COMPLAINT AFFIDAVIT

I, John Y. Depp, of legal age and a resident of Bulusan, Calapan City,

Oriental Mindoro, after being sworn in accordance with law depose and say that:

1. On January 25, 2019, the respondent borrowed the amount of Four

Hundred Thousand Pesos (P400, 000.00) from me, obliging himself to pay that
loan on or before January 25, 2020. A copy of the promissory note which he made
and issued for that loan is hereto attached as Annex “A.”

2. That as payment of the said loan obligation, he issued to me a post-dated

check. A copy of the said check is hereto attached as Annex “B.”

3. Upon presentment for clearing/collection, that check was dishonored by

the drawee bank for the reason “Account closed/Drawn Against Insufficient
Funds.” The bank debit advice to that effect is hereto attached as Annex “C.”

4. Notice of Dishonor and Demand for payment were made upon the
respondent. However, the latter simply ignored them. A copy of the said notice is
hereto attached as Annex “D”.

5. I am executing this sworn statement for the purpose of charging the

respondent MERLYN U. GUTIERREZ for violation of B.P. Blg. 22 who may be
served with subpoena and other processes of the Honorable Prosecutor and the
Honorable Court at her last known address at Block 12, Lot 6, Acacia Village,
Neo Calapan Subdivision, Sto. Nino, Calapan City, Oriental Mindoro.

IN WITNESS WHEREOF, I have hereunto set my hand this 8 th day of
