About ACM

ACM is a national retail merchandising company in the U.S., matching on-demand field
merchandisers to local merchandising opportunities offered by large and small retailers throughout
the country.

Since 2005, our merchandisers have been helping retailers with: temporary in-store merchandising
projects including: new store set-ups, store remodels, store resets, display assembly, fixture
installation, product demonstration, brand representation, shelf audits, and plan-o-gram
maintenance.

a. Our expertise is in every aspect of merchandising, including: product placement and


merchandising, stocking and restocking, product tagging, store remodeling, new store
openings, new item introductions, demos, showcasing products, store resets, assembly,
installation and moving of: shelves, fixtures, display items & signs, cleaning and preparing
location for customer traffic.
b. We maintain a broad network of merchandisers throughout the US. It is important that all
our merchandisers stay connected with us by using our Talent Execution Platform
(ACM360) via the ACM mobile app (NextCrew) and web based workspace portal at
https://acm360.net.

Merchandiser Role

As a member of ACM's on-demand merchandising crew, you play an active role in transforming a
vision into reality for the many retailers we support. The ACM on-demand field position role is
highly regarded and respected throughout the industry. It is the perfect position for those seeking
flexible schedules, work variety, challenging assignments, meeting new people and earning good
pay!

As a merchandiser working for ACM, you can work in any number of national retailers or smaller
privately-owned independent stores. Our crew members are not only self-starters capable of
working independently but also are strong contributors working in a team setting. ACM
merchandisers are always punctual, follow direction, handy and proficient with plan-o-grams and
various store schematic and can be relied upon to professionally accomplish various in store
activities as required by our clients.

a. ACM merchandisers are part-time, W-2 Employees based on “on-demand” project work.
b. Our projects vary in duration from 1hr service calls to multi week projects. Individual
project schedules are set by our clients. We cannot guarantee how much you will work, it is
primarily up to you, your availability, flexibility and initiative.
c. When you accept a project and are confirmed, you are accepting the entire project and must
complete it to our client’s satisfaction. Failure to complete a project in full to the satisfaction
of ACM and ACM’s Client could subject you to disciplinary action including possible
termination of the Merchandiser Employment Agreement.
d. Verified ACM Merchandisers have priority status for the many projects we have available
throughout the country which change daily. You will be notified of open opportunities in
your area via the ACM mobile app push notifications, text or email.

Merchandiser Duties

ACM merchandisers shall perform and complete work in a manner that is deemed satisfactory per
ACM and Client requirements and expectations outlined in the project details of ACM360 and in
accordance with all ACM policies, procedures and guidelines as outlined in the Merchandiser
Employment Agreement and Merchandiser Handbook.

Merchandiser responsibilities will include, but are not limited to the following:

a. Setting Displays & Fixtures - Breaking down and assembling new displays, shelves and
fixtures according to management's instructions.
b. Relocating Merchandise - Moving items from one part of the store to another, which may
require carrying the items physically or with the use of carts or dollies to and from the store
floor.
c. Merchandising Products - Properly displaying and tagging products per directives (plan-o-
gram, schematic, etc). Team leads will inspect work for accuracy.
d. Store Appearance - Completing all necessary tasks to prepare the store for re-opening. This
may include changing signage and general cleaning.

Every Merchandiser is responsible for supplying the required tools for each project. Failure to
supply the required tools may result in being denied work, receiving no pay and possible
disciplinary action.

e. Tool Requirements - Each job you are assigned to has specific tool requirements. The Tool
Kit list is available to you in ACM360 in the Documents section of the job details once you
are assigned to the job. The basic minimum tool requirement for most jobs is the following:

Standard for Conduct

The image of the Company is influenced by the actions, conduct, behavior and appearance of
anyone representing ACM. You must always, comply with all laws, regulations and ACM policies,
procedures and guidelines. ACM will not condone or tolerate the activities of anyone representing
ACM who is in violation of any laws or regulations or unethical behavior. We do not permit any
activity that fails to stand the closest possible public scrutiny.

Consistent with ACM’s Standard for Conduct, you agree to:

a. Conduct yourself with propriety and dignity and to do nothing on an assignment or


otherwise that may tend to injure the reputation and goodwill of the Employee, ACM, Client
or Retailer.
b. Not engage in any activity which impairs your capacity to fully comply with the terms of the
Merchandiser Employment Agreement or Handbook, or which impairs your physical or
mental qualities and abilities.
c. Adhere to ACM’s Dress Code and Code of Conduct guidelines in addition to any specific
project assignment guidelines set forth by the Client.
d. Treat all ACM customers, clients, partners, and peers in a polite, respectful, courteous and
businesslike manner.
e. Perform all duties conscientiously, honestly, and in accordance with the best interests of
ACM and the Client.
f. Follow direction, supervision and guidance of the project on-site team lead.
g. Adhere to all general safety procedures and other specific requirements of Client.
h. Not discriminate or harass any individual on the basis of race, national origin, religion,
gender, gender identity, physical or mental disability, medical condition, marital status, age
or sexual orientation.
i. Notify ACM if you encounter, experience, witness or have reason to believe that the
Standards for Conduct are compromised by calling and messaging the ACM Support Team
or Human Resources by phone 772-200-4521 or email support@acmerchandising.net or
hr@acmerchandising.net.

Substance Abuse:
ACM takes the problem of drug and alcohol abuse seriously and is committed to providing a
substance abuse-free workplace for its employees. Substance abuse of any kind is inconsistent with

the behavior expected of our employees, subjects all employees, clients and visitors to unacceptable
safety risks, and undermines our ability to operate effectively and efficiently.

ACM recognizes alcohol and drug abuse as potential health, safety and security problems. The
Company expects all employees to assist in maintaining a work environment free from the effects
of alcohol, drugs or other intoxicating substances. Compliance with this substance abuse policy is a
condition of employment, and violations of the policy may lead to discipline and/or termination.

All employees are prohibited from engaging in the unlawful manufacture, possession, use,
distribution or purchase of illicit drugs, alcohol or other intoxicants, as well as the misuse of
prescription drugs on Company or Client premises or at any time and any place during working
hours. While we cannot control your behavior off the ACM job sites on your own time, we certainly
encourage you to behave responsibly and appropriately at all times. However, any off-duty activity,
including drug or alcohol related activity, that leads to your arrest or that causes embarrassment to
the Company may be grounds for discipline and/or termination.

All employees are required to report to their jobs in appropriate mental and physical condition,
ready to work. When work performance is impaired, admission to or use of a treatment or other
program does not preclude appropriate action by the Company. Any violator of this substance abuse
policy will be subject to disciplinary action up to and including termination of employment.

Workplace Violence:
ACM is committed to the safety and security of our employees. Workplace violence presents a
serious occupational safety hazard to our organization, clients and visitors.

Workplace violence includes any physical assault or act of aggressive behavior occurring where an
employee performs any work-related duty in the course of his or her employment, including but not
limited to an attempt or threat, whether verbal or physical, to inflict physical injury upon any
person; any intentional display of force which would give any person reason to fear or expect
bodily harm; intentional and wrongful physical contact with a person without his or her consent that
entails some injury; or stalking any person with the intent of causing fear of material harm to the
physical safety and health of such person when such stalking has arisen through and in the course of
employment.

Acts of violence by or against any of our employees where any work-related duty is performed will
be thoroughly investigated and appropriate action will be taken, including involving law
enforcement authorities when warranted. All employees are responsible for helping to create an
environment of mutual respect for each other as well as clients and visitors, following all policies,
procedures and practices, and for assisting in maintaining a safe and secure work environment.

Workplace Harassment:
ACM is committed to providing a work environment that provides employees equality, respect and
dignity. In keeping with this commitment, the Company has adopted a policy of “zero tolerance”
with regard to employee harassment. Harassment is defined under federal law as unwelcome
conduct that is based on race, color, religion, sex (including pregnancy, sexual orientation and
gender identity), national origin, age (40 or older), disability or genetic information. Harassment

becomes unlawful where: (1) enduring the offensive conduct becomes a condition of continued
employment; or (2) the conduct is severe or pervasive enough to create a work environment that a
reasonable person would consider intimidating, hostile, or abusive.

This policy applies to all aspects of your employment. Harassment of any other person, including,
without limitation, fellow employees, contractors, visitors, clients or customers, whether at work or
outside of work, is grounds for immediate termination. The Company will make every reasonable
effort to ensure that its entire community is familiar with this policy and that all employees are
aware that every complaint received will be promptly, thoroughly and impartially investigated, and
resolved appropriately. The Company will not tolerate retaliation against anyone who complains of
harassment or who participates in an investigation.

Sexual Harassment:
Sexual harassment is prohibited by federal, state and local laws, and applies equally to men and
women. Federal law defines sexual harassment as unwelcome sexual advances, requests for sexual
favors, and other verbal or physical conduct of a sexual nature, when the conduct: (1) explicitly or
implicitly affects a term or condition of an employee’s employment; (2) is used as the basis for
employment decisions affecting the employee; or (3) unreasonably interferes with an employee’s
work performance or creates an intimidating, hostile or offensive working environment.

Such conduct may include but is not limited to: subtle or overt pressure for sexual favors;
inappropriate touching; lewd, sexually oriented comments or jokes; foul or obscene language;
posting of suggestive or sexually explicit posters, calendars, photographs, graffiti, or cartoons; and
repeated requests for dates. Company policy further prohibits harassment and discrimination based
on sex stereotyping. (Sex stereotyping occurs when one person perceives a man to be unduly
effeminate or a woman to be unduly masculine and harasses or discriminates against that person
because he or she does not fit the stereotype of being male or female.) ACM encourages reporting
of all perceived incidents of sexual harassment, regardless of who the offender may be. Every
employee is encouraged to raise any questions or concerns with any ACM Manager, or Human
Resources.

Dress Code

ACM Merchandiser are expected to maintain a neat, clean appearance and to dress in attire that is
suitable for the workplace and work to be performed. Generally, casual dress pants, a single-color
collared shirt and closed toe shoes (black or brown preferred) are acceptable. Dress code do’s and
don’ts will be provided in ACM360 in the Documents section of the job details of every project you
express interest in and work. If you do not adhere to the specific dress code for the project, you will
be denied work and receive no payment and subject to disciplinary action which may result in
termination of your Merchandiser Employment Agreement. Dress Code includes no visible tattoos
or piercings, jewelry is limited to watch & ring and no hats. If you are ever uncertain about the

required dress code, contact our Scheduling Team at 772-200-4521 and email
schedule@acmerchandising.net.

ACM Dress Code policy is available in ACM360 in the Documents section of the job details once
you are assigned to the job. Please note, dress code will vary based on the specific project.

Safety Policy

ACM recognizes that our Employees are our most valued assets who drive the business.
Management is committed to providing our Employees with a safe and healthful workplace.
Our policy is that all Employees report unsafe conditions and do not perform work tasks if the work
is considered unsafe. Employees must report all accidents, injuries, and unsafe conditions to their
on-site team lead and promptly notify the ACM Scheduling Team by phone 772-200-4521 and
email schedule@acmerchandising.net. No such report will result in retaliation, penalty, or other
disincentive.

Recommendations to improve safety and health conditions will be given thorough consideration.
Management will give attention and resources toward the correction of unsafe conditions, as well as
promote and influence safe behavior. This will be accomplished by:
a. Root cause analysis of safety hazards and corrective action
b. Positive reinforcement of correct and safe activity, and
c. Progressive disciplinary action for those who willfully or repeatedly work in an unsafe
manner.

Management reserves the right to terminate the Employment of any associate at any time for
violation of Company policies.

This policy statement serves to express ACM’s commitment to, and involvement in, providing our
employees with a safe and healthy workplace. This workplace safety and health program will be
incorporated as the standard of practice for this organization. Compliance with these safe practices
and those of any regulatory agency will be required of all employees as a condition to work with
ACM.

As an ACM Merchandiser, if injured on the job, you agree to:

a. Immediately report the incident to the on-site team lead. If possible, complete an incident
report from the retailer or team lead. Take a picture of the Incident Report and text to our
Scheduling Team at 772-200-4521.
b. Notify ACM by calling the Scheduling Team at 772-200-4521.
c. Clock out from your assignment if possible, using the ACM mobile app.
d. Seek immediate medical attention if you feel the need to do so, the closest Emergency
Room or Urgent Care are good sources to seek medical care.

Theft

ACM has a zero tolerance for theft or even the suspicion of theft. All will be grounds for
terminating your Merchandiser Employment Agreement and potentially subject to criminal
prosecution to the fullest extent of the law.

Please be aware that all locations that you work are equipped with high definition security
surveillance cameras. You are under surveillance the entire time you are on location. If you engage
in unusual, suspicious, or illegal behavior you will be subject to disciplinary action which may
result in termination of your Merchandiser Employment Agreement and other possible legal actions.

Background Checks

Our goal is to establish and maintain a business environment of fairness, ethics and honesty for all.
Employees representing ACM may not pose a reasonable and ascertainable risk to the safety or
property of ACM, its Clients, Associates, Retailers or Customers.

As an ACM Merchandiser you agree:

a. ACM may undertake a background check with respect to you in connection with the
subject matter of the Merchandiser Employment Agreement in such manner as ACM
determines to be appropriate and to the full extent permitted by law and may include
checking the Employee’s past history to include civil, criminal, prior claims history, and
traffic history.
b. Not to hold ACM or its Clients liable for any claims in connection with such checking or
the reporting of the results thereof to ACM.
c. ACM reserves the right to terminate the Merchandiser Employment Agreement in the event
the results of the background check are not satisfactory to ACM in its sole discretion. In the
event of any such termination, this Agreement shall be deemed null and void.
d. To provide Full disclosure or any and all convictions of felonies and misdemeanors when
completing your ACM360 profile. Failure to disclose relevant information would be
dishonest and grounds for terminating the Merchandiser Employment Agreement.

Past convictions will not automatically disqualify you from working with ACM, however certain
convictions may not permit specific work opportunities as specified by ACM, Client and Retailer.

Talent Execution Platform (ACM360)

ACM merchandisers are required to maintain an iPhone or Android mobile smart device with WiFi
access to utilize the ACM Talent Execution Platform (ACM360) via the web based online portal at
https://acm360.net.and the mobile app (NextCrew).

a. Description of Services Provided on Our Website/Mobile App:
Access to the online portal Website grants you the ability to complete new hire paperwork
and maintain the accuracy and completeness of your individual crew member profile.
Additionally, you will be granted the ability in the Mobile App to view available jobs, show
interest in jobs you would like to work, confirm jobs once scheduled, clock in & out for each
job worked, review approved hours and payment due, and receive messages and other
important notifications. The information provided and accessible on the Website & Mobile
App is for your use only and not for further distribution to any other person or entity.

You are solely responsible for your ability to access the services found on the Website &
Mobile App, including all necessary hardware and software. You are solely responsible for
protecting your computer & mobile device against interference, spyware or viruses that may
be encountered. ACM shall have no liability for your inability to access the Website or
Mobile App, at any time, and for any reason.

b. Authority and Capacity:


You acknowledge any information you provide in ACM360 will be true, accurate and
current; you will update your information as necessary so that it remains true, accurate and
current; and if any information is found to be inaccurate or outdated, you will immediately
report your findings to ACM.

If it is deemed you are not representing yourself accurately in ACM360, and that you do not
have the skills or appearance portrayed in your profile, ACM or an ACM Client reserves the
right to remove the you from all confirmed projects and you may be subject to disciplinary
action including possible termination of Merchandiser Employment Agreement without
notice.

c. Profile Creation / Password Security:


When you register on the Website, we ask you to provide profile and contact information
and create a user identification (“User ID”) and password. You shall not impersonate any
person or entity or otherwise misrepresent your identity. This includes, but is not limited to,
misrepresentation of your affiliation with any person or entity, using another person’s
username, password or account information, or another person’s name or other identifying
information. If we have reason to suspect any such information you provided is not
authorized, accurate, current or complete, we may refuse your access to the ACM360 or its
resources without notice, in addition to other available remedies under contract, at law and
in equity.

You are responsible for maintaining the confidentiality and security of your User ID and
password, and for all activities that occur while using your User ID and password. You
should not share your User ID and password with any person or entity. We will not be
liable for any loss you may incur as a result of another person or entity using your User ID
and password, either with or without your knowledge. If you become aware that the security
of your User ID and password has been compromised, you must call our corporate office
immediately at 772-200-4521.

d. Rules of Conduct:
You are solely responsible for all content you upload or post to ACM360. You
acknowledge that you will not use ACM360 in any manner and for any purpose prohibited
by law or in violation of this Handbook. You may not use ACM360 for any activity that is
unlawful, and you must not post, publish, or otherwise communicate in ACM360 any
information, language or material that may be considered and/or interpreted as follows:
• Defamatory, libelous, indecent, obscene, fraudulent, threatening, abusive, invades an
individual or group’s privacy, proprietary or other legal rights, for any reason;
• Contains viruses, damaging information or programs of any kind, harmful code, or any
other software which may be harmful to our platform or our hardware or equipment;
• Harms or disrupts, or intends to harm or disrupt, another user’s computer or would allow
you or others to illegally access software or bypass security on websites or services,
including but not limited to, spamming;
• Invades anyone’s privacy by attempting to harvest, store, or publish private or personally
identifiable information, such as passwords, account information, addresses, or other
contact information without their knowledge or consent;
• Misrepresents the source of anything you upload or post, including impersonation of
another individual or entity.

e. Violation:
To ensure the security and integrity of ACM360, all suspected fraudulent, unlawful, or
abusive activity will be investigated and all remedies available sought including, without
limitation, removing your content from ACM360, asking you to refrain from certain
activities, blocking access from a particular Internet address, or suspending your access to
ACM360 without notice, termination of your Merchandiser Employment Agreement, and/or
referring such activity to the appropriate authorities.

f. Account Inactivity:
ACM may terminate any User ID that has not been used to access ACM360 for a period of
one year from the date the User ID was created.

g. Privacy:
Your privacy is important. ACM uses certain information that you provide to us to operate
and provide our services to both you and our clients. By using ACM360, you acknowledge
that we may access, disclose, or preserve information associated with your use of ACM360
and services, including without limitation, your personal information and content, or
information that we acquire about you through your use of ACM360 and services to match
you with the appropriate project and/or client. When we have a good faith belief it is
necessary, we may also access, disclose or preserve your information to: a) comply with
applicable law or respond to legal process from competent authorities; b) to enforce this
Handbook or protect our rights or property or the rights and property of our employees and
clients; and c) to help prevent a loss of life or serious physical injury to anyone.

Project Confirmation

The Company’s primary goal when confirming employees for job openings is to schedule the
persons who have the best available skills, abilities, or experience needed to perform the work.
Decisions regarding the selection and placement of Employees are made on the basis of job-related
criteria provided by the ACM Client.

When job openings become available, all users of ACM360 are encouraged and are welcome to
express interest in the jobs, however, users must have completed onboarding and be hired
Employees of ACM to be eligible to be scheduled and work any job. As job openings occur in
ACM360, notices relating general information about the positions are posted. The project manager
with the opening will arrange project calls with employees who apply.

As an ACM merchandiser you agree to:

a. Utilize ACM360 to access and read the full project details and acknowledge confirmation
of each project within 24 hours of receiving notification to ensure understanding of all
project requirements and fulfillment obligations. If confirmation acknowledgment is not
made within 24 hours of notification, the Employee will be removed from the project.
Project questions are to be directed to the ACM Scheduling Team by direct message in
ACM360, by email to schedule@acmerchandising.net or by phone to 772-200-4521.
b. Arrive to job site on time each day of the project, follow the Client’s specific requirements,
adhere to the Client’s lunch and break schedules, and depart the Client’s location each day
at the designated time as detailed in the project terms or specific direction of the on-site
team lead.
c. The right to refuse an opportunity by ACM, however once an opportunity is accepted and
confirmed, the Employee agrees to complete each project in its entirely, working all days
and times as scheduled. Failure to complete a confirmed project in full to the satisfaction of
ACM and ACM’s Client could subject you to disciplinary action including possible
termination of the Merchandiser Employment Agreement.

Project Execution & Time Tracking

Our reliability and dependability to our clients is what sets ACM apart from our competition.
Punctuality, attendance and job performance of our merchandisers are critical. When you accept a
project and are confirmed, you are accepting the entire project and must complete it in full.

We have a 12-hr emergency cancellation policy. If you are running late or unable to work due to an
emergency, you must notify us ASAP by calling and messaging the ACM Scheduling Team by
phone 772-200-4521 and email schedule@acmerchandising.net.

Agreement.
As an ACM merchandiser you agree to:

a. Arrive at the job site 15mins prior to the scheduled shift start time and Clock In from the
parking lot via the ACM mobile app (NextCrew), making sure to include a selfie photo in
front of the store.
b. If you encounter a problem Clocking In, you must call the ACM Scheduling Team at 772-
200-4521 immediately.
c. If running late for a project shift, notify the ACM Scheduling Team immediately by phone
at 772-200-4521. You will only be paid for the time spent executing the project. Failure to
notify ACM of a late arrival for a project shift may be subject to disciplinary action and
possible termination of Merchandiser Employment Agreement.
d. If you arrive at a project location and cannot execute the project for whatever reason,
Contact the ACM Scheduling Team immediately by phone at 772-200-4521 in order to be
released of liability for failed project completion.
d. Upon completion of shift, Clock Out from the parking lot via the ACM mobile app
(NextCrew), making sure to include a selfie photo in front of the store.
e. Authorized Hours – You are only authorized to work the hours given on your schedule as
stated in ACM360. You are not permitted to leave your assignment unless released by the
on-site team lead. You must call to notify the ACM Scheduling Team 772-200-4521 if:
 On-site team lead releases you early.
 On-site team lead requests you work more than the scheduled hours.
 On-site team lead requests you start at a different time than what is scheduled.
 On-site team lead requests you work a different location or another assignment.
f. Under current federal and state employment laws, insubstantial or insignificant periods of
time spent outside of scheduled work hours may be disregarded by ACM for purposes of
computing and paying compensation. Certain clerical and administrative tasks performed
outside of scheduled work hours, including, but not limited to, time spent documenting and
providing ACM with data concerning hours worked and duties performed will not be
compensated. You must contact HR at hr@acmerchandising.net and obtain written consent
of ACM prior to performing any such clerical or administrative tasks that may exceed an
insubstantial period (7 minutes or more) to perform.

Cancellation Policy

We have a 12-hr emergency cancellation policy. If you are unable to work due to an emergency,
you must provide ACM a minimum 12-hour notice.

a. All cancellation notifications must be in writing to the ACM Scheduling Team by direct
message in ACM360 or email to schedule@acmerchandising.net AND verbally by phone
to 772-200-4521. You MUST speak to a Project Manager to be released of liability for
project completion as voice mail messages are NOT acceptable for project cancellations.
b. If you fail to provide written and verbal notification AND do not report for a project shift,
you will be subject to disciplinary action including possible termination of the

Merchandiser Employment Agreement and ineligible for future employment opportunities
with ACM.
c. Cancellations within 12 hours of the project start time will result in disciplinary action and
payment due will only be for the actual days and time you spent executing the project.

Hotel Policy

Certain projects may require pre-approved travel. ACM will pay for authorized lodging expenses
incurred while conducting authorized ACM business in compliance with the ACM Merchandiser
Employment Agreement.

In such cases when travel is approved by ACM, you agree:


a. To stay in a standard room in a safe, comfortable hotel or motel.
b. Not to switch hotels without prior authorization and arrangements made directly through
ACM.
c. To make reservations at a CLC contracted hotel through the CLC Lodging online booking
website at https://account.clclodging.com/login.cfm. Lodging rates may not exceed $70
nightly without pre-approval by ACM Management.
d. To call the hotel directly to cancel a reservation that will not be used.

The following list of items must be adhered to for all hotel stays:
a. A credit card, debit card or cash deposit must be provided to the hotel upon check-in to
cover potential incidentals or damage.
b. Check-in and out on time. ACM will not pay for no-show charges or an extra night stay
due to late checkout.
c. Compliance with the max occupancy of the room. Rooms may be shared with non-business
guests such as a spouse only up to the listed occupancy of the room.
d. Pets are not permitted under any circumstances.
e. Permitted one (1) night stay per each day worked. One day worked equals one-night stay.

The following is a list of items that are your responsibility and are not covered by ACM. This list is
not all-inclusive.
a. No-show charges
b. Room damages
c. Tips
d. Meals / Drinks
e. Parking / Tolls / Tickets
f. Phone calls / Internet Use
g. Room cleaning / Laundry
h. Personal Entertainment (in-room movies, health club fees, sightseeing tours, mini-bar, etc.)
i. Any other item bought for personal use (magazines, clothing, etc.)

Hotel accommodations will be paid for by ACM through direct billing. If any unauthorized charges
are billed to ACM, the cost of the unauthorized charges will be directly deducted from your next
issued paycheck. Unauthorized charges include no-show charges.

Payroll

a. ACM pays bi-weekly in accordance with published Payroll Schedule which is available in
ACM360.
b. Compensation is based on Hourly Pay Rates for work performed at the job site only. Such
Hourly Pay Rates are determined on a project by project basis and available for review and
consideration prior to the acceptance of each project.
1. Employee drive time and/or any other potential expenses for Travel are NOT paid by
ACM unless expressly stated on an exception basis.
2. If any additional compensation is offered, it will be expressly stated in writing on an
exception basis and subject to specific terms and performance conditions.
c. You agree to utilize ACM’s online time reporting system and to submit a timesheet to ACM
within 24 hours of completing a project. Payments due may be placed on hold if the
Employee fails to submit a timesheet when due.
d. You agree to provide ACM any supporting documentation that a respective Client may
require for a project in a timely manner. If the required supporting documentation is not
submitted timely with the respective timesheet, payments due may be placed on hold until
required supporting documentation is properly submitted.
e. If you do not complete a confirmed project in its entirety as specified in the project terms,
you will not be paid for the missed work. Compensation for each project is only payable per
hour for actual hours worked and services rendered.
f. All compensation due for services rendered by you in the performance of projects procured
for you by ACM will be paid directly by ACM via your selected method of payment of
direct deposit, pay card or check and issued in accordance with ACM’s bi-weekly Payroll
Schedule.
g. You may view and download itemized electronic payment receipts online by registering for
an online account with Paychex Flex at https://myapps.paychex.com.
h. ACM will withhold the following taxes from your paycheck: Federal, State and Local taxes,
as required by law, as well as the required FICA (Social Security and Medicare) payments.
i. Tax Information: W-2 will be available online in Paychex Flex and will be mailed to
primary address in ACM360 by January 30th each year. It is your sole responsibility to
keep ACM informed of his/her current mailing address by maintaining accurate and
complete information in ACM360.
j. You may have your paycheck deposited directly into your bank account. You may add your
bank information to your profile in ACM360.
k. If your paycheck is lost/stolen or direct deposit/pay card has an error, you agree to notify
ACM by calling and messaging the ACM Support Team by phone 772-200-4521 and email
support@acmerchandising.net. You further agree to complete an ACM supplied notarized
affidavit http://bit.ly/ACM-AFF. and submit to ACM at hr@acmerchandising.net. Upon
receipt of the notarized affidavit, the original payment will be voided, and a replacement
payment will be processed and added to the following pay period.

l. You agree not to ask the Client questions regarding payments and to direct questions or
concerns regarding payments to ACM in writing by email to support@acmerchandising.net.
m. As a Temporary Part Time Employee, you are not entitled to holiday pay.

Employer Provided Insurance

As a temporary part time employee, you are eligible for Social Security, Medicare and Federal
Insurance Contributions Act (FICA). Both employer and employee are required to contribute to
these funds. You are NOT eligible for Short Term Disability, Health and Dental Insurance

Other Insurance:
a. Workers Compensation Insurance – You are covered, in accordance with ACM policy
and conditions, refer to Safety Policy.
b. Unemployment Insurance – You are covered, in accordance with state specific rules,
regulations and conditions.
c. Auto Insurance – Throughout the term of the Merchandiser Employment Agreement, you
shall procure and maintain in force automobile liability insurance in minimum amounts of
$25,000 per person/$50,000 per accident personal injury liability coverage and $10,000 per
accident property damage liability coverage, with a maximum deductible of $500. Any
such automobile insurance required to be carried by Employee shall be primary, and not
excess, to any other insurance carried by ACM. Employee’s automobile insurance policy
shall contain a provision that states that coverage will not be canceled without thirty (30)
days prior written notice to ACM.

Employee Issues

ACM's open-door policy in business reflects our commitment to transparent and flexible
communication between managers and Merchandisers. Good communication is essential to
maintaining a pleasant and productive work environment. Concerns about work conditions, pay,
employment practices, clients or fellow employees should be voiced openly and directly with an
ACM Manager rather than involving a third party. Employees are expected to make an honest effort
to assist in working out a solution. In general, speak up when you have an opinion about something.
Also, inform us when you notice harassment, victimization or any violation of the ACM code of
conduct. We need you to ensure the workplace is safe where every employee is treated with
equality, respect and dignity. Employees are encouraged to report any concerns to their manager or
to the Crew Support Team at 772-200-4521 or email support@acmerchandising.net . If you are is
not satisfied with a response to an issue, you should report the matter to the Human Resources
Department at hr@acmerchandising.net. Human Resources will review and investigate all concerns.
Your relationship with ACM will not be jeopardized as a result of speaking up. Our sincere desire is
to maintain open channels of communication that will promote a productive work environment for
all.
