REPUBLIC OF THE PHILIPPINES | DEPARTMENT OF TRANSPORTATION | LAND TRANSPORTATION OFFICE East Avenue, Quezon Gly mat Adress omboxginaivoh « Webs: vaio. couch MEMORANDUM CIRCULAR NO. 2019. 2175_ 05 December 2019 SUBJECT: RULES AND REGULATIONS ON ACCREDITATION, SUPERVISION AND CONTROL OF DRIVING INSTITUTIONS, AND ON STANDARDIZATION OF DRIVER EDUCATION Pursuant to the provisions of Executive Order No. 248, dated July 14, 1970, and in consonance with Republic Act No. 4136, as amended, otherwise known as Land Transportation and Traffic Code, and in conformity with the provisions of Republic Act No. 10930 which mandates the establishment of stricter rules for the issuance of driver's license, the following revised rules and regulations are hereby promulgated to improve the quality of driver’s education, and to ensure that driver’s licenses are issued only to deserving applicants with sufficient driving skills and knowledge on road safety and proper road courtesy. ARTICLE 1 GENERAL PROVISIONS Section 1. Objectives This Memorandum Circular shall have the following objectives: i, To establish an accreditation system that ensures compliance of driving institutions, such as driving schools and Driving Enhancement Program (DEP) Training Centers, with the prescribed driver education standards which include driving instructor's qualifications, physical sites and _ facilities, equipment, and materials and other similar requirements prior to the issuance of an authority to offer or undertake driver education programs; ii, To ensure uniformity of the driver education course components, including topics of insiruction/andininitimum time requirements, in all accredited driying insane iii, To raise the standard of instruction and to develop safety consciousness and positive driving attitudes with the view of minimizing the incidence of road crashes. Section 2. Scope and Coverage ‘The following rules and regulations shall apply to the accreditation of driving schools offering complete course of instruction to student-drivers nationwide. This shall also cover the establishment, accreditation and operation of all Driving Enhancement Program (DEP) Training Centers. Section 3. Definition of Terms For purposes of this Memorandum Circular and as used herein, the following definitions are hereby adopted: Assistant Secretary — Chief of the Land Transportation Office Driving School - an educational institution, accredited by LTO, which is established, organized and authorized to engage in the business of handling complete course of instruction to student-drivers to operate motor vehicles. It may refer to the main school or any of its branches. Driving Enhancement Program (DEP) - a seminar designed by the Land Transportation Office (LTO) for driver's license holders that covers road safety and updated land transportation laws, rules and regulations. It includes the re-orientation course for drivers during renewal of their licenses under Section 14 of the Implementing Rules and Regulations (IRR) of Republic Act No. 10930, the intervention program as provided for under Section 15 of the said IRR, and the comprehensive driver education under Section 27 thereof. DEP Training Center — an educational institution authorized and accredited by LTO to conduct the Driving Enhancement Program, Driver’s License - the authority in the form prescribed by LTO granted to a person to operate motor vehicle that is either non-professional or professional driver’s license. Student-driver - a person enrolled in a driving school or Drivers Education Center undertaking——preseribed—courses of instruction to operate a motonyelticte /owerns rose DEC 09 2019 } | Page 20f17 peep El Student-driver’s Permit (SP) - the authority valid for a period of one (1) year embodied in a form prescribed by the Land Transportation Office (LTO) granted to a person who desires to learn to operate a motor vehicle when accompanied by a duly licensed driver possessing a driver’s license with the appropriate restrictions/ driver's license code/s for the type of motor vehicle to be operated by the student-driver. Section 4. Mandatory Theoretical Driving Course Student-driver’s Permit shall only be issued upon completion of a mandatory theoretical driving course to be conducted by LTO or its duly accredited driving school for at least fifteen (15) hours and shall be completed within two (2) years from start of the course. ARTICLE It REQUIREMENTS FOR DRIVING SCHOOLS Section 5. General Requirements A. Facilities and Equipment 1, Maneuvering Site a. The driving school must provide a maneuvering site where students undertake in-car but off-highway driving lessons, including the development of maneuvering dexterity, prior to major highway driving lessons. The dimension of maneuvering site shall be at least fourteen (14) meters in length and width. In case the designated maneuvering site is public property, it must have a written permit from the local government unit concerned. b. Schools are encouraged to establish a common driving test track complete with traffic signs and pavement markings. Driving schools must show proof of their agreement to use and maintain a common driving test track. 2, Classroom (Main Office and Branches) a. The minimum dimension of a classroom must not be less than twenty-four (24) square meters. Classrooms must ensure that ergonomics, anthropometries, thermal comfort, ventilation, illumination, and acoustics are considered in the over-all layout and design of the classroom. ¢. Each classroom must. have audio-visual materials and display, updated set of traffic signs, signals and pavement markings as described in the manual of Department of Public Works and Highways (DPWH) and other land transportation regulatory agencies. The lateral dimensions or diameter of each sign must not be less than twelve (12) inches. 4. For students intending to apply for a light vehicle professional driver's license, the school must have in the classrooms automotive components and parts assemblies which may be used as aids in teaching basic automotive servicing. e. All classrooms used for theoretical instruction must be equipped with closed circuit television (CCTV) system with built-in date and time recording features. f. The school shall maintain student records for monitoring and evaluation. Library Driving school library facilities must have the following reference and reading materials: a. Republic Act (R.A.) No. 4136, as amended and R.A. No. 10930 - An Act Rationalizing and Strengthening the Policy Regarding Driver’s License by Extending the Validity Period of Driver’s Licenses and Penalizing Acts in Violation of its Issuance and Application; b. Letters of Instructions, Administrative Orders/ Memorandum Circulars of the Department of Transportation, Land Transportation Office, Land Transportation Franchising and Regulatory Board, and city/municipal ordinance relative to land transportation and traffic rules and jeeulations: Ger Re Page 40f17 c. Filipino Driver’s Manual, defensive driving manual, and automotive mechanics manual to be provided to student- drivers; d. Special laws relative to land transportation, such as: i, R.A. 8749 - Philippine Clean Air Act of 1999 ii, R.A. 8750 - Seat Belts Use Act of 1999 iii, R.A. 8794 - An Act Imposing a Motor Vehicle User’s Charge on All Types of Motor Vehicles and for Other Purposes iv. R.A, 10054 - Motorcycle Helmet Act of 2009 v. R.A, 10586 - Anti-Drunk and Drugged Driving Act of 2013 vi. R.A. 10666 - Children’s Safety on Motorcycle Act of 2015 vii, R.A. 10913 - Anti-Distracted Driving Act viii, R.A. 10916 - Road Speed Limiter Act of 2016 ix. R.A. 11229 - Child Safety in Motor Vehicle’s Act x. R.A. 11235 - Motorcycle Crime Prevention Act ; and e. Other road safety manuals and materials. 4, Motor Vehicles ay ‘The schools must have at least two (2) light 4-wheeled motor vehicles (with manual and automatic transmissions), and at least two (2) motorcycles (manual and automatic). All vehicles used for practical instruction must not be more than seven (7) years old. All vehicles must be roadworthy, operational, equipped with front and rear-view dashboard recording camera, and currently registered in the name of the driving school or proprietor. |. All vehicles used for practical instruction must be modified to include a separate brake pedal for the instructor. . All motor vehicles used in the practical instruction shall bear markings “CAUTION — STUDENT-DRIVER” in white capital letters at least eight (8) inches in height with red background, and readable from the bagk of the matorvehicte— IR DEC 09 2019 1) Page 5 0f17 IE. CELY B. Course of Instruction The course of instruction shall consist of two phases, namely: classroom (theoretical) and practical driving instructions. 1. Classroom/Theoretical Instruction a. The classroom instruction shall be comprised of the following topies/fields of study: ii, iv. vii. viii. ix, * xii, xiii, Background/evolution of land transportation and its role in development; Basic organization and functions of LTO; Driver's license and motor vehicle registration requirements and processes; ‘Traffic rules and regulations including traffic signs, signals, pavement markings, and road right of way; Special laws and administrative issuances related to Land Transportation; Hazard scanning and recognition, and road crash risk reduction; Functions of automotive assemblies and accessories; Cockpit drill and driving maneuvers; Parking techniques such as the three-point turn, parallel, reverse, and angle parking; Fuel conservation tips and techniques; Vehicle safety checks and basic trouble shooting cum practicum; Road courtesy, discipline and defensive driving practices; and Detailed topics/concepts for the safe operation of motorcycle and light motor vehicles. b. The school must submit a course syllabus to the Regional Office concerned or the Traffic Safety Division conforming to the standard course content. ¢. Every student-driver must be provided with a copy of the Filipino Driver's Manual. d. The time for theoretical instructions shall not be less than fifteen (15) hours. Practical instruction shall cover safe driving techniques through different road gradients and conditions, densities of traffic, and weather conditions. (Annex B) b. The practical driving instructions shall not be less than eight (8) hours. c. Driving schools may be deputized by LTO to conduct a practical driving test, including the operation of Special Purpose Vehicle, depending on the performance evaluation of the previous accreditation period. The practical driving test shall be credited to the application of driver’s license. €. Driving School Instructor 1, Accreditation a. All driving instructors must be duly accredited by LTO. b. The documentary requirements for accreditation shall be as follows: i. Certified true copy of diploma and appropriate certificates of training; ii. Copy of valid professional driver’s license; iii. Original Certificate of neuropsychiatric test result; iv. Original copy of a valid certification from a DOH accredited drug testing center that applicant has undergone a mandatory drug test, and that he/she is free from the use of dangerous drugs; and v. Copy of valid National Bureau of Investigation (NBI) or Police Clearance. ¢. Instructor's accreditation shall be restricted to his/her school where he/she is affiliated. d. An accreditation fee of One Thousand Pesos (P1,000.00) shall be paid by instructor upon submission of his application and requirements, and after passing the written examination. e. Instructor's accreditation is valid for two (2) years. f. Prior to the renewal of a ‘idfiving instructor shall be required to attenfl a retooling'program. Accredited instructors must have an appropriate company uniform and identification card, and certificate of accreditation issued by LTO and exhibited at all times while conducting classes or practical driving lessons. 2. Qualifications for Accreditation a. Must be at least twenty-three (23) years of age; b. Must be a holder of a relevant four-year degree course or of automotive vocational training course; ¢. Must be a holder of TESDA National TVET Trainer’s Certificate (NTTC) or have completed a Trainer's Training, and National Certificate (NC) Il in Driving and Automotive Servicing; d. Must be a holder of professional driver’s license for the vehicle category to be lectured for at least five (5) years; e. Must not have any traffic violations for the past twelve (12) months prior to application as instructor; f, Must not have a history of suspension or revocation of driver's license for any cause; g. Must take and pass the neuropsychiatric test from a government accredited entity; h, Must have undergone a mandatory drug test performed by a DOH accredited drug testing center, and results must show that he/she is free from the use of dangerous drugs; i, Must not have been convicted by final judgment of a crime involving moral turpitude, or of a crime punishable by prision correccional under the Revised Penal Code; and j. Must have passed a written examination given by LTO. 3. Examination for Driving School Instructors a. Theoretical examinations shall be administered by the Traffic Safety Division (TSD) of the LTO Central Office. 1. At the Central Office, every second and fourth —Wednesday of the month. ‘At the Regional Office, shall be held twice a year depending on the number of applicants. Adjacent or Page 8017 contiguous regions may consolidate their respective applicants for a common date and place of examination. b. An applicant shall pay an examination fee of Two Hundred Pesos (P200.00). ¢, The examination result shall be released within fifteen (15) working days from the date of examination. d. The driving school instructor must have a rating of at least eighty-five per cent (85%), using the updated Department of Education grading system, to be considered as “Passed”. Section 6. Corporate Social Responsibility A scholarship program for indigent and deserving students may be instituted by a driving school as part of its community road safety advocacy. ARTICLE Ii CERTIFICATE OF DRIVING COURSE COMPLETION Section 7. Issuance and Contents After the satisfactory completion by a student-driver of the prescribed driving course, driving school shall issue a Certificate of Driving Course Completion to show that he/she has completed the theoretical and/or practical instruction. The certificate shall contain the following: 1, Complete name, nationality, date of birth, sex and address of the student; 2, Issuance date of the certificate; 3. Electronically captured picture; 4. Course/s completed particularly the types of the motor vehicles used during the training for guidance in determining driver's license code; and 5. Control number of the certificate and signature of enrolled driving instructor. In addition to the foregoing, the breakdown of payment representing the student must be clearly specified in the official 009 ont Elly Page 9017 Section 8. Interconnectivity and Monitoring 1. Driving schools and instructors’ profile shall be tagged and interconnected to the Land Transportation Office IT system. 2. The Certificate of Course Completion as mentioned in Section 7 of this Memorandum Circular shall be electronically transmitted in real time to LTO IT System. 3. The manner of electronic transmission shall be done through a uniform front-end facility that is duly approved by LTO. 4, Biometrics sign-off of the driving instructor/s who conducted the driver education shall be required prior to the electronic transmission of the Certificate of Driving Course Completion with the approval of the Driving School Administrator. 5. Driving schools shall be required to have the IT equipment and facilities necessary for the successful transmission of the Certificates of Course Completion using the duly approved front-end facility. 6. The TSD shall monitor, evaluate and give performance ratings to driving schools based on the previous operations and community relations. ARTICLE IV ACCREDITATION OF DRIVING SCHOOLS Section 9. Classifications of Driving Schools 1, New Driving Schools - Any person or group of persons, natural or juridical, who intends to establish and operate a driving school, shall file with the Regional Director concerned, an application, in a form prescribed by LTO, containing prescribed information and showing compliance with the standard requirements of this Memorandum Circular. All applications shall be forwarded to the Central Office Committee on Accreditation of Driving Schools for review, and recommendation to the Assistant Secretary for approval. 2. Existing Driving Schools - Driving schools that have already been established and operating.and which have previously been issued a certificate to operate o»provisignal: permit-shall be given six (6) months within which to comply with the standard requirements of this Memorandum Circular. 3. Driving School Kiosks in malls or registration offices may be established for marketing and enrollment purposes only. Section 10. Documentary Requirements A. For new driving school applicants: 1. For single proprietorship, the business name registration from the Department of Trade and Industry (DT!); 2. For partnership or corporation, the business name registration and other documentary requirements by the Securities and Exchange Commission as prerequisites to their establishment, organization and operation; 3. Business Permit; 4. Sworn statement with documentary evidence of the adequacy of funds for annual operating expenses; and 5. Bank certificate or Credit Line in the amount of Three Million Pesos (P3,000,000.00) in the name of the owner of driving school- applicant. Upon receipt of an application to establish a driving school, the Assistant Secretary, through the Committee on Accreditation, shall verify the correctness of the information contained in the application forwarded by the Regional Office concerned. B. For existing accredited driving schools: 1, Audited financial statement prepared by a certified public accountant; 2. Business Permit; 3. Driving Schools for the Operation of Heavy Vehicles Driving schools for heavy vehicles shall comply with the following requirements: a. The dimension of maneuvering site shall be at least thirty-one (31) meters in length and thirty-one (31) meters in width. b. The driving school must have at least one (1) heavy motor vehicle (e.g. bus, straight truck or articulated). c. The school must submit detailed course syllabus for the operation of heavy vehicles. d. Instructors must be a holder of TESDA NTTC and NC III Driving and Automotive Servicing for heavy vehicles, and must have passed the written examination administered by the LTO. e. The driver-applicant shall meet the qualifications mentioned under “Annex C” Section 12. Accreditation Fee The driving school shall pay a non-refundable accreditation fee in the amount of Five Thousand Pesos (P5,000.00) upon submission of the accomplished form and other documentary requirements. Section 13, Provisional Permit and Validity of Accreditation A provisional permit valid for ninety (90) days shall be given pending approval of accreditation. All applications approved by the Assistant Secretary shall be valid for two (2) years. Section 14. Renewal of Accreditation Renewal of accreditation shall be submitted sixty (60) days prior to the expiration of certificate. Upon application for renewal, a fee of Three ‘Thousand Pesos (P3,000.00) shall be paid. The authority of the driving school to operate shall be automatically cancelled upon failure to submit a duly accomplished application and -on_or before the expiration of its accreditation. Drug-Free Workplace The driving institution, regardless of the number of employees, shall develop and implement a drug abuse prevention program in the workplace. Such program shall include the adoption of company policies against drug use in the workplace and a drug testing program. Employers shall require all their driving instructors to undergo a random drug test for at least twice every year and in accordance with the company’s work rules and regulations for purposes of reducing the risk in the workplace. The driving institution shall bear all the expenses for drug testing. To ensure the safety of students, driving instructors who tested positive for drug use shall not be allowed to perform their duties and functions. Strict confidentiality shall be observed with regard to testing and the test results. Section 16. Compliance with Other Related Laws It shall be the duty of the duly accredited schools to comply with this Memorandum Circular and other existing rules and regulations, laws and policies in operating a driving school. Section 17. Regional Accreditation Committee A Regional Accreditation Committee (RAC) shall be constituted in every LTO Regional Office to receive and evaluate submitted applications for accreditation, The RAC shall have supervisory and visitorial powers over driving institutions. Prior to renewal of accreditation, the RAC shall conduct a mandatory inspection, and shall review and evaluate the over-all performance of the driving school. Irregular use of accreditation | P30,000.00 plus one (1) year suspension ‘30,000.00 f, Failure to display signage on motor vehicle In addition, the permit to establish and operate a driving school, or its certificate of accreditation, when in actual operation, may, after due notice and hearing, be suspended by the LTO Regional Director for a period of six (6) months on the first offense, and for one (1) year on the second offense for the following instances: 1. When the school is not properly equipped and managed; When the school fails to completely carry out its duly approved course syllabus; 3. When the instructors do not maintain professional standards in the performance of their duties and responsibilities; 4. When fraud and/or misrepresentations have been committed in the making and filing of the application and in its operation; 5. When the school is engaged in any unlawful or irregular transactions other than its main purpose; or 6. When the school was found to have failed to comply with the requirements and conditions prescribed in this Memorandum Circular. Provided, however, that the accreditation of the driving school shall be permanently revoked by the Assistant Secretary on the third offense. 03 209 Jf iI) Page 14 0f17 Section 19. Preventive Suspension If upon inspection or monitoring visits, the driving school or driving instructor is found to be violating the standards or existing rules and regulations or committed prohibited acts stipulated in this Memorandum Circular, the concerned LTO Regional Director may immediately impose preventive suspension to the said driving school or instructor for not more than sixty (60) days pending the outcome of the investigation. ARTICLE VI FINAL PROVISIONS Section 21. Full Implementation of R.A. 10930 and its IRR Driving institutions may be allowed to lecture the Standard Module of the Driving Enhancement Program (DEP) in compliance to Sections 14, 15 and 27 of the IRR of Republic Act No. 10930, subject to accreditation and approval of LTO. In addition to the regular reportorial requirements, DEP training centers shall conform to the requirements as described under Sections 5(A)(2), 5(A\(3), and 5(C) hereof. Transitory Provision Upon the effectivity of this circular, all existing enrolled instructors subject for renewal of accreditation shall: 1. Secure a TESDA NTTC and NC II for light vehicle Driving and Automotive Servicing except if the existing instructor has demonstrated exemplary background, experience and expertise. A testimonial eligibility may be considered provided the following circumstances are present: a. Teaching as driving instructor for more than five (5) years; b. Cited for outstanding performance; and c. No record of traffic violation for the past five (5) years. Repealing Clause All orders, circulars, issuances, rules and regulations pertaining to the issuance of accreditation of driving schools, which are inconsistent herewith, are hereby repealed and modified accordingly. Section 24. Separability Clause If any provision or part hereof is held invalid or unconstitutional, the remainder of the Memorandum Circular or provisions not otherwise affected shall remain valid and subsisting. Section 25. Effectivity ‘This Memorandum Circular shall take effect fifteen (15) days upon its publication in the Official Gazette or in a newspaper of general circulation, and upon registration with the Office of the National Administrative Register at the University of the Philippines Law Center, U.P.
