Definitions (i) “Act” means the Real Estate (Regulation and Development) Act, 2016. (i) “Authority” means Karnataka Real Esta subsection (1) f section 20 of the Act. General Guidelines (i) The RERA Bank Account opened in accordance with the provisions of section 4(2\0\0) ofthe Act, shall be a No Lien Account’ and withdrawal from such separate ‘account shall be in accordance with the provisions of the Act, Rules and Directions issued by the Authority from time to time (i) The Authority recommends that the amount withdrawn from the RERA Bank ‘Account shall be utilized for the purpose of completion of the same Real Estate Project. However, there is na end use restrition on the amount which is withdeawn from the RERA Bank Account, In accordance with the provisions ofthe Act, Rules, and Directions, ‘Account Opening (i) ARERA Bank Account i to be maintained for each ofthe registered projects of the Promoter and RERA Bank Account shall be opened inthe local branch where the projects ging on, Details of this projet specific Bank Account are to be submitted with the project registration application. As such the promoters shall have the RERA Bank Account opened before application (ite shall be required to suf the term “RERA Bank Account for < name ofthe project > Real Estate Project” withthe name of the RERA Bank Account holder (w) Every project shall have only one RERA Bank Account opened in the focal branch Where the project is going on. In the case of multiple promoters, necessary ‘contractual or legal arrangements should be made by the principal promoter, who Is registering the project, to ensure proper operations af RERA Bank Account. Withdrawals from Account ‘The Promoter shal be required to follow the following procedure for every withdrawl from RERA Bank Account til the project is completed: (0) As per the second proviso to section 4(2}040) ofthe Act swhich provides thet the amounts from the RERA Bank Account shal be withdrawn by the promoter after itis cetied by an architect, an engineer and a chartered accountant in practice, that the withdrawals im proportion tothe percentage of completion ofthe project, Ai) As per Rule 5 of the Karnataka Real Estate (Regulation and Development) Rules, 2017 which prescribes the withdrawal aspects ofthe amounts deposited Ina RERA Banke Account under Section 4(2}(0} ofthe Act and the sal Rule requires tha for ‘the purpose of withdrawal of amounts cepasited In the RERA Bank Account In respect of Registered Project, the promoter shall have the following three ceticates: 8) Certificate from the Architect in the Template Farm 1, certifying the percentage ‘of completion of construction work of each ofthe taks/activty ofthe building ing ofthe projet ‘) Certificate from the Engineer in the Template Form 2, for the actual cost Incurted on the construction work ofeach ofthe bullding/wing ofthe project; and 1) Certificate from the Chartered Accountant in practice other than the statutory autitor of the Promoter in Template Form 3, for the cat incutred and paid on construction cost and the lan cost. The Chartered Accountant in practice is also Fequied to certify the proportion ofthe cost incurred and psi on construction {ané land cost to the total estimated cost of the project.
