Introduction

This is the proposed rule for sitting criteria for establishment of Brick
Kilns in Uttar Pradesh to be notified under section 54(2) (Z) read with section
21(1) of the Air (Prevention & Control of Pollution) Act, 1981 (Act No. 14 of
1981).
The proposed rule has been sent to the State Government. Environment
Department for further necessary action.
It is also being put on the Uttar Pradesh Pollution Control Board's
Website (www.uppcb.com) for 30 days to invite comments and suggestions of
all concerned Brick Kilns Owners, Grove/orchard holders and public at large.
Please send your comment on Board's website for consideration within
aforesaid period.

In pursuance of the provisions of clause (3) of Article 348 of the

constitution, the Governor is pleased to order the publication of the following
English translation of notification no. 2011 dated 2011

In exercise of the powers under section 54 (2) (z) read with section 21 (1)
of the Air (Prevention And Control) of Pollution) Act, 1981 (Act no.14 of
1981) the Hon'ble Governor, after consultation with the Uttar Pradesh
Pollution control Board is pleased to make the following rules with regard to
the sitting criteria for establishment of new brick kilns in State of Uttar
Pradesh:-

 THE UTTAR PRADESH BRICK KILNS (SITING CRITERIA FOR
ESTABLISHMENT) RULES, 2011

1. (1) These rules may be called the Uttar Pradesh Brick Short title and
Commencement
kiln(Sitting Criteria For Establishment) Rules, 2011
(2) They shall come into force with effect from the date
of their publication in the Gazette.

2. Following distance criteria may be adopted for installing in

a new brick kiln:

(1) Brick kiln shall be established at least 500 m away Distance from
residential area/
from residential area having a minimum population of population
100-150 people or 20 houses including both kachcha
and pucca houses, 1.0 km from a residential area
having a population more than 150 or more than 20
houses including both kachcha and pucca houses.
However the distance from notified municipal area
will be 5.0 km.

(2) The distance of brick kilns shall be atleast 1.0 km Distance from
Sensitive Areas
from the areas like registered hospital, school, public
building, religious place or a place where flammable
substances are stored. Brick kilns shall not be
allowed with in a radius of 5.0 km in notified
sensitive areas like Zoo, wild life sanctuary, historic
monuments*, museum etc.
*
In case of Taz Trapezium Zone (TTZ) area the
directions / guidelines given by Hon'ble Supreme
Court shall also be applicable besides the rule
mentioned in these rules.

(3) Brick kilns shall not be constructed within 200 m Distance from
Railway Track
from the sides of railway tracks.

(4) The brick kilns shall be constructed at least 300 m Distance from
National / State
from National and State highway from the both sides highways
of the road .

 (5) Brick kiln shall be constructed at least 100 m away Distance from
PWD Road/
from the both sides of the main district road/PWD District Road
roads
(6) The distance between two brick kilns shall not be Distance between
two brick kilns
less than 500 m to avoid clustering of brick kilns in
an area if a new brick kiln is being installed.

(7) Brick Kiln should not be allowed to install in the Distance from
Mango/fruits
'Buffer zone' of a notified fruit belt area as defined in Orchard
'The Uttar Pradesh Promotion and Protection of Fruit
Trees (Regulation of Harmful Establishments And
Housing Schemes) Act, 1985' and the restriction
made by concerning competent authority or decision
of Hon’ble court on case to case basis if any.

Distance from sides of mango orchard/Mixed fruits

(mango and other) orchard (having at least 100
fruiting trees)/ joint nursery from brick kiln shall not
be less than 800 m in each direction. The mentioned
distances are applicable irrespective of the
variety/type of fruit whose area individually or
collectively should not be less than 2.5 acre.

Note: Distance will be measured from the chimney of

the brick kiln to the first/nearest row of the tree of
mango/fruit orchard towards the kiln.

3. The establishment of brick kiln can be under-taken only Prior consent

after obtaining prior "Consent to establish" under the for
establishment
provisions of section 25 of the Water (prevention & control
of pollution) Act, 1974 and section 21 of the Air
(prevention & control of pollution) Act, 1981 from the
State Pollution Control Board.
4. The emission standards and Pollution Control System Emission
including height of Chimney for Brick Kilns as notified by Standards
Ministry of Environment and Forest (MOEF) Government
of India vide serial no. 74 of schedule I in Environment
(Protection) Rules, 1986 in notification no. GSR 543 (E)
dated 22nd July, 2009 (as amended) shall be applicable in
case of Brick kilns.
5. Local agro industrial wastes residue shall be used as
internal fuel to replace coal eg. Cotton stalk, mustard

 stalk etc.

6. The use of non-hazardous industrial waste such as stone

dust, rice husk ash, red mud etc. shall be encouraged to be
mixed with top soil.

7. Fly ash shall be used in brick molding in compliance

of the notification( ad amended) issued under the provision
of Environment (Protection) Act, 1986 to manufacture soil-
fly ash brick.

8. Spent organic solvent, oily residue, pet coke, filter press

cake (hazardous waste) etc. and other wastes such as
plastic, rubber, lather etc. shall not be allowed as fuel in
brick kiln.

9. Multi layer and multi storey green belt of 10 m width shall

be constructed along the periphery of brick kiln leaving
two 10 m wide gaps in the boundary for entry and exit of
material and vehicles. A wall of 3 m height shall be
constructed on the sides where land is not available for
green belt development to prevent fugitive dust emission.
For installation of brick kiln with green belt development,
the minimum area required is 2.0 acre.

10. Lighting arrestor as per the PWD norms or any other

standard design shall be installed for brick kiln to avoid the
damage to stacks/chimney caused due to lighting attack.

11. To Start production that-is to operate brick kiln " the Consent to
consent to operate" is required from the State Pollution operate before
commissioning
Control Board under the provision of section 25 of the
Water (Prevention & control of Pollution) Act, 1974 and
section 21 of the Air (Prevention & control of Pollution)
Act, 1981 besides the other mandatory requirement in any
other laws viz. mining lease from District Administration,
permission for firing from Zila Panchayat and no objection
certificate/license if required, from Horticulture
Department & Zila Parisad.

 12. In Brick Kiln besides the above Good House Keeping Good House
practices including disposal of coal ash, provision of Keeping
Practices
double wall around the kiln, proper layout, Brick lining of
passage, use of properly graded coal, proper firing
practices, protection from noise pollution and other
measures should be followed by all Brick Kiln Owners.

Note:

1. The above sitting criteria will be applicable to all Bulls Trench Kilns irrespective of
their brick production capacity.

2. All the distances are in the above rules for installing a new brick kiln are from the
stack of the brick kiln considering stack as the central point of the kiln to the outer
periphery to orchid etc. or a human settlement (abadi).

3. The above rules are prepared based on the studies carried out by CBRI, Roorkee on
Bulls Trench fixed chimney kiln installed with gravitational settling chamber as
pollution control device, existing guidelines of Jila Panchayat (UP), drafted guide
lines of CPCB, Delhi (COINDS/16/1995-96) and guidelines recommended by
Central Institute for Sub-Tropical Horticulture, Lucknow.
