CHAPTER ONE

GENERAL PROVISIONS

Art cle 1. Purpose of the Law

1.1. The purpose of th s Law s to regulate relat ons w th respect to ma nta n ng c v l state reg strat on
and other related relat ons.

Art cle 2. Leg slat on on C v l State Reg strat on

2.1. Leg slat on on c v l state reg strat on shall cons st of the Const tut on of Mongol a[1], C v l Code[2],
Fam ly Law[3], General Law on State Reg strat on[4], Law on travel and mm grat on abroad of c t zens of
Mongol a[5], th s Law[6] and other leg slat ve acts ssued n conform ty therew th.

2.2. If an nternat onal treaty of Mongol a s ncons stent w th th s Law, then the prov s ons of the
nternat onal treaty shall preva l.

Art cle 3. Scope of the Law

3.1. Relat ons w th respect to acqu s t on, cessat on and restorat on of c t zensh p of Mongol a shall be
regulated by the Law on C t zensh p[7], and reg strat on of res dence, travel and m grat on of fore gn c t zens
and stateless persons n Mongol a shall be regulated by the Law on Legal Status of Fore gn C t zens[8].

3.2. Th s Law shall regulate relat ons ar s ng n connect on w th c v l state reg strat on of c t zens of
Mongol a as well as fore gn c t zens and stateless persons res d ng and m grat ng on the terr tory of Mongol a,
w th except on of those spec f ed n Paragraph 3.1 of th s Law.

Art cle 4. Def n t ons of Terms of the Law

4.1. The follow ng terms used n th s Law shall be understood as follows:

4.1.1. “C v l reg strat on number” refers to a 12-d g t number ssued from c v l reg strat on
database to a person who s reg stered n reg strat on of b ometr c tra t (f ngerpr nt);

4.1.2. “C v l state reg strat on” refers to the prov s on of Paragraph 3.1.2 of the General Law on
State Reg strat on;

4.1.3. “C v l state reg strat on number” refers to a number represent ng the order of reg strat on n
c v l state reg strat on;

4.1.4. “References from c v l state reg strat on” refers to a document ver fy ng the correctness of
reg strat on nformat on based on c v l state reg strat on database;

4.1.5. “C v l state reg strat on database” refers to a set of arch ve and electron c database of
source documents of the c v l state reg strat ons spec f ed n Paragraph 6.1 of the General Law on State
Reg strat on;

4.1.6. “Source documents of c v l state reg strat on” refers to a c v l state reg strat on record,
reg strat on number book, automated central populat on reg strat on form, c v l state reg strat on form,
ver f cat on document prov ded n leg slat ons and assessment of state superv s on nspector;

4.1.7. “Reg strat on number” refers to an unrepeated code composed of 2 letters and 8-d g t
number spec fy ng the date of b rth and gender of a c t zen of Mongol a.

CHAPTER TWO

CIVIL STATE REGISTRATION

Art cle 5. Ma ntenance of C v l State Reg strat on

5.1. C v l state reg strat on shall be ma nta ned n the Mongol an language.

5.2. State adm n strat ve organ n charge of state reg strat on, ts local bod es and state reg strars
(here nafter referred to as “state reg strar”), and off cers respons ble for c v l state reg strat on n d plomat c
m ss ons abroad (here nafter referred to as “reg strat on off cer”) shall carry out the ma ntenance of c v l state
reg strat on on the bas s of state reg strat on database n accordance w th th s Law.

5.3. Reg strat on n c v l state reg strat on shall be den ed only on the bas s of laws.

5.4. When reg ster ng n c v l state reg strat on, the fees nd cated n the Law on State Stamp Dut es[9]
shall be pa d.

5.5. Reg strat on off cers of d plomat c m ss ons abroad (here nafter referred to as “d plomat c
m ss on”) shall ma nta n the c v l state reg strat ons spec f ed n Paragraphs 6.1.1, 6.1.2, 6.1.3, 6.1.4, 6.1.5, 6.1.8,
6.1.9, 6.1.10 and 6.1.11 of the General Law on State Reg strat on.

5.6. C v l state reg strat ons other than reg strat ons of adopt on, change of fam ly name, surname or
name, sex change, m grat on, acqu s t on, cessat on and restorat on of c t zensh p of Mongol a shall be reg stered
regardless of the jur sd ct on of adm n strat ve un ts.

5.7. C v l state reg strat on n relat on to fore gn c t zens and stateless persons shall be reg stered by a
state adm n strat ve organ n charge of state reg strat on and ts local bod es.

5.8. Procedure on ma nta n ng c v l state reg strat on and templates of state reg strat on cert f cates of
b rth, marr age and death shall be approved by a Government member n charge of state reg strat on.

5.9. Procedure on del ver ng source documents of the c v l state reg strat ons referred to n Paragraph 5.5
of th s Law to a state adm n strat ve organ n charge of state reg strat on shall be approved jo ntly by
Government members n charge of state reg strat on and fore gn affa rs.

5.10. Templates of documents other than those spec f ed n Paragraph 5.8 of th s Law, forms and the
procedure on ssu ng, chang ng and revok ng reg strat on numbers shall be approved by a head of state
adm n strat ve organ n charge of state reg strat on.

5.11. Documents n fore gn languages w th the r off c al translat on shall be documents ver fy ng the
r ght to reg ster n c v l state reg strat on.

5.12. Every c t zen of Mongol a shall have a reg strat on number and th s number shall be recorded n
state reg strat on cert f cates of b rth, marr age or death, c t zen dent ty card, nat onal passport and the r
dent cal documents.

5.13. Numbers of c v l state reg strat on form and cert f cate shall co nc de w th the c v l state reg strat on
number spec f ed n Paragraph 4.1.3 of th s Law.

5.14. C v l state reg strat on can be recorded n electron c form and the general procedure set forth n th s
Law shall apply equally.

Art cle 6. Reg strat on of B rth

6.1. Parent or h s/her author zed representat ve or representat ve of competent author ty shall subm t and
reg ster n reg strat on of b rth the follow ng documents w th n 30 days after the b rth of a ch ld:

6.1.1. Parent's c t zen dent ty card or, f the parent s a fore gn nat onal or stateless person, a
passport or ts subst tute document;

6.1.2. Med cal descr pt on on the b rth of a ch ld;

6.1.3. Parents’ marr age cert f cate.

6.2. For reg strat on of b rth of a ch ld born on the terr tory of Mongol a from parents, one of whom s a
c t zen of Mongol a and another s a fore gn c t zen or stateless person, separate appl cat ons of parents shall be
enclosed to the documents spec f ed n Paragraph 6.1 of th s Law.

6.3. For reg strat on of b rth of a ch ld born on the terr tory of fore gn country from parents, one of whom
s a c t zen of Mongol a and another s a fore gn c t zen or stateless person, separate appl cat ons of parents on
the r mutual agreement to reg ster the r ch ld as a c t zen of Mongol a n reg strat on of b rth, shall be enclosed to
the documents spec f ed n Paragraph 6.1 of th s Law.

6.4. If the ch ld referred to n Paragraph 6.3 of th s Law s not reg stered n reg strat on of b rth w th n the
per od set forth n Paragraph 6.1 of th s Law, a reference letter of competent author ty ev denc ng that a
c t zensh p of fore gn country has not been acqu red, shall be enclosed.

6.5. If parents who have not reg stered the r marr age want to reg ster the r ch ld n a father’s fam ly
name and g ven name, they shall subm t separate appl cat ons. If one of the parents cannot personally subm t,
h s/her appl cat on shall be cert f ed by a notary.

6.6. C t zen or representat ve of ch ld care nst tut on w sh ng to take care of a ch ld whose parents have
not been determ ned, shall record the ch ld to pol ce w th n 2 days after the d scovery of the ch ld.

6.7. In the case prov ded n Paragraph 6.6 of th s Law the follow ng documents shall be subm tted and a
ch ld shall be reg stered n reg strat on of b rth:

6.7.1. Pol ce descr pt on;

6.7.2. Court dec s on or forens c nqu ry’s conclus on on sett ng age of the ch ld.

6.8. Ch ld born w th n 10 months after the death of h s father may be reg stered n the father's fam ly
name and g ven name on the bas s of the documents spec f ed n Paragraph 6.1 of th s Law and the death
cert f cate. If parents d d not reg stered n reg strat on of marr age, a court rul ng that he s a ch ld of the
deceased shall be enclosed.

6.9. In order to reg ster a ch ld n the father’s fam ly name and g ven name, who was born w th n 10
months after the d vorce or nval dat on of parents’ marr age, separate appl cat ons of the parents or court
dec s on on patern ty determ nat on, shall be enclosed to the documents spec f ed n Paragraphs 6.1.1 and 6.1.2
of th s Law.

6.10. If a ch ld d ed before b rth reg strat on, n order to reg ster the deceased ch ld n reg strat ons of
b rth and death, parents shall enclose a med cal descr pt on on the death of the ch ld to the documents spec f ed
n Paragraph 6.1 of th s Law.

6.11. State reg strars and reg strat on off cers shall record reg strat on of b rth w th n 1 work ng day after
rece v ng the documents spec f ed n Paragraphs 6.1, 6.2, 6.3, 6.4, 6.5, 6.7, 6.8, 6.9 and 6.10 of th s Law.

6.12. B rth cert f cate shall nclude the follow ng:

6.12.1. C v l state reg strat on number;

6.12.2. Ch ld’s reg strat on number;

6.12.3. Ch ld’s fam ly name, surname and g ven name;

6.12.4. Date of ch ld's b rth, gender, place of b rth;

6.12.5. Date of reg strat on n reg strat on of b rth;

6.12.6. Father’s c t zensh p, reg strat on number, fam ly name, surname and g ven name;

6.12.7. Mother’s c t zensh p, reg strat on number, fam ly name, surname and g ven name;

6.12.8. Name of a reg ster ng author ty;

6.12.9. State reg strar’s or reg strat on off cer’s s gnature and stamp.

6.13. B rth of tw n ch ldren shall be reg stered n sequence, and a b rth cert f cate shall be ssued to each
ch ld.

6.14. If the appl cat on referred n Paragraph 6.5 of th s Law has not been subm tted, or a court dec s on
on patern ty determ nat on has not been taken, or the prev ous marr age of one of the parents has not ended, a
b rth of ch ld shall be reg stered n the mother’s fam ly name and g ven name.

6.15. If one of the parents s a c t zen of Mongol a and another s a fore gn c t zen or stateless person, a
b rth of ch ld may be reg stered n the fam ly name of the parent who s a fore gn c t zen or stateless person on
the parents’ mutual consent n accordance w th th s Law.

6.16. B rth of a ch ld born from fore gn c t zens or stateless persons on the terr tory of Mongol a may be
reg stered and a b rth cert f cate can be ssued w thout reg strat on number.

6.17. If a ch ld d ed before reg strat on of b rth, reg strat ons of b rth and death shall be carr ed out on the
bas s of a med cal descr pt on.

Art cle 7. Reg strat on of Marr age

7.1. Appl cants for marr age shall subm t and personally reg ster n reg strat on of marr age the follow ng
documents:

7.1.1. Separate appl cat ons;

7.1.2. Appl cants’ c t zen dent ty cards, or passports or the r subst tute documents of fore gn
c t zens or stateless persons;

7.1.3. Med cal exam nat on descr pt on of appl cants referred n Art cle 8 of the Fam ly Law.

7.2. When cons der ng a m nor w th full legal capab l ty n accordance w th Paragraph 15.2 of the C v l
Code, the relevant court dec s on shall be enclosed to the documents spec f ed n Paragraph 7.1 of th s Law.

7.3. In case of reg strat on of marr age of a fore gn c t zen w th a c t zen of Mongol a or fore gn c t zens
res d ng pr vately or off c ally n Mongol a, a document on marr age status ssued by competence author ty or
d plomat c m ss on of the relevant fore gn country shall be enclosed to the documents spec f ed n Paragraph 7.1
of th s Law.

7.4. If a c t zen of Mongol a, who reg stered h s/her marr age n accordance w th leg slat on of fore gn
countrym, w shes to reg ster n reg strat on of marr age, a marr age cert f cate ssued by competent author ty of
the relevant fore gn country shall be enclosed to the documents spec f ed n Paragraphs 7.1.1 and 7.1.2 of th s
Law.

7.5. State reg strars and reg strat on off cers shall record reg strat on of marr age w th n 5 work ng days
after the rece pt of the documents spec f ed n Paragraphs 7.1, 7.2, 7.3 and 7.4 of th s Law.

7.6. When record ng reg strat on of marr age, spouses shall be accompan ed by w tnesses and a w tness
shall be over the age of 18 years.

7.7. Marr age cert f cate shall nclude the follow ng:

7.7.1. C v l state reg strat on number;

7.7.2. F ance’s reg strat on number;

7.7.3. F ance’s c t zensh p, date of b rth, fam ly name, surname and g ven name;

7.7.4. F ancee’s reg strat on number;

7.7.5. F ancee’s c t zensh p, date of b rth, fam ly name, surname and g ven name;

7.7.6. Date of reg strat on;

7.7.7. Name of a reg ster ng author ty;

7.7.8. State reg strar’s or reg strat on off cer’s s gnature and stamp.

7.8. If there are mped ments to marr age spec f ed n Art cle 9 of the Fam ly Law, the reg strat on
of marr age shall be den ed.

Art cle 8. Reg strat on of Marr age End

8.1. C t zens, who fulf ll the grounds spec f ed n Art cle 13 of the Fam ly Law and mutually consent to
d vorce the r marr age by adm n strat ve procedure, shall subm t and personally reg ster n reg strat on of
marr age end the follow ng documents:

8.1.1. Separate appl cat ons;

8.1.2. C t zen dent ty cards, or passports or the r subst tute documents of fore gn c t zens or
stateless persons;

8.1.3. Marr age cert f cate.

8.2. If a c t zen who s d vorc ng h s/her marr age by adm n strat ve procedure cannot be present for good
reason, the appl cat on spec f ed n Paragraph 8.1.1 of th s Law shall be cert f ed by a notary.

8.3. C t zen, who has d vorced h s/her marr age by jud c al procedure, shall subm t the follow ng
documents w th n 3 work ng days after the day the court dec s on comes nto force and shall reg ster them n
c v l state reg strat on:

8.3.1. C t zen dent ty card;

8.3.2. Court dec s on on d vorce.

8.4. If spouses are c t zens of Mongol a or a spouse s a fore gn c t zen or stateless person and the r
d vorce n accordance w th leg slat on of a fore gn country does not contrad ct the leg slat on of Mongol a, the r
marr age end shall be reg stered n c v l state reg strat on on the bases of a document ssued by competent
author ty of the relevant fore gn country.

8.5. State reg strars and reg strat on off cers shall record reg strat on of marr age end w th n 21 work ng
days after the rece pt of the documents spec f ed n Paragraphs 8.1, 8.2 and 8.4 of th s Law and w th n 1 work ng
day after the rece pt of the documents spec f ed n Paragraph 8.3 of th s Law.

8.6. If a spouse s reg stered n death reg strat on, h s/her marr age end shall be reg stered n c v l state
reg strat on.

Art cle 9. Reg strat on of Marr age Rest tut on

9.1. C t zens, who want to reg ster the r marr age rest tut on, shall subm t and personally reg ster
the follow ng documents:

9.1.1. Separate appl cat ons;

9.1.2. C t zen dent ty cards, or passports or the r subst tute documents of fore gn c t zens or
stateless persons;

9.2. If a court dec s on on declar ng a c t zen m ss ng or deceased s cancelled, the court dec s on shall be
enclosed to the documents spec f ed n Paragraph 9.1 of th s Law.

9.3. If a court declares a d vorce nval d, the court dec s on shall be enclosed to the documents spec f ed
n Paragraph 9.1 of th s Law.

9.4. State reg strars and reg strat on off cers shall record reg strat on of marr age rest tut on w th n 5
work ng days after the rece pt of the documents spec f ed n Paragraphs 9.1, 9.2 and 9.3 of th s Law.

Art cle 10. Reg strat on of Patern ty Determ nat on

10.1. Parents, who have reg stered the r marr age after reg ster ng a b rth of the r ch ld and want to
reg ster the r ch ld n the father's fam ly name and g ven name, shall subm t and personally reg ster the follow ng
documents:

10.1.1. Parents’ appl cat on;

10.1.2. C t zen dent ty cards, or passports or the r subst tute documents of fore gn c t zens or
stateless persons;

10.1.3. Marr age cert f cate;

10.1.4. Ch ld’s b rth cert f cate and c t zen dent ty card.

10.2. If a parent cannot be present for good reason, h s/her appl cat on for patern ty determ nat on shall
be cert f ed by a notary.

10.3. If the patern ty s determ ned by court, a parent shall subm t and reg ster the follow ng appropr ate
documents:

10.3.1. Parents’ c t zen dent ty cards, or passports or the r subst tute documents of fore gn
c t zens or stateless persons;

10.3.2. Ch ld’s b rth cert f cate and c t zen dent ty card;

10.3.3. Court dec s on on the patern ty determ nat on.

10.4. State reg strars and reg strat on off cers shall record reg strat on of patern ty determ nat on w th n 5
work ng days after the rece pt of the documents spec f ed n Paragraphs 10.1, 10.2 and 10.3 of th s Law.

10.5. Patern ty, determ ned by leg slat on of a fore gn country n respect to a c t zen of Mongol a, may be
reg stered n reg strat on of patern ty determ nat on n accordance w th the Fam ly Law.

Art cle 11. Reg strat on of Adopt on

11.1. Adopter shall subm t the follow ng documents and personally approach to a governor of soum or
d str ct where a ch ld s res d ng:

11.1.1. Appl cat on;

11.1.2. Consent of parents to g ve the r ch ld for adopt on;

11.1.3. C t zen dent ty cards of adopter and parents or guard an or trustee;

11.1.4. Marr age cert f cate, f marr ed;

11.1.5. Consent of a ch ld foster nst tut on, f a ch ld s n th s nst tut on.

11.2. The documents spec f ed n Paragraphs 11.1.1 and 11.1.2 of th s Law shall be cert f ed by a notary.

11.3. The appropr ate consents spec f ed n Paragraphs 55.2, 55.3 and 55.4 of the Fam ly Law shall be
enclosed to the documents spec f ed n Paragraph 11.1 of th s Law.

11.4. Governor of soum or d str ct, f he cons ders the documents spec f ed n Paragraphs 11.1 and 11.3
of th s Law to be completed, shall ask an off cer respons ble for ch ldren and soc al welfare matters to make an
op n on.

11.5. Governor of soum or d str ct shall dec de whether to g ve a ch ld for adopt on w th n 20 days on the
bas s of the op n on referred n Paragraph 11.4 of th s Law.

11.6. State reg strars shall record reg strat on of adopt on w th n 1 work ng day after the rece pt of
dec s on of author zed person and add t to a b rth cert f cate.

11.7. Reference from c v l state reg strat on may be ssued at the request of competent author ty, adopt ve
parents, guard an and trustee, as well as to nat ve parents w th the consent of the adopt ve parents.

11.8. Based on the court dec s on on the nval dat on of adopt on, state reg strar shall amend the
reg strat on and restore the reg strat on of b rth.

Art cle 12. Reg strat on of Change of Fam ly Name, Surname and G ven Name

12.1. C t zen, who wants to change h s/her fam ly name, surname or g ven name, shall subm t the
follow ng documents and reg ster them w th a state reg strat on author ty of the place of h s/her res dence:

12.1.1. Appl cat on;

12.1.2. B rth cert f cate, c t zen dent ty card, or passport or ts subst tute document of fore gn
c t zen or stateless person.

12.2. The follow ng appropr ate documents shall be enclosed to the documents spec f ed n Paragraph
12.1 of th s Law:

12.2.1. Marr age cert f cate, f an appl cant to change h s/her fam ly name, surname or g ven
name s marr ed;

12.2.2. Ch ld’s b rth cert f cate and c t zen dent ty card, f an appl cant to change h s/her fam ly
name, surname or g ven name has a ch ld;

12.2.3. Consent of parents or guard an, f a fam ly name, surname or g ven name of c t zen w th
part al c v l legal capab l ty s changed;

12.2.4. Consent of parents or trustee, f a fam ly name, surname or g ven name of c t zen w th
some c v l legal capab l ty s changed;

12.2.5. Court dec s on, f a c t zen cons dered the person w thout c v l legal capab l ty.

12.3. C t zen may request to change h s/her fam ly name, surname or g ven name on the follow ng
grounds:

12.3.1. Parent’s ancestral fam ly name has been erroneously determ ned and reg stered n c v l
state reg strat on;

12.3.2. C t zen of Mongol a marr ed to a fore gn c t zen or stateless person wants to reg ster n
h s/her spouse’s fam ly name;

12.3.3. C t zen, who has h s/her father’s fam ly name and g ven name, wants to change by h s/her
mother’s fam ly name and g ven name, and a c t zen, who has h s/her mother’s fam ly name and g ven name,
wants to change by h s/her father’s fam ly name and g ven name;

12.3.4. Fam ly name, surname or g ven name of a c t zen n the c v l state reg strat on electron c
database s d fferent from h s/her fam ly name, surname or g ven name n h s/her documents.

12.4. C t zen may change h s/her g ven name once.

12.5. C t zen may apply to restore h s/her prev ous fam ly name, surname or g ven name.

12.6. State reg strars shall record reg strat on of changes of fam ly names, surnames and g ven
names w th n 7 work ng days after the rece pt of the documents spec f ed n Paragraphs 12.1, 12.2 and 12.5 of
th s Law.

12.7. If a c t zen has reg stered h s/her changed fam ly name or g ven name, the relevant change shall be
made n the nformat on of c v l state reg strat on of a ch ld who has the c t zen’s fam ly name or g ven name.

12.8. Paragraph 12.4 of th s Law shall not apply to tak ng the measures spec f ed n Art cle 7 of the Law
on Protect on of W tnesses and V ct ms[10].

12.9. Fam ly name, surname or g ven name of a suspect, accused, defendant and conv cted shall not be
changed.

Art cle 13. Reg strat on of Death

13.1. Person referred n Paragraph 13.2 of th s Law shall subm t and reg ster a c t zen dent ty card of the
deceased and the follow ng appropr ate documents w th n 3 days n a mag and the cap tal, and 7 days n soum
and d plomat c m ss on:

13.1.1. Med cal descr pt on on the death of a c t zen;

13.1.2. Court dec s on on declar ng a c t zen dead;

13.1.3. Forens c med cal conclus on on the cause of death;

13.1.4. Dec s on of an emergency comm ss on created by the Government f a person has d ed

from d saster.

13.2. The follow ng persons shall reg ster the deceased n reg strat on of death:

13.2.1. Fam ly member over the age of 18 years or parent or relat ve of the deceased;

13.2.2. If the deceased worked, stud ed, rece ved med cal treatment, nursed or was n m l tary
serv ce, deta ned or conv cted n pr son, an adm n strat ve off c al of the relevant organ zat on, and n case of
f nd ng a dead body a competent off c al of forens c med cal author ty;

13.2.3. If a c t zen of Mongol a d es on terr tory of a fore gn country, a c t zen of Mongol a or a

c t zen or legal ent ty of fore gn country.

13.3. When reg ster ng the deceased, the person spec f ed n Paragraph 13.2.1 of th s Law, shall subm t a
c t zen dent ty card, and the off c al and legal ent ty referred n Paragraphs 13.2.2 and 13.2.3 of th s Law shall
subm t a document conf rm ng h s pos t on.

13.4. State reg strars and reg strat on off cers shall record reg strat on of death w th n 1 work ng day after
the rece pt of the documents spec f ed n Paragraph 13.1 of th s Law.

13.5. Death cert f cate shall nclude the follow ng:

13.5.9. State reg strar’s or reg strat on off cer’s s gnature and stamp.

13.6. Death of a fore gn c t zen or stateless person on the terr tory of Mongol a may be reg stered n
accordance w th th s Law.

13.7. Death cert f cate shall be ssued once to the person who reg stered the death.

Art cle 14. Reg strat on of Sex Change

14.1. C t zen over the age of 18 years, who wants to reg ster h s/her sex change n c v l state reg strat on,
shall subm t the follow ng documents and personally reg ster them n state adm n strat ve organ n charge of
state reg strat on:

14.1.1. Appl cat on;

14.1.2. C t zen dent ty card and b rth cert f cate;

14.1.3. Med cal ver f cat on document on the sex change.

14.2. The follow ng appropr ate documents shall be enclosed to the documents referred n Paragraph 14.1
of th s Law:

14.2.1. Dec s on of competent author ty on marr age end;

14.2.2. Parent’s appl cat on n case of change n reg strat on of a surname of ch ld;

14.2.3. Ch ld’s b rth cert f cate and c t zen dent ty card.

14.3. State reg strars shall record reg strat on of sex change w th n 7 work ng days after the
rece pt of the documents spec f ed n Paragraphs 14.1 and 14.2 of th s Law.

Art cle 15. Reg strat on of B ometr c Tra t (f ngerpr nt)

15.1. C t zens of Mongol a, who have reached the age of 16 years and are rece v ng c t zen dent ty cards
for the f rst t me, c t zens of the age of 25 and 45 years who have changed the r c t zen dent ty cards, and
c t zens who have acqu red or restored a c t zensh p of Mongol a by the degree of the Pres dent of Mongol a,
shall be reg stered n reg strat on of b ometr c tra t (f ngerpr nt).

15.2. C t zen of Mongol a, who must be reg stered for the f rst t me n reg strat on of b ometr c tra t
(f ngerpr nt), shall subm t the follow ng documents and be personally reg stered:

15.2.1. B rth cert f cate;

15.2.2. C t zen dent ty card of a parent or trustee.

15.3. The follow ng appropr ate documents shall be enclosed to the documents spec f ed n Paragraph
15.2 of th s Law:

15.3.1. Court dec s on or order of governor of soum or d str ct on the appo ntment of a trustee;

15.3.2. Descr pt on of a ch ldren care nst tut on, where a ch ld l ves;

15.3.3. Court dec s on on determ n ng age of a c t zen who s w thout a document or does not
have a source document n c v l state reg strat on database.

15.4. C t zen, who has acqu red or restored c t zensh p of Mongol a by the degree of the Pres dent of
Mongol a, shall subm t a descr pt on ssued by state adm n strat ve organ n charge of fore gners and c t zensh p
matters and be personally reg stered.

15.5. State reg strars and reg strat on off cers shall record reg strat on of b ometr c tra t (f ngerpr nt)
w th n 1 work ng day after the rece pt of the documents spec f ed n Paragraphs 15.2, 16.3 and 15.4 of th s Law.

15.6. C t zen reg stered n reg strat on of b ometr c tra t (f ngerpr nt) shall be ass gned a c v l reg strat on
number.

Art cle 16. C t zen Ident ty Card

16.1. C t zen of Mongol a aged 16 years and older shall have a c t zen dent ty card.

16.2. C t zen dent ty cards shall be ssued for the f rst t me to c t zens who have reached the age of 16
years, and renewed to c t zens of the age of 25 and 45 years.

16.3. New c t zen dent ty card shall be ssued to a c t zen who has acqu red or restored c t zensh p of
Mongol a by the degree of the Pres dent of Mongol a.

16.4. C t zen dent ty card can be ssued to a c t zen w thout res dence address n c v l state reg strat on
database at h s/her request and at the request of a non-governmental organ zat on nvolved n human tar an
ass stance and human r ghts protect on, and prov ded that the c t zen s reg stered at the address of th s
organ zat on.

16.5. C t zen of Mongol a shall subm t and personally reg ster the follow ng documents w th n 30 days
after he reaches the age of 16 years:

16.5.1. B rth cert f cate;

16.5.2. C t zen dent ty card of a parent or guard an or trustee.

16.6. C t zen of Mongol a shall renew h s/her c t zen dent ty card w th n 30 days after he/she reaches the
age of 25 and 45 years.

16.7. C t zen dent ty card shall be ssued for the f rst t me and for renewal at the age of 25 and 45 years
w th n 5 work ng days n the cap tal, 15 work ng days n soums and 45 work ng days n d plomat c m ss ons.

16.8. In case of re- ssuance, a c t zen dent ty card shall be ssued w th n 3 work ng days n the cap tal, 10
work ng days n soums and 30 work ng days n d plomat c m ss ons.

16.9. State reg strar and reg strat on off cer shall g ve a c t zen dent ty card to the c t zen or h s
author zed representat ve.

16.10. C t zen dent ty card and an ord nary passport of a c t zen of Mongol a, who w thdrew the
c t zensh p of Mongol a, shall be conf scated by a state adm n strat ve organ n charge of fore gners and

c t zensh p matters or d plomat c m ss on and del vered to state adm n strat ve organ n charge of state
reg strat on.

Art cle 17. Nat onal Passport and Its Subst tute Document

17.1. Nat onal passport and ts subst tute document shall become the document to cert fy the c t zensh p
of Mongol a n fore gn country.

17.2. Nat onal passport shall have d plomat c, off c al and ord nary types.

17.3. Val d ty per od of d plomat c and off c al passports shall be 5 years, and the val d ty per od of
ord nary passport shall be 10 years. Ord nary passport shall be ssued to ch ldren under the age of 16 years for 5
years.

17.4. Templates of nat onal passport and travel document to Mongol a as well as the procedure on
ssu ng, possess ng and keep ng nat onal passports shall be approved by the Government.

17.5. The follow ng author t es shall ssue nat onal passports and the r subst tute documents:

17.5.1. D plomat c and off c al passports by a state adm n strat ve organ n charge of fore gn
affa rs;

17.5.2. Ord nary passports by a state reg strat on author ty and d plomat c m ss on;

17.5.3. Travel documents to Mongol a by a d plomat c m ss on;

17.5.4. Border cross ng documents by a local state reg strat on body.

17.6. For obta n ng an ord nary passport, travel document to Mongol a or border cross ng
document, a c t zen of Mongol a shall subm t and personally reg ster the follow ng documents:

17.6.1. C t zen dent ty card;

17.6.2. If under the age of 16 years, a b rth cert f cate and h s legal representat ve’s c t zen
dent ty card or dec s on on appo ntment of guard an or trustee.

17.7. State reg strar and reg strat on off cer shall record reg strat on and g ve a nat onal passport and ts
subst tute document to a c t zen or h s author zed representat ve w th n 5 work ng days n the cap tal, 15 work ng
days n soums and 30 work ng days n d plomat c m ss ons after the rece pt of the documents spec f ed n
Paragraph 17.5 of th s Law.

17.8. D plomat c m ss on shall dec de the request to obta n a travel document to Mongol a w th n 7
work ng days.

17.9. Issuance of an ord nary passport and border cross ng document may be temporary suspended on the
bas s of the prov s ons of Subparagraph 5 of Paragraph 1 of Art cle 5 of the Imm grat on Law.

Art cle 18. Reg strat on of C t zen’s Res dence Address

18.1. When a c t zen moves to an address other than that reg stered n c v l state reg strat on database,
“permanent res dence” refers to reg strat on of a res dence for more than 180 days and “temporary res dence”
refers to reg strat on of a res dence for less than 180 days.

18.2. Address of c t zen’s res dence for more than 180 days shall be reg stered n c v l state reg strat on
database n accordance w th Paragraph 19.1 of th s Law.

18.3. Names of a mag, cap tal c ty, soum and d str ct, names and numbers of bag and khoroo, names of
sub-d str ct and street, numbers of apartment and door, as well as geograph cal name (name of a place or a r ver)
shall be recorded n address reg strat on n c v l state reg strat on database.

18.4. Reg strat on of a res dence address of ch ldren under 16 years shall be determ ned by the res dence
address of the r parent or guard an or trustee.

Art cle 19. Reg strat on of M grat on

19.1. When m grat ng, a c t zen shall subm t and personally reg ster the follow ng documents w th state
reg strar of h s/her new res dence (soum and khoroo) w th n 10 days:

19.1.1. C t zen dent ty card;

19.1.2. Ch ld's b rth cert f cate, f a c t zen w th ch ld under the age of 16 years s res d ng;

19.1.3. Ver f cat on document on a res dence address;

19.1.4. Other documents spec f ed n laws.

19.2. State reg strars shall record reg strat on of m grat on w th n 3 work ng days after the rece pt of the
documents spec f ed n Paragraph 19.1 of th s Law.

19.3. Unless otherw se prov ded by laws, suspens on of reg strat on of m grat on shall be proh b ted.

19.4. If a c t zen’s ownersh p r ghts to mmovable property and land at h s/her res dence place exp red
and a such change s not reg stered n h s/her address reg strat on n c v l state reg strat on database, the
reg strat on of h s/her res dence address may be suspended on the bas s of assessment of a state superv s on
nspector at the request of the c t zen concerned.

19.5. Procedure on reg strat on and not f cat on of c t zens’ m grat on on the terr tory of Mongol a shall
be approved by the Government.

Art cle 20. Reg strat on of Acqu s t on, Cessat on and Restorat on of C t zensh p of Mongol a

20.1. State adm n strat ve organ n charge of fore gners and c t zensh p matters shall ma nta n the
reg strat on of acqu s t on, cessat on and restorat on of c t zensh p of Mongol a.

20.2. The organ spec f ed n Paragraph 20.1 of th s Law shall not fy n wr tten a state adm n strat ve
organ n charge of state reg strat on w th n 5 days from the date of reg strat on of acqu s t on, cessat on and
restorat on of c t zensh p of Mongol a.

20.3. State adm n strat ve organ n charge of state reg strat on shall record reg strat on of acqu s t on,
cessat on and restorat on of c t zensh p of Mongol a w th n 3 days after the rece pt of the degree of the Pres dent
of Mongol a.

CHAPTER THREE

AMENDMENTS TO INFORMATION OF CIVIL STATE REGISTRATION

Art cle 21. Amend ng Informat on of C v l State Reg strat on

21.1. State reg strar may amend nformat on of c v l state reg strat on n accordance w th th s Law on the
bas s of a court dec s on or an assessment of state superv s on nspector.

21.2. In case the relevant nformat on s not reg stered n c v l state reg strat on database, state reg strar
shall record the nformat on n state reg strat on database on the bas s of source documents of c v l state
reg strat on.

21.3. In the absence of c t zen's relevant nformat on and source documents n c v l state reg strat on
database, state reg strar may record c v l state reg strat on on the bas s of an assessment of state superv s on
nspector based on c t zen's other documents.

21.4. If an assessment of state superv s on nspector cannot be ssued n accordance w th Paragraph 21.3
of th s Law, a c t zen shall apply to the court w th a cla m to determ ne the event of legal s gn f cance.

Art cle 22. Re nstat ng C v l State Reg strat on

22.1. State reg strar shall re nstate a c v l state reg strat on on the bas s of a decree of the Pres dent of
Mongol a or court dec s on or assessment of state superv s on nspector.

Art cle 23. Inval dat ng C v l State Reg strat on

23.1. If a c v l state reg strat on s nval dated, state reg strar shall reg ster t on the bas s of a court
dec s on or assessment of state superv s on nspector.

23.2. State reg strar shall nval date the c t zen’s reg strat on number or c v l state reg strat on of the same
type that was reg stered 2 or more t mes, on the bas s of an assessment of state superv s on nspector.

23.3. Paragraph 23.2 of th s Law shall not apply to reg strat on of ord nary passport.

Art cle 24. Re- ssu ng Documents of C v l State Reg strat on

24.1. State reg strar and reg strat on off cer shall re- ssue documents of c v l state reg strat on on the
bas s of a personal appl cat on of c t zen, and documents of a ch ld under the age of 18 years on the bas s of an
appl cat on of h s/her parent, guard an, trustee or representat ve of ch ld foster nst tut on n the follow ng cases:

24.1.1. Document cannot be the legal document due to ts loss, damage or exp rat on, and there s
no space for remarks on ord nary passport’s pages;

24.1.2. C v l state reg strat on s amended or re nstated;

24.1.3. Court dec s on s taken n accordance w th Art cle 150 of the C v l Procedure Code[11].

24.2. Ch ld’s b rth cert f cate shall not be re- ssued to a c t zen whose parental r ght was excluded by
court dec s on, and a marr age cert f cate shall not be re- ssued to a c t zen whose marr age s d vorced or
cons dered as vo d by court.

24.3. Unless otherw se prov ded by laws, t s proh b ted to make changes to the n t al nformat on when
re- ssu ng a b rth cert f cate.

CHAPTER FOUR

CIVIL STATE REGISTRATION DATABASE

Art cle 25. C v l State Reg strat on Database

25.1. It s proh b ted to delete, mod fy, transfer, m suse or reproduce nformat on from the c v l state
reg strat on database, unless otherw se prov ded by laws.

Art cle 26. Arch ve of Source Documents of C v l State Reg strat on

26.1. Bas c documents of the arch ve of source documents of c v l state reg strat on shall conta n the
source documents of reg strat on of b rth, marr age, marr age end, marr age rest tut on, patern ty determ nat on,
adopt on, changes of fam ly name, surname and name, b ometr c tra t (f ngerpr nt), sex change, c t zen dent ty
card, nat onal passport and ts subst tute document, acqu s t on, cessat on and restorat on of c t zensh p of
Mongol a, m grat on and death, as well as the c v l state reg strat on forms, the reg strat on number book and the
c v l state reg strat on record.

26.2. One copy of a source document of c v l state reg strat on shall be reta ned n the c v l documents’
arch ves of state adm n strat ve organ n charge of state reg strat on and ts second copy shall be stored n the
c v l document’ arch ves of local state reg strat on bod es.

26.3. Relat ons concern ng preservat on, protect on, replen shment and ut l zat on of the arch val
documents spec f ed n Paragraph 26.1 of th s Law shall be regulated by the Law on Arch ves[12].

CHAPTER FIVE

REGISTRATION OF POPULATION, HOUSEHOLD AND VOTERS

Art cle 27. Reg strat on of Populat on and Households

27.1. Governors of bags and khoroos shall ma nta n reg strat on of populat on, households and c t zens’
temporary res dences n accordance w th Paragraph 1 of Art cle 21 of the Law on Stat st cs[13].

27.2. Governors of bags and khoroos shall exchange nformat on on the reg strat ons spec f ed n
Paragraph 27.1 of th s Law w th state reg strat on author ty.

Art cle 28. Reg strat on of Voters

28.1. Reg strat on of voters shall be ma nta ned by state adm n strat ve organ n charge of state
reg strat on on the bas s of c v l state reg strat on electron c database.

28.2. Person who has reg stered n reg strat on of b ometr c tra t (f ngerpr nt) n accordance w th Art cle
15 of th s Law and reached the age of 18 years shall be reg stered n reg strat on of voters.

CHAPTER SIX

MISCELLANEOUS

Art cle 29. L ab l t es for V olat ng the Law

29.1. If an act by an off c al n breach of th s Law s not a cr m nal n nature, l ab l t es spec f ed n the
Law on C v l Serv ce[14] shall be mposed.

29.2. A person or legal ent ty that v olates th s Law shall be subject to l ab l t es under the Cr m nal
code[15] or the Law on v olat on[16].

Art cle 30. Effect ve Date of the Law

30.1. Th s Law shall come nto force on the effect ve date of the General Law on State
Reg strat on /Rev sed Ed t on/.
