1.What is Forensic Medicine?

>.Forensic medicine, the science that deals with the application of medical knowledge to legal

question.

recognized as a speciality early in the 19th century.

The primary tool of forensic medicine has always been the autopsy.frequently of the dead

autopsies may also be conducted to determine the caused of death.in cases of death caused by

a weapon,for example, the forensic pathologist- by examining the wound-can often provide

detailed information about the type of weapon used as well as important contextual

information. (In a death of gunshot, for example, he can determine with reasonable accuracy

and angle of fire)Forensic medicine is the major factorin identification of victims of disaster, such as
landslide or plane crash. In cause-of-death determinations, forensic pathologists can also significantly
affect the outcome of trials dealing with insurance and inheritance.

2. What is medical jurisprudence?

>.Medical jurisprudence: The branch of law that deals with the application of law to medicine or,
conversely, the applicaton of medical science to legal problems. Medical jurisprudence may involve in
cases concerning genetic relationships (eg, paternity testing) or injury or death esulting for violence . An
autopsy may be done to help determine the agent of death (eg, a gun shot poison) and how long the
person has been dead . Forensic medicine is also important in cases involving rape. Modern
techniques use such specimens as semen, blood, and hair to identify the body of a victim and to
compare the DNA of the criminal to that of the defandant through DNA fingerprinting.

3. What is Forensic Pathology?

>.Forensic Pathology is that focuses on determining the cause of death by examining the corpse. A post
mortem performed by a medical examiner, usually during the investigation of criminal law cases and
civil law cases in some jurisdictions. Coroners and medical examiners are also frequently also to confirm

4. What do you mean by Medicolegal case? Give some examples.

medical advice.

A Medicolegal case can be defined as a case injury or ailment, etc., in which investigations by the law
enforcing agencies are essential to fix the responsibility regarding the causation of the injury or ailment.
In simple language, it is a medical case with legal implication for the attending doctor where the
attending doctor, after eliciting history and examining the patient, thinksthat some investigations by law
enforcement agencies is essential. Or a leagl case requiring medical expertise when brought by the
police for examination.

In any of the medico-legal cases , it is the legal duty of treating doctor to report it to nearest police
station immediatly after completing primary lifesaving medical care. Thisis in accordancce with section
39 of criminal procedure code of india. The idea is to initiate the legal proceeding at the earliast so that
the maximum evidence can be collected by police officer. Quick action by the police also helps to avoid
the destruction of evidence by the treating physician.

The following cases should be considerd as medico-legal and as such the medical officer is "duty-bound"
to intimate to the police regarding such cases:

. All cases of injuries or burns- the cicumstances of which suggest commision of an offense by
somebody. (irrespective of suspicion of foul play)

. All vehicular, factory or other unnatural accident cases specially Kannada actress Sharmiela Mendre
who was in car accident on saturday morning, was immediatly admitted to a nearby hospital. On
suspicions of the actress and her friend bieng under the influence ohf alcohol, a medico-legal case was
registered and sent to the high ground traffic police. The police have already filed the suo motto case
against sharmiela mandre .

Meanwhile, as per latest reports, the actress who was undergoing treatment at hospital near
Vasanthnagar, was shifted to another to another hospital in Banglore on her family doctor's advice but
against medical advvice of the doctors treating her at the previous hospital.

Sharmiela Mandre who stepped out in her car3 am along with a friend met with an accident in the
Vasanthnagar area in Banglore and was immediatly rushed to nearby hospitl. The actress was
undergoing treatment there but her family shifted her to another hospital against medical advice. The
police were not informed about this and so when they reached the first hospital for taking Sharmiela's
statement, they were taken aback.

According to the sources , Sharmiela Mandre report to doctor that she will be taking treatment from a
family doctor, before taking Discharging Against Medical Advice from the first hospital. As per the
reports, a case under section 279, 337 IPC has been reportedly registered as well for violence of the
lockdown order. Meanwhile, the vehicle has been siezed by the cops.
