CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and entered into by and between:


 
        _________________________ of legal age, single/married, Filipino, and with
residence and postal address
at ______________________________________________, hereinafter referred to as
the LESSOR.
 
-AND-
 
        ___________________________________ and _______________________________
of legal ages, single/married, Filipinos, and with residence and postal address
at ______________________________________________, hereinafter referred to as
the LESSEES.

witnesseth:

WHEREAS, the LESSOR is the absolute and registered owner of the


house and lot located at _________________________________________ as
evidenced by Owner’s Certificate of Title No. ___________________________;

WHEREAS, the LESSOR is leasing the above-stated property and that


the LESSEES are willing to lease said property from the LESSOR.

NOW THERFORE, the LESSOR hereby leases to the LESSEES the


aforementioned property under the following terms and conditions:

1. PERIOD – This CONRACT OF LEASE shall be for a period of ____ (__)


year/s from ____________________ to ___________________.

2. RENTAL
2.1 The LESSEES shall pay to the LESSOR a monthly rental in the
amount of _____________________ PERSOS (Php ________________)
which shall be paid in cash or check within the first ten (10) days
of the month.

3. UTILITIES
3.1 The LESSEES shall pay all charges for electricity, water,
telephone, and other utilities installed on the LEASED
PREMISES and used by the LESSEES. LESSOR shall not impose
any additional charges and/or deposits other than those
imposed by the utility provider LESSEES’ actual electricity
and/or water consumption. In case of sub-meter, LESSOR shall
provide the LESSEES with a Statement of Account to serve as
the basis for the computation/reading of the water/electric
consumption.

4. USE OF THE LEASED PROPERTY


4.1 The LEASED PROPERTY shall be used exclusively by the
LESSEES for residential purposes only and may not be used for
any other purpose without the written consent of the LESSOR
4.2 The LESSEES shall report to the LESSOR of the need to for any
necessary repairs on the LEASED PROPERTY. The LESSOR shall
make or cause to make any necessary repairs upon receipt of the
notice. With the approval of the LESSOR, the LESSEES may
make the necessary repair on the LEASED PROPERY in which
the cost will be deducted from the monthly rental.

4.3 The LESSEES may, at their option, build or put up such


structures/buildings/improvement on the lease premises and for
which, the LESSEES have the right to remove the same upon the
expiration of this contract, or at any time thereto.

5. PRE-TERMINATION OF CONTRACT
5.1 At any time before the expiration of this Contract, either party
may terminate this CONTRACT OF LEASE for violation of any of
the provisions of this Contract. However, before any party can
terminate this contract, the aggrieved party must ask in writing
the erring party to rectify the violation/s within fifteen days from
notice. The said notification shall be referred to as NOTICE TO
RECTIFY. If after fifteen days the erring party still failed to
rectify, the other party may send a NOTICE TO TERMINATE but
the same shall only be effective after thirty days from receipt of
the said notice. In the given situation, the LESSEES shall have
the right to pull out all improvements introduced in the leased
property;

5.2 The LESSSES have the option to terminate this contract for any
valid circumstances such financial losses in its operations,
disturbance of peace and order, and such other events that may
reasonably demand or dictate the termination of this contract by
serving a thirty-day prior written notice to the LESSOR.

6. SANITATION – The LESSEES shall have the most utmost


responsibility of maintaining the cleanliness of the leased property.

7. PROHIBITION AGAINST SUBLEASE – Under no circumstances will


the leased premises be subleased to any other person or entity
without the written consent and approval of the LESSOR.

8. WARRANTIES
8.1 The LESSOR hereby warrants its sole, exclusive and absolute
ownership and possession over the above-mentioned property
free. Moreover, the LESSOR shall defend he peaceful possession
of herein LESSEES from any claims of whatever kind or nature
from third persons within the duration of the contract;

8.2 The LESSOR hereby warrants that the above-described property


is not subject of any pending litigation b any natural or juridical
person before any court or administrative agency;

8.3 Should there be violation of any of the warranties stated in the


next preceding paragraph, the LESSOR shall be obliged to clear
the said property from any liens and encumbrances of whatever
kind and nature and/or secure the dismissal of any pending
litigation in relation thereto. The LESSEES are not however
barred from helping the LESSOR in complying with the
aforementioned obligations. Expenses incurred in compliance
with these obligations are for the account and paid for by
LESSOR;

8.4 Moreover, in the event that the LESSEES are evicted in the
above-mentioned property before the expiration of the contract
by order of any court, the LESSOR shall reimburse the LESSSES
of all rentals received by the latter plus reasonable damages
incurred by the LESSEES in the given circumstance; and

8.5 Any legal action for breach or violation of any provision of this
CONTRACT OF LEASE shall be filed exclusively before the proper
courts of Bacolod City, Negros Occidental.

9. RENEWAL OF CONTRACT
9.1 At the option of either party, this CONRACT OF LEASE may be
renewed, provided that the continuing party shall serve the other
party a written notice of its intention to renew the contract not
later than thirty days before the expiration of this Contract;

9.2 Should this lease be not renewed after the expiration of the term,
said extension of lease shall be understood as running from
month to month only under the same terms and conditions
herein stipulated.

9.3 The LESSOR cannot unilaterally increase the above-stipulated


rentals. Any increase in the rentals has to be agreed by both
parties.

9.4 The LESSEES have the right also to pre-terminate the contract
before one (1) month with written notice to the LESSOR.

10. MISCELLANEOUS PROVISIONS – No verbal understanding shall


in any way alter or vary he terms and conditions of his agreement.
Any revision, amendment or changes shall be agreed upon in writing
and approved by the parties, otherwise, the same shall have no force
and effect.

11. PARTIAL INVALIDITY – In the event that any provision of this


CONTRACT OF LEASE is declared invalid by any lawful authority, all
other provisions not affected by such declaration shall remain valid
and effective.

12. REPEALING CLAUSE – This contract supersedes all other


contracts executed by the same parties for the same purpose.
