AGREEMENT FOR LAW ENFORCEMENT SERVICES BETWEEN THE ST. CLAIR COUNTY SHERIFF AND ‘THE CHARTER TOWNSHIP OF FORT GRATIOT THIS AGREEMENT made and entered into this day of 2020 by and between the COUNTY OF ST. CLAIR through its Board of Commissioners end the Shes ofthe County, hereinafter refered to as the “COUNTY” and the CHARTER TOWNSHIP OF FORT GRATIOT, hereinafter referred to as the “TOWNSHIP”, WHEREAS, the County does provide police protection to its residents, ad provides fr the enforcement of Sate and local laws, regulations and ordinances generally under the direction of the St Clair County Shevf's Department, and WHEREAS, the Tovmship desires 19 provide to its residents specific pole protection in addition to that generally provided by the County without thereby creating» Township police deparment, and WHEREAS, the County is agreeable to rendering such services on the terms and conditions as hereinafter set forth: NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: 1. The County will provide police protection forthe purpose of enforcement of al State las end local ‘Township criminal, civil and traffic ordinances within and forthe Township. 2. ‘The law enforcement services tobe proved by the County shell const of Furnishing one regular patrol car manned by a certified deputy fora 24 hour shift, seven days per week ffom January 1, 2021 through December 31,2023 “The County shall provide one adeitional regular patrol car manned by a ceriied deputy committed exchsive to police protection fr twelve (12) hours day seven days a week The specific hours and working days sal! be as provided in Exhibit “A” ofthis agreement. Further, the financial breakdown and any supplemental law enforcement service to be provided requiring additional time, personnel or ‘equipment, shall be specified in Exhibit "ofthis Agreement 3, ‘The Administration, assignment, discipline, and enforcement of performance standards ofthe assigned deputies shall be the sole responsibilty of the County. ‘The County is responsible for the payment of salaries, taxes, benefits, insurance premiums and other expenses related to the employees providing this service and will indemnity the Township harmless from such claims 4, The County will maintain and provide all equipment such as, but not Limited to, patrol cars, ammunition, communication facilities and dispatching services which are necessary to the providing ofthe service withthe exception of stationary such as notices, appearance tickets, or traffic ordinances. 5. The contro, standard of performance, and discipline of those personnel assigned to provide those services set forth herein shall be the sole responsibility ofthe St. Clait County Sheriff. 6. Scheduling of specific hours of patrol shal be determined by the sheriff, with the advice and consent of the designated Township official 7. The County shall indemnify the Township harmless from all claims, demands, payments, and suits by reason of any acts or omissions of the County, its agents or employees, their performance af those services herein provided 8 The Township shall have th right of inspection of ll ime records, pal logs, accountng records ofthe Sheriff's Department related tothe providing of services herein, Incident and investigetion reports shall be available tothe cntent that disclosure of same would not: i. Interfere with aw enforcement proceedings fi, Deprive a person ofthe right toa fair trial or impartial administration adjudicati Constitute an unwarranted invasion of personal property Disclose the identity of a confidential source, or if the record is compiled by a criminal investigation, disclose confidential information furnished only by a confidential source. ¥. Disclose law enforcement investigative techniques or procedures. vi. Endanger the life or physical safety of law enforcement personnel 9. The County wil famish the Tovnship with weekly time sheets and patrol fog sheets for those hours spent by its certfed deputy on carrying ou the terms ofthis agreement. Soid time sheets end pat! log sheets shall be calculated in inerements of (25) hours 10, ‘The term of this agreement shall be fom January 1, 2021 through Desemnber 31,2023, ‘The Township is solely responsible for and agrees to pay $965,394 for such law enforcement service, beginning January 1, 2021 through December 31, 2021 to be paid in equal monthly installments of $80,449.50. ‘The Township is solely responsible for and agrees to pay $988,661 for such law enforcement service, beginning January 1, 2022 through December 31, 2022 to be paid in equal monthly installments of $82,388.43. ‘The Township is solely responsible for and agrees to pay $1,013,078 for such Law enforcement service, beginning Jennary 1, 2023 through December 31, 2023 to be paid in equal monthly installments of $84,423.20. Payments of each monthly installment shall be made on or before the last day of the month in which the service is provided, The St. Clair County Controller will provide information to Townships as reasonably requested to substantiate the cost factors in determining the aforestated amounts. 11, ‘The Townships shall have the right to renew the contract atthe end ofits term provided that: i. The Township expressed their intent ro renew in wring thirty days prio othe expiration of this agreement, Said notice is to be sent tothe St. Clair County Sheriff and the St. Clair County Board of Commissioners ‘The County is agreesble to renewal Rates forthe new agreement ean be agreed upon bene the parties 12. At the conclusion of the contract, the three (3) vehicles purchased through the contract will transfer ownership to the Township. The Township may opt to take a per vehicle credit on a futue invoice if they are not interested in obtaining ownership of the used vehicles. The credit amount will be the fair market value of the vehicle sold at the County's latest auction, 13, Either party may terminate this agreement with a 60-day written notice 14, Any controversy or claim arising out of or relating to this contract, orthe breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the awatd rendered by the Arbitrator(s) may be entered in any court having jurisdiction thereof, 15. This Agreement shall constitute the entire agreement between the parties superseding all other communications, writen or oral, between the partes relating to the subject matter of this agreement and it may be added or ‘modified only in writing signed by the parties.
