Learned senior counsel appearing for respondent no. 2 submits
that since the petitioner is claiming equitable relief, the petitioner
should at least offer to pay the amount admitted to be due by the
petitioner without prejudice to the rights and contentions of the
parties.
Learned counsel for the petitioner submits that, without
prejudice to the rights and contentions of the parties, the petitioner
would pay to respondent no. 2 the amount admittedly due.
He submits that, without prejudice, 50% of the amount would
be paid to the respondent no. 2 within 15 days and balance 50% of the

amount would be paid within 15 days thereafter.
The respondents may file response, if not already filed within
one week. Rejoinder, if any, be filed within one week thereafter.
