Section - I Instructions:
- While attempting subjective examination Text formatting facility will be disabled such as use of bullets,
making the text bold, underlining the text etc. Only normal character on the key board will be available.
- Special characters available on the keyboard will be allowed.
- Students can not attempt more than 2 questions out of given 3.
- A blank (space typed) or any entry in the space provided will be considered as question is answered.
- Hand written answers are not allowed. Subjective test can be answered by using key board.
- No brail support shall be provided, but writer assistance shall be allowed. The student has to intimate it to
SCDL well in advance by completing applicable formalities.
- Answers for both the questions should not exceed more than 110 words. The maximum word limit per
answer is 55 words (for Subjective part).

1) Can employer give notice of discharge or dismissal to a woman employee who is on maternity leave? Give

Discharge or dismissal during maternity leave is considered to be void. When a pregnant woman absents
herself from work in accordance with the provisions of this Act, it shall be unlawful for her employer to
discharge or dismiss her during, or on account of, such absence, or give notice of discharge or dismissal in
such a day that the notice will expire during such absence or to vary to her disadvantage any of the
conditions of her services. Dismissal or discharge of a pregnant woman shall not disentitle her to the
maternity benefit or medical bonus allowable under the Act except if it was on some other ground.
2) What is the definition of 'wages' under the minimum wages Act, 1948?

Wages means all remuneration, capable of being expressed in terms of money, which would, if the terms
of the contract of employment, express or implied, were fulfilled, be payable to a person employed in
respect of his employment or of work done in such employment, and includes house rent allowance, but
does not include the value of (a) any house-accommodation, supply of light, water, medical attendance, or
(b) any other amenity or any service excluded by general or special order of the appropriate Government.
3) What are the main provisions envisaged in the Payment of wages act, 1936?

It regulates the payment of wages in time i.e., not later than 7th day from the last day of the wage period
for factories employing less than 1000 employees and 10th day for factories exceeding 1000 employees.
Wages shall be paid in cash in current currency with in the working hours. Only authorised deductions
can be caused from the earned wages; Workers shall be issued wage slips giving all the details of their
earned wages along with the wages paid; Fines can be imposed as per the rules specified;
