registered on September 26 1995 (Application April 15, 1994) inthe USA,
and was first used inthe USA since April 151995, and has been openly and
continuously in use since then.
‘The Company's HY-D mark is internationally well-known and has been
registered worldwide, as evidenced by the summary hereto attached as
‘Annex “A” and made an integral part hereof, showing alist ofthe countries,
territories and jurisdictions where the Company's HY-D mark is registred,
or where epplications to register the same have been filed and are pending.

42. The HY-D mark is protected in 47 jurisdictions worldwide,
including: USA, China and the counties of the European Union

43° Given the foregoing, it i undeniable that the HY-D mark is
internationally well-known based on the itera set out in Rule 102
‘of the Philippine Rules and Regulations on Trademarks which
provides that:

the Company in various counties, i is undeniable thatthe Company has

Doe tothe promotion and marketing strategies ofthe Company, the sles of
‘the HY-D products inthe Philippines forthe past 10 years have amounted
to over PhP 60SM. Attached at Annex “E® are products bearing the HY-
mark being sold in the Philippines. Attached as Annex "Fare samples
of invoices concerning sales of products bearing the HY-D mark in the
Philippines over the past 5 years.
Products bearing the Company's HY-D marks have been widely sold in the
Philippines since 2008 up to the present through it distributors and by
independent local retailers. In fact, the Applicant EQUALIVET, INC. was
a former distributor of the HY-D products from 2015 until 2018 which
necessarily acquainted the Applicant of the existence of the Company's
well-known HY-D marks, The Company was surprised to have learned that
the Applicant went on to file an aplication forthe registration ofthe mark
