Australia's federal anti-discrimination laws are contained in the following legislation:

Who administers this act and what do they do in relation to enforcing Commonwealth workplace law?

The Fair Work Act is one of the key Commonwealth statutes governing the employment of mature age
workers. It provides for terms and conditions of employment and sets out the rights and responsibilities of
employees, employers and employee organisations in relation to that employment.

The Fair Work Act regulates ‘national system’ employers and employees. Employment that is not covered
under the national industrial relations system remains regulated by the relevant state industrial relations
systems. However, some entitlements under the Fair Work Act extend to non-national system employees. The
Act also creates a compliance and enforcement regime and establishes several bodies to administer the Act,
including Fair Work Australia (FWA) and the FWO.

In New South Wales, certain types of discrimination are against the law in specific areas of public life. Sexual

Discrimination is a violation of human rights, all people have the right to exercise their profession with dignity and
to seek opportunities that help perfect their talents regardless of age, sex or gender.

f. Consider the following scenario: Helen had been working as a registrar in a school for many years and applied
to undertake internal training in new information services being developed by the department. Her application
was denied because management thought she was too old to learn about the new software being implemented.

 Has Helen’s employer acted ethically? Justify your response.

No, Helen´s employer is violating her rights as an employee and as a human being, she is forbidding
her to do something that will benefit her and that will help the company in the future

 How do you think the federal and state authorities will advise Helen in order to resolve the situation?

State authorities will agree with Helen. They will also help her to report the case so that these same
authorities contribute to fulfilling her rights.
