CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE, made and entered into this ______________ at


Binmaley, Pangasinan, executed by and between the ___________ Binmaley Campus, situated
at San Isidro Norte, Binmaley, Pangasinan, represented herein by the _______________,
_________________., referred to as the LESSOR

And

__________________, of legal age, Filipino and with permanent address at


Lomboy, Binmaley, Pangasinan, herein referred to as the LESSEE.

WITNESSETH

WHEREAS, the LESSOR is the ________________________ wherein the space to


be leased is the Campus Canteen;

WHEREAS, the LESSEE desires to lease the CAMPUS CANTEEN and the LESSOR has
agreed upon, subject to some terms and conditions herein;

NOW THEREFORE, for and in consideration of the faithful observance and in


compliance by the parties on the terms and conditions hereunder stipulated, the LESSOR
hereby allows and leases unto the LESSEE, the above stated property which is the CAMPUS
CANTEEN, in accordance with the following terms and conditions.

TERMS AND CONDITIONS

1. Use of the Leased Canteen - The LESSEE shall use the lease premises hereof for the
purpose of providing food services to the students, employees and visitors and for no
other purposes whatsoever without the written consent/approval of the LESSOR.

2. Terms of Payments – Upon signing of this contract, the LESSEE shall:


a. Pay the LESSOR the amount of Four thousand (P4,000.00) pesos a month as rental
and this contract shall be valid for one year.

b. That the LESSEE shall be charged P200.00/day if and when the LESSEE decides to
operate during Saturdays and Sundays, and on special events as requested.

3. Sublease – The LESSEE shall not directly or indirectly sub-lease, assign or transfer the
rights of leased premises or any portion therein under any circumstances whatsoever,
and any contract made in violation of this lease shall be considered null and void.
4. Permitted Use- The LESSOR shall agree with the LESSEE to use the Campus
Canteen to cater food, snacks, soft drinks, mineral water and the like to the faculty,
staff, students and visitors.

5. Business Permits & Licenses- the LESSEE shall secure on his own account all
permits and licenses as may be required by local authorities and the University in
connection with his business operations and copies of the said permits and licenses shall
be furnished the LESSOR prior to the start of LESSEE/S business thereof.

6. Utilities- Individual Service Utilities

a. Utilities – The electricity, water and other utility charges arising from the use by the
LESSEE of the said Campus Canteen during the leased period will not be included
from the rental.
b. The LESSEE is prohibited from using other electronically driven
appliances/equipment unless permitted by the LESSOR.

7. Abandonment of Lease Premises- if the LESSEE shall abandon or vacate the lease
premises/canteen or if it remains closed for a continuous period of five (5) days at any
time within the term of the lease without informing the LESSOR of the reason of the
temporary cessation of its operation and obtaining the consents accordingly, the
LESSOR may cause the termination of this contract and thereafter compel the LESSEE
to vacate the premises.

8. Breach/Default- In the event of the default or breach, non-performance or non-


observance, of any of the terms and conditions of this contract specifically where the
payment of money is involved, such default or breach or non-performance or non-
observance shall be cause for the cancellation or termination of the contract and the
LESSEE can be required to vacate the leased premises.

9. Improvements and Repairs- That any improvements, attachment, adjunct desired to


the leased property or canteen shall be shouldered by the LESSOR.

10. Prohibition and Use/Purpose

a. The LESSEE is prohibited from selling wine, alcoholic beverages, cigarettes and
prohibited drugs.

b. The LESSEE shall operate from Mondays to Friday from 7am to 6pm unless
otherwise requested by the LESSOR to extend its time service due to special
occasions in the campus.
