MOTION
ORDER:
Considering the evidence presented in the respondents' motion, including their prima facie
eligibility for adjustment of status based on approved visa petitions filed by their United States
citizen son, who they assert is a member of the military on active duty, as well as the lack of
opposition from the Department of Homeland Security, we find exceptional circumstances and
grant the respondents' motion in the exercise of our sua sponte authority. 8 C.F.R. § 1003.2(a).
The record will be remanded to the Immigration Judge to provide the respondents an opportunity
FURTHER ORDER: The record is remanded to the Immigration Judge for further proceedings
