composed of a five–part for information composed of the following:

a. Map of the Municipal Government Offices, Vision and Mission;

b. The Municipal Government Frontline Services which are divided into


two (2) major frontline service categories, the Economic and Related
Services and Social and Related Services. The Economic and
Related Services contains list of services rendered in the areas of
Business and Investment, Infrastructure, Agriculture, Transport and
Traffic Management, Livelihood and Employment, and other Related
Service while the Social and Related Services contains a list of
services along the areas of Administration, Civil Registration,

Legislative, Development Planning, General Services, Health, Real


Property Assessment, Social Welfare, Tourism and Solid Waste
Management; and

c. Service Standards and Performance Pledges.– The service standards


provides information about the service, the requirements involved, fee
or charges (if necessary, the procedures involved, the time needed to
do the service and the person responsible in delivering the service.
Aside from which, the Municipal Government commits to adhere on
the provisions of Republic Act No. 9485, particularly Section 8 and 9
of the said Act. On the other hand, the performance pledge expresses
the commitment of the service provider; and

d. Complaints and Redress Mechanism.– The Municipal Government


through its officials and employees shall guarantee the delivery of the
service as promised in the Citizen’s Charter. For this purpose,
feedback mechanisms shall be provided but not limited to the
establishment of information or service desk, putting–up of suggestion
boxes in offices, and making accessible customers feedback form.

In the event that the customer is not satisfied with the level of service

6.b Undertake review of the Citizen’s Charter, not less than once
every two years to guarantee the responsiveness of the systems
and procedures involve in delivering a particular frontline service;
and

6.c Deliver the services with honesty, transparency and


accountability.

SECTION 7. Funding.– The Municipal Government shall provide in its Annual


Budget not less than ½ of 1 percent of the total allocation for Maintenance and
Other Operating Expenses.

SECTION 8. Separability Clause.– If for any reason or reasons, any part or


provision of the Ordinance shall be held unconstitutional, inoperative or invalid,
other parts or provisions which are not affected shall continue to be in force and
effect.

SECTION 9. Repealing Clause.– Ordinances, executive orders and other


administrative issuance or any of its part or parts inconsistent with this Ordinance
are hereby repealed, amended or modified accordingly.

SECTION 10. Effectivity.– This ordinance shall take effect fifteen (15) days
upon approval.
