RAPE CULTURE IN GLOBALISING INDIA

ABSTRACT
In the recent times, India has witnessed a series of brutal rape cases which has shocked the
entire country to its core. These incidents have placed the issue of sexual violence back on
the national agenda. This very year, India witnessed yet again, two sets of attacks on girls
aged 16 and 8 which created a huge outrage across the country. There were protests which
were comparable to the rallies that took place after the much-publicized gang rape of
Nirbhaya. It is these continuous incidents which have prompted demands for bringing in a
stricter set of rape laws. Not just women, there have been rapid instances of men getting
raped too however hardly those incidents have been reported. Responding to such outrages,
the Government has finally passed an executive order in the form of the Criminal Amendment
Act 2018. This Act introduces death penalty as a punishment for raping children below 12
years of age along with few other harsher forms of punishment thereby aiming at bringing
the situation at hand under control.
This paper focuses on the rising culture of rape in India. The recently passed Criminal Law
Amendment Bill 2018, by the Lok Sabha on July 30 th has been focused upon, here. The
Criminal Law Amendment Bill, 2018 prima facie seems to effectively control the increasing
rate of rapes in India. However, when looked closely, it comprises of aspects which are
fallacious in nature and play no useful role in the society whatsoever. This paper tries to
bring out the relevant questions regarding the aspects of the above-mentioned Bill along with
that tries to throw light on the situation prevalent in India.
