 After submission of assignment viva-voce shall be conducted for 20 marks
 The candidates are required to specify in their submission –
Name, ID No., Semester and Subject.
 The students are required to submit their SACE in the trailing mail through which the
candidate has received the questions of SACE.

1. “Imposition of emergency in a State under Article 356 has always been a matter of
controversy.” Do you think that total wipe out of ruling party at the state level at
Parliamentary election will be a valid ground for arriving at the conclusion of failure
of constitutional machinery in that state?

What are your suggestions to check the misuse of Article 356 in the light of the
Supreme Court decision on the point?

2. “With the adoption of Parliamentary form of government, the vesting clause under
article 53(1) remains to a great extent meaningless, as real executive power lies in the
ministry”

Critically examine the above statement in the context of the status and position of the
President of India under the Indian Constitution. Also answer, if the President of India
does not accept the advise of the Prime Minister what consequences would follow.
