AFFIDAVIT

I, PAZ M. NOLEAL, of legal age, Filipino, widow, resident of 68

Dayangdang, Naga City, after having been duly sworn, depose and say:

1. That I personally know the late Domingo Fraxidio, he being my

immediate neighbor in Dayangdang, Naga City;

2. That I know that during the lifetime of my Domingo he acquired a

parcel of land known as Lot No. 8, Block No. 6 of the Subdivision Plan (LRC)
Psd-10681 of the City Heights Subd., (excess) in Naga City, containing an area
One Hundred Ninety Seven (197) square meters more or less;

3. That after the death I know that his heirs composed of his wife,
Leticia and daughters Rechilda and Elenita sold their respective shares to the
sibling of Domingo named Rolando Fraxidio;

4. That because of the sale of their shares to Rolando the latters has
taken possession of the said parcel of land and house existing on the land after
Rolando has decided to stay in the Philippines for good after staying and working
in the United States for many years;

5. That Rolando Fraxidio has been continuously staying in the said

property up to this time;

6. That I am executing this Affidavit to attest to the truth and veracity of the
foregoing facts.

IN WITNESS WHEREOF, I have hereunto set my hand this 24 th day of
