RULE 108 CANCELLATION OR CORRECTION OF

ENTRIES IN THE   CIVIL  REGISTRY

Section 1. Who may file.-    Any person interested in any act.


Where to File? –   A verified petition may be file with the family court of the
province where the corresponding civil registrar is located.

Section 2. Entries  subject to cancellation or correction.


 Birth;
 Marriage;
 Death;
 Legal separation;
 Judgment of annulment of marriage;
 Judgment declaring void marriages;
 Legitimation;
 Adoption;
 Acknowledgment of natural children;
 Naturalization;
 election ;
 Loss or recovery of citizenship;
 Civil interdiction;
 Judicial determination of filiation;
 Voluntary emancipation of minor; and
 Changes of names.

Section 3. Parties
 The civil registrar;
 The person who have claims or interest that would be affected.

Section 4. notice and publication-


 The court shall by a order, fix the time, date and place for the hearing;
 The court shall cause reasonable notice to persons named in the petition;
 The court shall cause order to publish once a week for 3 consecutive weeks in a
news paper of general circulation in the province.

Section 5. Opposition
 The civil registrar;
 Any person having claims or interest
Note: they are given within 15 days from the last day of publication of such
notice of hearing, may file their opposition thereto.

Section 6. Expediting Proceeding


 The court may issue order expediting the proceeding;
 The court may grant preliminary injunction for reservation of rights of parties
pending such proceeding.

Section 7. Order
After hearing the court may;

 Either dismiss the petition;


 Issue an order granting the cancellation or correction prayed for;
 A certified copy of the order shall be served upon the civil register concern who in
turn shall annotate the same in the registry records.
