SEAFARER EMPLOYMENT AGREEMENT
This Contract of Employment (Seafarer Employment Agreement) is between:-

‘A. Capacity of Engagement
‘The capacity in which you are now employed is "AB",
B. Place of Employment
You will be employed on board Vessel "M2M3” (Ship-owner/Employer has the option of transferring/employing
‘you on any vessel owned, managed or Duration of Employment /Contract
‘Your employment is for a period for “@ Months” commencing on 26-06-2020 and ending 25-03-2020 unless itis
terminated for justified reasons. The validity of contract of engagement remains valid through the duration of
contract and all terms & conditions cease to exist once full & final payment is disbursed. The above contract can be
extended upon receipt of a request from seafarer subject to mutual agreement. (Subject to Appraisal report from
Vessel). In no case however, the contract shall be extended chartered by them.)

‘The length of notice which you are obliged to give to terminate your employment is 30 days. The length of notice
which you are entitled to receive from RSM to terminate your employment is 30 days. Subject to fact that your
‘employment is not terminated on disciplinary grounds.
Remuneration
The Remuneration agreed between the Employer/ Ship-Owner and the Seafarer under this contractual
employment is as follows:
Basic: Rs. 5,000/- month pro rata,
Gross: INR: R.15,000/- per day/-per-week/ per month inclusive of all applicable allowances, leave pay, Provident
Fund, and taxes and payable at monthly intervals by 10% day of every month.

D. The Wages/Remuneration
‘Agreed between the Employer/Ship-owner and the Seafarer under this Contractual employment are as
follows:
i. Your wages shall commence from the date of Joining the Vessel and shall cease to be payable on the date
you sign off from the vessel. The wages shall be paid to you on regular basis in the bank account nominated
by you after deducting cash advance drawn on board by you, if any, allotments availed by you during the
‘month, Seafarer’s PF contribution, where applicable, and any other legitimate deductions including but not
limited like TDS etc. You are entitled to request for allotments during your employment free of cost to you.
‘The monthly details of Earnings, deductions and payment shall be advised to you.
ii, Upon signing off from the vessel, your Balance of Wages, if not paid on board, shall be settled by the Ship-
‘owner /Employer within a reasonable time.
‘Any changes in wages /benefits payable to the Seafarer in the future due to the regulatory guidelines or
‘otherwise shall be incorporated in this SEA with its effective date.
iv. Tax shall be deducted at source on the taxable income as applicable to you under Indian Income Tax rules
and appropriate Tax Deduction Certificate shall be issued to you by the Employer. However, you will be
responsible for all personal taxation whether of an income or capital nature, which may be levied upon you
from time to time. Filing the Timely Tax returns and complying with Income tax regulations shall be your
responsibility.
E, The Wages/Remuneration
‘Agreed between the Employer/Ship-owner and the Seafarer under this Contractual employment are as
follows:

F. Travel and Repatriation
When joining the vessel and upon being signed off from the vessel, the Seafarer shall make the necessary travel
arrangements to Vessel or vice versa (except as mentioned otherwise in this contract) either by Air or Train
‘or Road (in employer’s/ Ship-owner’s option). When travelling by Air, the baggage allowance shall be as
allowed by the Airline concerned. Any extra baggage expenses incurred will be paid by you.
ii, You may resign from the service at any time before the expiry of your contractual employment after giving 30
Days’ notice in writing, in which case you will be entitled to your wages as in Clause E)but you will have to bear
all expenses incurred by the Ship-owner/Employer towards your repatriation. In the event of your leaving the
services in less than 30 days of the written notice, you will entitled to your wages as in clause E) but you will
have to bear all expenses incurred by the Ship/owner/Employer towards your repatriation as well of your
reliever and the Ship-owner/Employer reserves the right to recover all such expenses and all related costs
and/or losses incurred, which would not have -arisen had you fulfilled your contractual employment period. **
If, due to the circumstances involving no fault of yours, it becomes necessary to terminate employment
within the period of your service, the Ship-owner/Employer will give 15 days’ notice in writing or 15
‘months days wages as in clause E) in lieu thereof. **
iv, If you are discharged due to your misconduct and/or negligence, you will receive wages only up to and
including the day of termination of your services, but you will be responsible for your repatriation and reliefs
expenses and for all costs and/or losses incurred, which would not have arisen, had you not been discharged.
\. The Ship-owner/Employer shall arrange free repatriation for you if you require to be signed off on
compassionate grounds prior to the completion of your service on board. Compassionate rounds for an
unmarried person means parents and dependent siblings and for a married person wife, children and parents.
+ Barring certain exceptional circumstances, the notice period by either side shall not be less than 1Sdays.
G. Health Protection and Death & Disability Compensation
i. The “Period of employment! for this clause (G) shall mean:
a. While employed on board only.
ii, During your “period of employment" if you fall ill or get hurt or receive injury, the Ship-Owner shall arrange
and provide, free of cost to you, medical care and treatment on board vessel (including medicines and
therapeutic appliances) as well as access to the shore based medical facilities for the treatment of illness, hurt
and/or injury which includes medical and surgical treatment, dental (except Cosmetic) and optical treatment,
hospitalization, repatriation to the Place of engagement/Home town etc, provided the illness, hurt and/or
Injury was not caused by your own wilful act or default or your own misbehaviour and is not attributable to
your employment.
lil, Ifyou are repatriated to place of engagement/Home town, unfit as a result of illness as stated in Clause G)-i &
{i above, you shall be entitled to free medical attention (including hospitalization) for a maximum period of
upto16 weeks after repatriation and in the case of hurt and/or injury the free medical attention (including
hospitalization) shall continue after repatriation until a medical determination has been made on your
disability.
iv, Ifthe illness, hurt and/or injury caused to you results in incapacity to work, you shall be paid the basic and the
leave wages and the entitlements as stated in Clause E) until repatriated to your place of engagement/home

town, Post repatriation, while undergoing treatment including hospitalization, you shall be entitled to receive
only your Basic wages for a maximum period of 16 weeks after repatriation or less if certified medically fit
v. Ifyou Contact illness or get hurt and/or receive Injury as stated in Clause G)-i & ii which results in your death
(including death arising from marine peril or heart attack or any other natural cause) or due to which your
ability to work is reduced but not being death or disability caused by your own will-full act or default or your
own misbehaviour and cannot be attributed to your employment ,the following lump-sum disability and death
compensation shall be paid to you or your nominated Next of Kin/s:
COMPENSATION FOR DISABILITY(delete as applicable)
a. Ratings and Petty Officers ‘As per latest NMB (India) Agreement

‘The disability compensation shall be over and above the cost of treatment and the wages payable as in sub-
clause i) and ii) above. If you are declared partially incapacitated whist in employment, above Disability
Compensation shall be paid on proportionate basis as medically determined. A disability of 50% or more shall
be considered as full Disability.
COMPENSATION FOR DEATH(deleteas applicable)

vi, The Ship owner, where applicable, shall arrange and pay for the transportation of your mortal remains and/or
burial expenses as applicable. Your personal effect left on board, if any, shall be delivered to you or your next
‘of kin at free of cost by the ship-owner /employer.
H. You warrant that you will disclose to the Ship-owner's/Employer’s doctor, at the time of medical
‘examination, true and complete information about and relevant to your past and present health status. Any
continuing medication needed and surgical operation undergone must be disclosed also. If you are
subsequently found to have failed to disclose the true status of health, you will be liable for all costs and
expenses incurred by the employer as a consequence thereof.
1. _ If during the period of your contractual employment, any area is designated as a war risk area then you will
during the period for which you are required to work in that area shall be entitled to following:
.A war risk bonus amounting to 100% of basic wage. Such entitlement to the bonus will start from the Day
the ship enter the war risk area and the calendar day that the ship leaves the zone. (both inclusive)
b.tn the event of death or disability, the respective compensation shall be twice the amount that would
Have received had the vessel been trading in normal areas.
J. During your first Employment/contract with the Ship-owner/Employer, the first three months of your
service will be considered as probation period. In case you are promoted on board during your
‘employment/ contract, the first three months after the promotion will be the probation period. During the
probation period the ship-owner/employer is entitled to terminate your employment in case of
‘unsatisfactory performance and appraisals from your superiors. Under such circumstances, the ship~
‘owner /employer will pay wages as in clause E) till the date of your sign off from the vessel..
K. You shall be provided catering of required quality and quantity and nutritional value and water including
drinking water on board free of cost. Recreational facilities, as practical, shall be provided on board as well,

|. Hours of work on board shall be in accordance with the governing rules and a record of the same shall be
‘maintained on board and made available to you.
M. On completion of your employment, the employer/ship owner shall provide to you the Record of service
performed including relevant entry in to your Seaman's Book (CDC), where applicable,
N. You will be required to carry all your documents in original which are considered necessary for Service on
Board the vessel to which you are being assigned to. Any expenses that the Ship-owner/employer may incur
due to you not having complied with the above will be chargeable to you.
0. You undertake to abide by the Ship Owner's/Managers "Drug & Alcohol Policy”, “Safety & Environment
Protection Policy”, which has been read and understood by you. Any violation of these requirements may
lead to disciplinary action including dismissal from the service. Any infringement by you of the Drug and
Alcohol Policy may lead to a penalty and/or prosecution and will not be defended by the Ship
owner/Employer.
P. Signing this contract, binds you to sign the appropriate Articles of the ship to which you may be appointed
from time to time by the Ship-owner/Employer.
Q. You agree to not to divulge any secret/confidential business information and data in connection with Ship
‘Owners/Employers business which is likely to prejudice the business interest of the ship owner/Employer.
You also understand and agree that this Employment agreement (Contract of Employment) does not
constitute permanent employment with the Ship-owner/Employer.
