My store’s name on Amazon is JULY MEROLLIs
- Thank you for giving me another chance to file a complaint about a Misuse of
Intellectual Property Rights
- I apologize and take full responsibility for non-compliance with Amazon's
policies. I have been posting and selling suspected intellectual property misuse
products and I have not made a specific plan to resolve these issues.
- Especially, I sold graphically designed face masks which are completely made
by all of my staff.
Everyone came up with the idea and designed it.
- Because new designers and ideas based on existing designs, so inadvertently
they used other brand's design images and logos. Specifically, in the product
description title, we have violated some major brands like "Supreme". This is a
very silly mistake because my employees are not yet familiar with using of
famous fashion brands in product descriptions, so we inadvertently violated
Amazon’s policies. It is also my fault for not training carefully my employees to
correctly design and describe my products in detail. This will make Amazon’s
customers distrustful while purchasing goods.
I understand that listing product whose titles contain violated words,
trademarks, or logos is a serious infringement of intellectual property rights.
Hence, I am aware of my violation and below is my detailed explanation plan.
Please consider this carefully!

A) Possible cause of the infringement: My shop has listed some products


violating Intellectual Property Rights.
The following infringing ASINS scanned by Amazon's system have been
removed immediately and permanently from our Inventory include:

- ASIN: B08HN4QBHB, B08G4CR75N, B08HN4T7RH, B08G4MQLNC,


B08HN59T9M, B08HN4RTYN, B08HN67GGZ

B) What we have done to resolve the Violation issues.


1. I immediately removed all infringing lists from the inventory details page.
2. Read, view the report, and find out the root cause of the breached Asins. I
have retrieved all of my inventory listings to investigate other similar violations.
I proceeded to remove it from my inventory and made sure no similar violations
would occur.
3. I have spent several days thoroughly educating myself and our team about
Amazon policies to avoid these breaches in the future. I learned more about
Seller Prohibited Activities and Actions, Product Detail Page Rules, US
Intellectual Property, and Trademark Rights.
4. I have worked to guide my staff to comply with these policies. We held a lot
of discussions to point out a violation in each design, find the cause, and outline
the direction in the future to avoid similar problems.
5. We have studied the concept of pirating equipment very carefully. We have
built a team to conceptualize our unique designs and brainchildren. We
undertake that all future design and product descriptions of our products are our
intellectual property and do not infringe any proprietary rights of any other
person or entity. All my designs will be registered for DMCA for copyright
protection in the near future
6. All descriptions on the product detail page are thoroughly checked by us so
as not to bring suspicion, confusion or confusion to customers when shopping
on Amazon.

C) What we did to prevent future violations:


1. The actions I have taken in step B will prevent any problems from occurring
in the future.
2. Never list and sell products using someone's or the company's trademark
without the permission of law.
3. List only items for which we are legally authorized / authorized
authorized distributor / manufacturer (with appropriate invoice as proof). We
guarantee that no one can file an infringement lawsuit against us.
4. Double-check the product details page (including: image, title, bullet point,
product description, ...) before listing any product on Amazon. We guarantee
that WE DO NOT create a pirated list or detail page again.
5. We won't list Amazon bulk products without checking if I have permission to
sell them.
6. Since we cleaned up the inventory, stopped selling every week to train our
team. We guarantee that we fully understand amazon policy and US trademark
rights. We promise that violations of this policy won't happen again.
7. We continue to monitor all items and highlight our new QA steps to ensure
all items We sell are subject to the copyright policy.
8. Any suspicions remain regarding infringing items, we have created a policy
of consulting with the Amazon Seller Performance Team before listing
products. I do NOT list, or sell any item for which we cannot determine
authenticity.

9. I will only list and sell items that I buy directly from
manufacturers, authorized agents or I produce. This will prevent any claims of
piracy.
10. If I want to sell a product under a brand name other than the name of an
existing ASIN, I will not change the existing ASIN. I'll create a new ASIN for
that trademarked product instead using Bulk Upload File.
11. When I list products for sale using the existing product detail page and
ASIN, I will ensure that the supplied product accurately describes the product
and matches the existing data in that ASIN including EAN or UPC barcode,
product title, brand, manufacturer, part number. I won't list an ASIN that doesn't
match my item description, the status without a health and safety label.
12. I list all major brand names, brands, logos and proper nouns that violate
"Trade Mark" as a set of infringing keywords. All such infringing terms will
never appear in the inventory details page.

About us:
- I have removed all list of infringing products from my inventory
- I have carefully reviewed the notice received from the Vendor Performance
Team and learned from my experience and mistakes.
- I have checked and evaluated all violations, received warnings and possible
violations. We remove it before it poses a potential risk of a violation warning
- I have read the Amazons Seller's Prohibited Actions and Activities policy

the policy and will have an immediate impact on our business.

In addition to the three very important policies I have read and complete
understand, I have also read the Amazon policies and agreements (

to the policies.
- It is my responsibility to ensure that I follow all of these and future policies in
order to maintain my privilege of selling on Amazon.
- I assure you that I have resolved all the problems caused
account suspended
- All the violated Asins have never existed for more than 24 hours when they
are listed. That is the confusion and my role in not really training my staff well.

While waiting for you to review and recover my account, I still take care of my
clients, reply to client messages within 24 hours, handle all return issues and
other necessary actions to keep my account in good working order. I've also
removed all listings from my inventory, I'll start over to ensure compliance with
Amazon's policies when listing a new product in the future. I hope Amazon will
consider my attempt to regain the right to sell on Amazon and give me another
chance.

I really enjoy selling on Amazon and this opportunity helps me support my


family. I still have a lot to learn and will continue to get better as a Top Rated
Seller on your platform, which is why I would love to get another chance. I
have tried my best to write this detailed POA so I really hope you can
understand and give me - the seller from Vietnam the chance to continue doing
business with Amazon. We realized we were on the wrong track and looked
forward to recovering our accounts soon to start building our business again on
Amazon.
Once again I urge the Amazon performance team to review my plan of action
soon and restore my merchant account soon. This is my job and life and many
other people I work with. It's all mine.
