RATIONALE The MOA between the BFP and PEZA is a milestone achievement for both agencies as it delineates areas of cooperation, duties and functions, roles and obligations of both parties in consonance with the present administration's thrust of simplifying government transactions, inter-operability of government processes and strengthening communication and coordination among government agencies. These are of course anchored within the ténets of upholding safety and security at all times. However, an implementing guidelines and/or policies must be established by the agency not only to ensure that the coverage and intention of the MOA will be properly carried out, but also to ascertain that the legal mandates, and safety of the people above all reasons will not be compromised and that the field operating units of the BFP would have a clear-cut directions on how to effectively and efficiently perform the particular task. It is worthy to note that this is something that cannot be taken lightly. It requires unfathomable commitment, discipline and great deal of accountability and responsibilty. Hence, these guidelines. Ill. COVERAGE AND APPLICABILITY These guidelines shall apply to the administration and implementation of the FCP and other related laws in all buildings, structures, facilities, business establishments and installations in all PEZA-registered economic zones in the country as defined under RA 7916 and its IRR, including Information Technology Parks and Centers and PEZA- registered enterprises. IV. RESPONSIBILITIES OF THE BFP ENFORCEMENT UNITS To properly execute the provisions of this guidelines, all concerned enforcement units shall: MC-implementing Guidelines of BFP-PEZA MOA. A. In coordination with PEZA, ensure full compliance by the owner/administrator of the covered buildings, facilities, business establishments and enterprises, with the required fire safety regulations as provided for under the FCP, its IRR and other related laws and issuances; B. Strictly perform its mandated functions in accordance with the provisions of the FCP, its IRR, other fire related laws and issuances, but without necessarily deviating from the terms of the MOA, specifically in performing the following tasks: 1. Issuance of Fire Safety Evaluation Clearance (FSEC), Fire Safety Inspection Certificate (FSIC) and other FCP-related clearances; Review of building plans; Conduct of fire safety inspection; Responses to fire-related incidents; Conduct of fire investigation; and ween . Report to the concemed Fire Marshal, any refusal by the building owner, building in-charge, manager and/or its administrator to allow the conduct of fire safety inspection or fire incident investigation. The enforcement units are enjoined to give priority and act on all applications of new PEZA-registered facilities within the period herein provided thereby ensuring that they can operate on time. Should there be deficiencies or violations, a Notice of Disapproval (NOD) or Notice to Comply (NTC), as the case may be, shall be immediately issued. V. GENERAL FIRE SAFETY ENFORCEMENT POLICIES AND PROCEDURES, A FSEC shall be a pre-requisite for the issuance of Building Permit and FSIC shall be a prerequisite for the igsuance of Occupancy Permits and Certificate of Annual Inspection by PEZA. For this purpose, all PEZA-issued FSIC for Certificate of Annual Inspection shall be considered valid only up to the remaining period of its validity A. FSIC AND ANNUAL FIRE SAFETY INSPECTION 1. All buildings covered by these guidelines shall be subjected to annual fire safety inspection at least 60 days before the expiration of the validity of issued FSIC. The annual inspection herein contemplated shall be, as much as possible, be conducted by a BFP and PEZA Inspector/s. In the event that a joint inspection is not possible, Fire Safety Inspection shall be conducted by the BFP even without the presence of the PEZA Inspector/s. However, it is necessary that the PEZA through the CLU will be notified before the actual inspection is conducted; 2. Compliant PEZA-registered entities shall be issued with an FSIC which shall be transmitted to the BFP-PEZA Central Liaison Units (CLU) within ‘two (2) days from the date of inspection; 3. For non-compliant entities, the administrative courses of action prescribed in the FCP shall be followed. A list of non-compliant entities with noted violation(s) shall then be submitted to the BFP-PEZA CLU for its disposition. ‘MC-mplementing Guidelines of BFP-PEZA MOA 4. No FSIC shall be issued unless an amount equivalent to ten percent (10%) of all fees charged by PEZA for issuance of Annual Inspection Certificate shall have been paid. B. FSEC FOR BUILDING PERMIT APPLICATION 1. Upon receipt of the endorsement from the PEZA Building Official, the designated Customer Relations Officer (CRO) assigned shall thoroughly check the completeness of the submitted documents applicable to the planned building construction, as follows: a. Three (3) sets of the proposed building plans and other documents prepared, signed and sealed over the printed names of the licensed and registered professionals, consisting of the following: i. Architectural documents; i Civi/Structural Documents; iti, Electrical Documents; iv. Mechanical Documents; v. Sanitary Documents; vi. Plumbing Documents; vii. Electronics Documents; viii. Detailed Project Cost Estimate Technical Specifications; and ix. Fire Protection Plan (If applicable); b. Electronic copy of the proposed building plans including the documents enumerated in the immediately preceding paragraph; and . Photocopies of the valid licenses of all involved professionals such as Current Professional Tax Receipt and Professional Regulations Commission (PRC) Identification Card. 2. If the building is already constructed, an as-built plan containing the same number of documents shall be submitted 3. The evaluation of the submitted documents including the issuance of the necessary FSEC shall in no case exceed three (3) working days from the receipt of the endorsement from the PEZA. 4. For application that complies with the requirements of FCP, and its referral codes FSEC shall be issued after payment of appropriate fees and charges. For non-compliant applications the Fire Safety Checklist shall be issued after payment of appropriate fees and charges. All noted deficiencies and fire safety recommendations shall be reflected in the Fire Safety Checklist. ©. FSIC FOR OCCUPANCY PERMIT 1. Upon receipt of the endorsement from PEZA Building Official, the CRO concerned shall check the completeness of the submitted documents, to wit a. Three (3) copies of the a duly notarized Certificate of Completion using the standard form provided for by the PEZA building official, signed by the owner/applicant and signed and sealed by a duly licensed Architect or Civil Engineer in-charge of construction, together with the approved plan and specifications and One (1) copy of the construction logbook. If a the construction was undertaken through a contract, the certificate of completion shall be signed by the contractor or authorized managing officer, b. One (1) photocopy of the issued Building Permit and the issued ancillary permits; c. Owner's photocopy of Fire Safety Checklist and its corresponding FSEC; d. Photocopies of the valid licenses of all involved professionals such as Current Professional Tax Receipt and PRC Identification Card; @. Photograph of the completed structure showing front, sides and rear areas; and f. In cases where there are changes during construction and/or deviations from the approved building plans, three (3) sets of as-built plan reflecting therein the changes or deviations made; 2. A joint inspection shall be scheduled, by PEZA. However, in the event that a joint inspection is not possible, fire safety inspection shall still proceed, provided that PEZA is informed before conducting the actual inspection. 3. Should the building inspected be found compliant, an FSIC shall be issued which shall be transmitted to the PEZA building official within three (3) days from the date of inspection. 4. In case violations are noted during inspection, an After-Inspection Report using the Standard Checklist reflecting therein all the deficiencies shall be prepared and a Notice of Disapproval shall be issued. 1D. COMMON PROVISIONS 1. If during actual inspection, it is found out that a business establishment, has noted violations of the FCP a Notice of Disapproval shall be issued if it is for Occupancy Permit or a Notice to Comply if it is for Certificate of Annual Inspection. If said business establishment is already operating without the necessary Building or Occupancy Permit; the same shall be immediately reported to the PEZA. 2. Assessment of fees shall be in accordance with the procedures set forth in the FCP and its IRR while payment or collection shall be made in a One- Stop-Shop Co-Location Sites as provided for in the MOA and these guidelines. VI. ESTABLISHMENT OF BFP-PEZA CENTRAL LIAISON UNITS, A. In order to adopt a one-time processing and issuance of permits, concemed BFP Regional Offices shall designate personnel at the PEZA Regional Administrative Offices where the registration of PEZA registered entities are processed. These co-located personnel shall compose the BFP-PEZA CLU. B. The following BFP Regional Offices are directed to designate personnel to the BFP-PEZA CLU; 1. Cordillera Administrative Region (BFP CAR) covering PEZA Entities in Regions 1, 2, 3 and CAR; MC-Amplementing Guidelines of BFP-PEZA MOA 2. National Capital Region (BFP NCR) covering PEZA Entities in Regions NCR and 5; 3. CALABARZON BFP (R4-A) covering PEZA Regional Administrative Offices in Laguna, Cavite and Batangas, the rest of Region 4A and 4B except Palawan; and 4. Central Visayas Region (BFP R7) covering PEZA Entities in Regions 6, 7, 8, 9, 10, 11, 12, CARAGA and Palawan. Details of administrative coverage of the identified regions are stated in Annex A-1 (List of PEZA Registered entities per regional administrative office) of this policy subject to the additions and/or amendments by PEZA. The BFP-PEZA CLU shall be directly administered and monitored by the Regional Office concerned and the officers and personnel that compose the CLU shall be accountable to the Regional Director. The BFP-PEZA CLU shall be composed of the following: One Team Leader — Chief, Regional Fire Safety Enforcement Division One (1) NCO as Customer Relations Officer (CRO) and Assessor, One (1) NCO as Collecting Agent; and One (1) NCO Liaison Officer. PeNs The duties and responsibilities of the designated personnel include the receipt, processing, and immediate transmittal of applications to the city/municipal fire stations where the business operation of the applicant is located. The Regional Office shall ensure that the CLU’s are adequately manned at all times and in the event that one of the personnel is unable to render his/her duty, immediate replacement shall be made. It shall be the responsibility of the concemed City/Municipal Fire Marshal to enforce the provisions of the FCP and its IRR and other related laws. Due notification and transmittal of application and processed applications shall be made by the designated liaison officer to the respective Regional FSES, The BFP-PEZA CLU shall be provided with proper equipment such as computers, printers, scanners, intemet and telecommunication connection, documentation, and office supplies charged from the funds of the concerned Regional Office. The Regional Directors concerned shall compose a technical support team at every province and region composed of fire safety inspectors and evaluators that could be augmented to the lower units in cases where the concemed stations cannot cope-up with the processing time as imposéd in these guidelines due to volume of applicants. The technical teams may only give assistance upon request by the C/MFM concemed. The BFP NHQ, through the Directorate for Fire Safety and Enforcement may also render technical assistance to the regional offices and the local fire station should the need arises The BFP-PEZA CLU personnel and the concerned City/Municipal Fire Marshals shall interpret these guidelines according to the intents and purposes of the FCP, BFP Policies and Guidelines and the BFP-PEZA MOA. In case of confiict of interpretation with PEZA, the CLU personnel or the concemed C/MFM shall immediately seek the proper interpretation or guidance from the Director for Fire Safety and Enforcement. K. Monthly reports shall be submitted by BFP-PEZA CLU Team Leader to the concerned Regional Director subject to the template to be prescribed by the Directorate for Fire Safety and Enforcement. Vil. ONE-STOP-SHOP CO-LOCATION SITE AND BACKROOM OPERATION a. Pursuant to the provisions. of the MOA, personnel to be designated at the BFP-PEZA CLU shall be co-located at the one-stop shop for processing of permits to be established by PEZA at their Regional Administrative Units indicated in Paragraph VI hereof. b. Processing of certificates from the BFP shall be through a backroom operation, hence, no face-to-face transaction with the applicants are allowed. Procedures for the said processing shall be in accordance with the following sub-section: A. ISSUANCE OF FIRE SAFETY EVALUATION CLEARANCE (FSEC) The procedure for the issuance of FSEC shall be as follows. At the Central Liaison Unit: 1. The BFP CRO/Assessor shall (a) receive three (3) sets of application for Building Permits with complete documentary requirements and FSEC from the PEZA Receiving Personnel accompanied with an electronic copy of the plans; (b) records the details of the application in his/her logbook; and (c) assess the required Fire Code Fee and prepare corresponding Order of Payment Slip (OPS), which (d) shall be attached to the application documents and forward the documents to the liaison officer for proper and immediate transmittal. In case of incomplete documents, the receiver shall return the documents. 2. The Liaison Officer shall immediately transmit said applications to the fire station by all available means. (e.g. electronic courier or personal service) A soft copy (electronic copy) of the building plans shall be transmitted initially and shall be the basis for the evaluation and processing of the application. The hard copies shall remain in the possession of the CLU until the permits are issued. Only after the issuance of the building permit by the PEZA Building Official shall the hard copies be transmitted to the local fire station. At the Local Fire Station: a. The Chief, FSES upon receipt of the transmittal shall“ assign the documents to the designated Building Plan Evaluator to conduct evaluation and review. b. The Building Plan Evaluator shall (a) evaluate the submitted plans and specifications; (b) accomplish the standard Fire Safety Checklist (FSC) ‘on Building Plans; and (c) prepare the FSEC. Should there be inconsistencies with the fire safety standards with the proposed plans, the same shall be duly noted at the checklist. c. The Chief, FSES reviews the findings of the Building Plan Evaluator and recommends to the City/Municipal Fire Marshal for final action d. Immediately after the final action of the C/MFM, the Chief, FSES shall cause the immediate transmittal of the processed application to the BFP-PEZA CLU and call on the attention of the designated liaison officer. Scanned copies of the (a) issued FSEC and Checkiist, and (b) the reviewed plans shall be transmitted to the BFP-PEZA CLU. It will then be printed and certified authentic by the Team Leader of the BFP in the BFP-PEZA CLU. The hard copies of the clearance can be obtained by the owner from the local fire station at any time thereafter. . The Liaison Officer shall then process the received transmittal and verifies the completeness of the transmitted documents. If there are inconsistencies or lacking documents, he/she shall immediately notify the sender of the said concem. Provided that all documents are present, the Liaison Officer shall forward the processed documents to the CRO/Assessor for notification and proper disposition. Upon receipt of the processed application the CRO/Assessor shall record the status remarks of the application (APPROVED, RETURNED TO OWNER, RELEASED) in his/her logbook. He/she shall then forward two (2) sets of the application documents to the PEZA Building OfficialRegistration Office. g. When the application is due for release by the PEZA Building Official/Registration Office, the CRO/Collecting Agent shall receive the Fire Code Fee as declared in the OPS alongside with the PEZA Collecting Officer and issue the receipt h. The CRO/Collecting Agent then secures a copy of the approved/issued Building Permjt and attaches the same to the remaining set of plans. He shall then record the control numbers of the FSEC and the Building Permit and date of release before endorsing the documents to the Liaison Officer be filed at the CLU and to be transmitted back to the fire station for their proper filing. B. ISSUANCE OF FIRE SAFETY INSPECTION CERTIFICATE (FSIC) FOR OCCUPANCY PERMIT At the Central Liaison Unit 1. The BFP CRO/Collecting Agent shall (a) receive application for FSIC for Occupancy along with three (3) copies of all required documents from the PEZA Receiving Personnel; (b) record the details of the application in his/her logbook; and (c) asses the required Fire Code Fee to be collected and prepare corresponding Order of Payment Slip (OPS), (d) which shall be atiached to the application documents and forward the documents to the Liaison Officer for proper and immediate transmittal. In case of incomplete documents, the receiver shall return the documents. 2. The Liaison Officer shall immediately transmit said applications to the fire station by all available means (e.g. electronic courier or personal service). An electronic copy of the building plans shall be transmitted initially and shall be the basis for the evaluation and processing of the application. Only after the issuance of the building permit by the OBO of PEZA shall the hard copies be transmitted to the local fire station. 3. For every application, the Liaison Officer shall verify to the PEZA Building Official the schedule of the joint inspection. 4. The Liaison Officer shall notify immediately the Chief, FSES of the Fire Station concemed and shall cause the transmittal of said applications to the fire station. At the Local Fire Station 1. The Chief, FSES assigns the designated Fire Safety Inspector and immediately prepares an Inspection Order (10) and countersigns the same. FOR THIS CASE ONLY, the Chief, FSES may prepare, countersign and afer signature of the C/MFM issue the 0 even prior to the physical transmittal of documents from the BFP-PEZA CLU in order to meet the set forth schedule. In the case of an advance list of Joint Inspection, the Chief FSES can prepare the IO in advance based on the list from PEZA. 2. The FSI joins the Joint Inspection Team proceeds to the establishment and requests acknowledgment of the IO from any responsible person in the building, structure or facility. 3. The FSI proceeds with the fire safety inspection and immediately prepares an After Inspection Report (AIR), a copy of which is given to the establishment / building owner, occupant, or any duly authorized representative before leaving the premises. The inspector shall then notify the owner/administrator or representative that the FSIC and or other notices can be claimed at the CLU within the next three days after the inspection, . 4. The FSI submits a copy of the AIR to the Chief, FSES within two (2) days upon receipt of the inspection. 5. The Chief, FSES evaluates the submitted AIR and prepares either the FSIC or NOD or Notice to Comply (NTC) for those subjected to the issuance of FSIC for Certificate of Annual Inspection. 6. The Chief, FSES signs the AIR and the FSIC or NOD or NTC and forwards the same to the C/MFM for proper disposition and final action on the application. 7. The C/MFM signs the AIR and FSIC or NOD and forwards the same to the Chief, FSES who shall then cause the immediate transmittal of the processed request back to the BFP-PEZA CLU and call on the attention of the designated Liaison Officer of their region. The Chief, FSES shall only forward back to the BFP-PEZA CLU scanned copies of the FSIC, AIR, NOD or NTC. 8. The Liaison Officer shall then process the received transmittal and verifies, the completeness of the transmitted documents and if there are inconsistencies or lacking documents shall immediately notify the sender of the said concer. Provided that all documents are present, the Liaison Officer shall forward the processed documents to the Assessor for notification and proper disposition. arses MC-implementing Guidelines of BFP-PEZA MOA. 9. Upon receipt of the processed application the CRO/Assessor shall record the status remarks of the application (With FSIC/NOD or NTC) in his/her logbook. He/she shall then forward two (2) sets of application documents to the PEZA Building Official and or Registration Office for the Occupancy Permits and AIR and FSIC for the Certificate of Annual Inspection. 10.When the application is due for release by the PEZA Building OfficialRegistration Office, the CRO/Collecting Agent shall receive the Fire Code Fee as declared in the OPS alongside with the PEZA collecting officer and issue the receipt. 11. The CRO/Collecting Agent then secures a copy of the approved/issued Occupancy Permit. He shall then record the control numbers of the FSIC and the Occupancy Permit and date of release before endorsing the documents to the Liaison Officer be filed at the BFP-PEZA CLU and to be transmitted back to the fire station for their proper filing. . ISSUANCE OF FIRE SAFETY INSPECTION CERTIFICATE (FSIC) FOR CERTIFICATE OF ANNUAL INSPECTION At the Central Liaison Unit 1. For the initial implementation of this policy, a list of all PEZA registered entities provided by PEZA to the CLU which shall be the basis for the ‘scheduling of inspection to all existing PEZA entities. Sixty (60) days before the expiration of the FSIC issued by PEZA as indicated in the list, the BFP local fire station covering said entity shall conduct the Fire Safety Inspection. 2. The Liaison Officer of the CLU shall notify/remind the local fire station before that 60 days’ period and subsequently, the Chief, FSED shall provide the CLU with a copy of all Inspection Orders issued. The basis for the issuance of the IO by the Chief, FSES of the station shall be the list provided by the CLU. 3. For the succeeding year of the implementation of this policy, the CLU shall be the one to provide the monthly list of establishment due for inspection 60 days prior to the expiration of the issued FSIC. For establishment due for inspection, the Liaison Officer shall verify to the PEZA Building Official the schedule of the joint inspection. If the joint inspection is not possible, the BFP can proceed with the inspection as scheduled. At the Local Fire Station 1. The Chief, FSES after receipt of the list of establishments due for inspection assigns the designated Fire Safety Inspector and immediately prepares an Inspection Order (IO) and countersigns the same. Copies of the issued 10 shall be forwarded to the CLU for their notification/information. The FSI joins the Joint Inspection Team proceeds to the establishment and requests acknowledgment of the IO from any responsible person in the building, structure or facility. N 3. The FSI proceeds with the fire safety inspection and prepares an After Inspection Report (AIR), a copy of which is given to the establishment / MC-implementing Guidelines of BFP-PEZA MOA building owner, occupant, or any duly authorized representative before leaving the ‘premises. The inspector shall then notify the ‘owner/administrator or representative that the FSIC and or other notices can be claimed at the CLU at their due time for renewal of certificate of annual inspection. However, this will not preclude the applicant to pay and claim the FSIC in the local fire station. 4. The FSI submits a copy of the AIR to the Chief, FSES within two (2) days upon receipt of the inspection. 5. The Chief, FSES evaluates the submitted AIR and prepares either the FSIC or NOD or Notice to Comply (NTC) for those subjected to the issuance of FSIC for Certificate of Annual Inspection. 6. The Chief, FSES signs the AIR and the FSIC or NOD or NTC and forwards the same to the C/MFM for proper disposition and final action on the application. 7. The C/MFM signs the AIR and FSIC or NOD and forwards the same to the Chief, FSES who shall then cause the immediate transmittal of the processed request back to the BFP-PEZA CLU and call on the attention of the designated Liaison Officer of their region. The Chief, FSES shall only forward back to the BFP-PEZA CLU scanned copies of the FSIC, AIR, NOD or NTC. 8. The Liaison Officer shall then process the received transmittal and verifies, the completeness of the transmitted documents and if there are inconsistencies or lacking documents shall immediately notify the sender of the said concer. Provided that all documents are present, the Liaison Officer shall forward the processed documents to the Assessor for notification and proper disposition. 9. Upon receipt of the processed application the CRO/Assessor shall record the status remarks of the application (With FSIC/NOD or NTC) in his/her logbook 10.When the application is due for release by the PEZA Building OfficiaRegistration Office, the CRO/Collecting Agent shall receive the Fire Code Fee as declared in the OPS alongside with the PEZA collecting officer and issue the receipt. Should the FSIC was claimed at the local fire station the Chief, FSES shall forward copies of the issued FSIC, OPS and OR issued at fire station to the BFP-PEZA CLU. 11. The CRO/Collecting Agent then secures a copy of the approved/issued Certificate of Annual Inspection (CAI). He shall then record the control numbers of the FSIC and the CAI and date of release before endorsing the documents to the Liaison Officer be filed at the BFP-PEZA CLU and to be transmitted back to the fire station for their proper filing. D. COLLECTION AND DEPOSIT OF FIRE CODE FEES 41. General Procedure a. The collection of all fees shall be made in the BFP-PEZA-CLU through backroom operation and deposited at a depository bank nearest to the BFP-PEZA CLU. Every collection whether made at the CLU or at the local fire station, shall be credited as collection for the local fire station where the application and the clearances/certificates where processed and issued. b. No clearances/certificates shall be issued unless and until the payment of appropriate fee is made simultaneously with the payment of other fees to PEZA cashierlcollectors. Both the PEZA cashier and the BFP Collecting Agents shall collect the fees and issue the receipts at the same time. ¢. All Collections shall be deposited within the day it is collected with a cut-off period set at 1300H of the current day. All collections thereafter shall be deposited on the next banking day. d. The Collecting Agent shall prepare a consolidated collection report for every local fire station with a processed application. This report shall be furnished to the local fire station every time a deposit is made; the regional offices on a weekly basis; and the national headquarters on a monthly report This report shall contain the same attachments required by COA and shall indicate the name of establishment, the issued certificate, the amount paid, the OR number issued, date and time of deposit, scanned copy of the OPS and scanned copy of the issued official receipt among others. Vill. PROFILING AND REPORTORIAL REQUIREMENTS, A. In order to have a complete database and to assess the status of compliance of every building/structure of all PEZA registered entities, a profiling measure shall be made by every fire station with PEZA entities in their AOR followed by a thorough inspection of all noted facilities. For the purpose of profiling and data gathering a prescribed form shall be used. See Annex C-1: Profiling Checklist. 1. Copies of these profiles shall be collated and submitted to the regional offices, to BFP-PEZA CLU, and to Fire Safety Data Management Section, FSED, BFP NHQ. The Profiling shall run within the first six months after the effectivity of this policy. 2. Monthly Fire Prevention Activity reports shall be prepared by the Liaison Officer and forwarded to the Regional FSEB and to the Fire Safety Data Management Section, FSED, BFP NHQ using Annex B-1 to B-3 (Fire Prevention Activities for PEZA Entities). 3. Similar monthly report for the collection and deposit of Fire Code Fees shall be prepared by the Collecting Agent and transmitted to the Regional Accounting Section and the Fire Code Revenue Management Division, Directorate for Comptroliership, BFP NHQ. 1X. FUNDING REQUIREMENTS Considering that the BFP-PEZA CLU shall function as an extension unit of the BFP Regional office concemed, appropriate funding shall be provided by the said regional office and future concerns necessary for the performance of functions shall be duly reflected in the Project Procurement Management Plans (PPMP) and Annual Procurement Plans (APP) of every fiscal year. X. FIRE INCIDENT RESPONSE AND INVESTIGATION ‘The BFP shall take full control in the suppression of fire occurrences within PEZA. Zones and PEZA administered entities. During the conduct of investigation, the PEZA building official maybe allowed to assist the investigators if deemed necessary. Xi, ADMINISTRATIVE LIABILITIES Any BFP Officer or personnel who violates the provisions of these guidelines, will be held administratively liable in accordance with the applicable provisions of law, rules and regulations. Xil, REPEALING CLAUSE All circulars, orders, SOPs and other issuances that are inconsistent with the provisions of this Circular are hereby repealed, amended or modified accordingly. Xill. SEPARABILITY CLAUSE If any provision of this implementing guidelines or the applications thereof to any person or circumstances is declared invalid or inconsistent by a competent court, all other provisions hereof which are not affected thereby shall continue to be executed fully.
