 CHANGE NO 2. INSPECTOR CUM FACILITOR - The ‘inspector’ under the previous
regime has been replaced with an ‘Inspector-cum-Facilitator’, who has additional duties
of guiding and advising employers and employees on effective implementation.
Inspections are now possible through a web-based inspection scheme and electronic
summoning of information, which may ease compliance burdens, and be in sync with
current trends towards digitalization.
ANALYSIS OF THIS CHANGE- This change attracts criticism to it because Now
the ‘inspector cum facilitator’ has to advice both employers and workers – he/she is not
supposed to check violations alone. In fact, a detailed system of inspection procedure is
laid out which specifies that a “web-based inspection” system may also be put in place.
The govt. will decide which locations need to be inspected, on a “randomized” basis.
This will lead to arbitrariness in decision making
