THE POLITICAL PARTIES ACT, (CAP.258) REGULATIONS (Made under section 22) ‘THE POLITICAL PARTIES (REGISTRATION AND MONITORING) REGULATIONS, 2019 PARTI PRELIMINARY PROVISIONS 1. These Regulations may be cited as the Political Parties (Registration and Monitoring) Regulations, 2019. 2. In these Regulations, unless the contents otherwise requires- “Act” means the Political Parties Act; “assistant Registrar” means Assistant Registrar appointed under section 5 of the Act; “founding member of a political party” means a person who participates in the formation of 1 political party and who is among the first members of the party: “governing body” means the committee responsible for administering the affairs of a political party; “national leader” means a national leader of a political party as prescribed in the constitution of a political party “office holder” in relation to a political party, means any person who is elected by members of the political party to hold office or leadership position in the party and is registered with the Registrar of Political Parties; “party” or “political party” has the meaning ascribed to it under the Act; “party organ” means a meeting, committee or any other structure of the party established by the party constitution; “register” means the register of particulars of political parties or its members which is ina text and electronic form kept and maintained by the Registrar or a political party; and “Registrar” means the Registrar of Political Parties appointed under seetion 4 of the Act and includes the Deputy Registrar and Assistant Registrar; PART IL APPLICATION FOR PROVISIONAL REGISTRATION 3 option fo 3+ (1) Any person applying for provisional registration of a political party shall regisration of submit to the Registrar an application in duplicate in a dully filled Form PP.1 set out in the Political party Fist Schedule. (2) An application under subregulation (1) shall be accompanied with- (@) a declaration in support of the application in Form PP.2 set out in the First Schedule dully filled and signed by two founding members submitting the application; (b) two copies of the constitution and rules of the party duly signed by two founding member submitting the application and stamped by the party’s official stamp; (©) soft copy of the constitution and rules of the party; (@) party policy statement which includes party ideology; (©) curriculum vitae of the two founding members applying for party registration; (9 birth certificate and proof of citizenship of the two founding members applying for registration of the party; (2) proof of citizenship of the parents of the two founding members applying for registration of the party; (h) two passport size photographs of each founding member submitting application for registration of the party; (a sample of the party flag on a piece of paper and cloth, both in Ad size; () asample membership card; and (K) Proof of payment of application fees for provisional registration. (3) A party membership card shall contain the following information- (a) name of the party; (b) logo of the party; (©) card number; (@) full name of the member; (&) passport size photograph of a member; (© signature of a member; (g) signature of the issuing authority; (h) place and date of issue; and (@) postal and physical address of the party headquarters, (4) Without prejudice to subregulation (1), the Registrar may request additional information relating to the requirements and conditions for registration prescribed in these Regulations and the Act. 4. On receipt of an application under regulation (3), the Registrar shall- (@) publish a notice in at least two newspapers having nationwide circulation, one reaistration being a Kiswahili and the other English newspaper, inviting objections from ‘any person or any other political party concerning the name, symbol or colour of the party seeking provisional registration or any other particular matter relating to the registration of the political party concerned; (©) scrutinize documents in support of an application for provisional registration 4 and may instruct correction or amendments of the same; (6) within thirty days after receipt of a valid application, register the political party and issue a certificate of provisional registration after being satisfied that, an application for provisional registration of a political party meets the requirements and conditions for registration. Centfcat of 5.-(1) The certificate of provisional registration ofa political party shall be in Form rewisonal _pp.3 set out in the First Schedule (2) The Registrar shall, after issuing a certificate of provisional registration, publish the certificate in the Government Gazette. PART il APPLICATION FOR FULL REGISTRATION Aplin 6-(1) Persons applying for fall registration of a political party shall submit to the fulrsseaton Registrar an application in duplicate in a dully filled Form PP.4 set out in the First Schedule. (2) An application under subregulation (1) shall be accompanied with- (@) a declaration in support of the application in Form PP.5 set out in the First Schedule duly filled and signed by two founding members submitting the application; (b) a copy of certificate for provisional registration; (©) number of members of the party in each region in Form PP. 5A accompanied by 4 list of such members by regions, indicating the name, region and party card number of each member; (@) particulars of national leaders of the party in Form PP. SB which shall include the name, sex, address, telephone number, leadership position, date of appointment or election and place of origin whether is Tanzania Mainland or Tanzania Zanzibar and accompanied by: (proof of citizenship; i) party membership card; Gii)curriculum vitae; Civ)passport size photograph; (v) proof of payment of application fees for full registration (vijany other particulars as may be requested by the Registrar which may be necessary for registration purposes; (c) particulars of each founding member of the party in Form PP. SC which shall include sex, religious belief, race, tribe, ethnic group, profession and occupation; (f) location of head office or subhead office of the party and postal address of each office on the basis that, if the head office is established in Mainland Tanzania the subhead office shall be established in Tanzania Zanzibar or vice versa in Form PP. 5D accompanied by a certified copy of the lease agreement of the building or part of the building or proof of ownership of the land on which the party office is located.
