Republic of the Philippi GGUNIANG PANLUNGSOD AE ea ORDINANCE NO_475, S-2011 ‘ANI ORDINANCE ADOPTING THE NEW ZONING REGULATIONS ‘OF MANDALUYONG CITY FOR THE YEAR 2011 WHEREAS, the City Government of Mandaluyong continues to formulate stratogic developmental poiices in its pursuit for excellence in governance and in pursuant to ‘Sections 16 General Welfare and Section 17 asic Services and Facilities of Republic Act No. 7160 otherwise known as the Local Government Code of 1991; WHEREAS, Ordinance No. 164, S-1997, establshed the areas bounded by EDSA, ‘Shaw Blvd, the Mandaluyong-Pasig Eoundary and the Pasig River as the Mandaluyong Central Business Dstrict; WHEREAS, Ordinance No. 238, $2000, established the zoning rues and regulations for the ity based on the Approved City Comprehensive Development Plan 25 ‘per Resolution lo. 485, S~1996, WHEREAS, Ordinance No, 244, S-2001, preserbed rates of filing and processing ‘ees for zoning clearances in the city of Mandaluyong based on development trends deemed curtent for that year and which, ten years after, are no longer reflective of the fast-paced and innovative trends in development today, WHEREAS, Ordinance No. 356, $2005, adopted an Integrated Zoning Regulations forthe City t feciltate eross-referencing between and among the approved zoring ordinances; WHEREAS, Ordinance No. 448, $-2010 atopted new setback reguations and parking requirements in consideration of difficulties encountered in the imposition of ‘Such regulations and requirements prescrived inthe earlier ordinances and withthe view of utizing space in its highest value; WHEREAS, to become resiient to disasters and the consequences of climate change, disaster risk reéuction and management must be of prime consideration in determining land use policies and allocation, what with the present trends in development vvis-2-vis the socio-economic characteristics of lacal population; NOW, THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of ‘Mandaluyong, in session assembled: ARTICLE | TWTLE OF THE ORDINANCE SECTION 1. TITLE OF THE ORDINANCE. This Ordinance shall be known as the New Zoning Ordinance of the Cty of Mandaluyong and hall be referred to as the Ordinance (rdirance No. 475, 2011 Page 2 SECTION 2 SECTION 3. SECTION 4, ARTICLE 11 AUTHORITY AND PURPOSE AUTHORITY. This Ordinance is enacted pursuant to the provision ‘of the Local Government Code of 1991 (Republic Act 7160) Section $58 (2) (2) (0) and (a) 2) 00, “authorizing the City through the Sangguniang Panlungsod to adopt a Zoning Ordinance subject to tho provisions of ‘existing ws" PURPOSES, This Ordinance is enacted for the fllowing purposes: ‘A. Guide, control and regulate future growth and development of the City of Mandaluyong in accordance with its Comprehensive Develooment Pian B. Protect the character and stabilty of residental, commercial, Institutional, open space and other functional areas within the locality and promote the orderly and beneficial development ofthe €. Promote and protect the health, salety, peace, comiort, converience and general welfare of the inhabitants inthe locality 1, Promote and ensure the sustainable growth of the city as a premier commercial, business, financial and residential center of Metro Manila GENERAL ZONING PRINCIPLE. These Zoning Regulations are based on the following: ‘A. Mandaluyong City Metium-Torm Dovelopmont Plan 2010-2015 adopted through Sanggunian Resolution No. 1563, $-2000 Mandaiuyong Annual Investment Program 2011 Mandaluyong Annual Investment Program 2010 Priority Development Programs and Projects 2009, 2010, 2011 Central Business District Master Plan Approved Comprehensive Development Plan (COP) as per Resolution No. 485, S=1996 dated February 19, 1998 for the City of Mandaluyong, ARTICLE Ill DEFINITION OF TERMS AND PHRASES "moses ‘The definition of the technical terms used in the Zoning Ordirance shall carry the ‘same meaning given to them in already approved codes and regulations, such as but not limites to the National Building Code, Water Code, Phiippine Environmental Code and Other implementing Rules and Regulations promulgated by the Housing and Land Use Regulstoy Board. A use customarily inciental and subordinate to the principal use of the building and located on the same lat with such principal use ofthe building BARANGAY. The remaining space in a lot after deducting the required minimum open spaces. BUILDING ACCESSORY. A bulling erected prior to the adoption of this ‘Ordinance oF one for which a legal building permit has been issued. BUSINESS. Uses or land tivities capable ot existing together harmoniously e.. residential use and parks and playground, COMPREHENSIVE DEVELOPMENT PLAN. A document emtodying speciic proposals for guiding, regulating growth and/or development. The main roquiroments of tho Comprohensive Dovalopment Plan inthis usage aro ho sectoral studios ie. Socio-Economic, Infrastructure, Lecal Administration and Land Use CONDOMINIUM BUILDING. A mult-rise structure usually used tor ‘commercial or residential purpose and generally owned by the occupants thereof CONFLICTING USES. Uses or land actives with contrasting characteristics sited next to each other e.g residential unit next to industrial pants. CONFORMING USE. A use that is in conformity with the zone classification 4 provided for inthe Ordinance. DOMINANT LAND USE. Land use which accounts for at least 70% of the area within 1,000 meter radius trom the periphery of the lot being applied ‘or. DORMITORIES. An insttutonal building where boarders are provided with board and lodging, sleeping and eating in commen halls ard consisting of at least ten (10) or more persons DWELLING, A building designed or used exclucively as living quarters for ine or more families, DWELLING, SINGLE DETACHED. A dweling unit having two side yards, WELLING, SEMI-DETACHED. A dwoling unit having one party wall and one side yard DWELLING, MULTIPLE. A building used as a home or residence of three (8) or more families ving Independently from one another each occupying ‘one or more rooms as a single housekeeping unit. DWELLING, ROW OR GROUP. A building consisting of a series of one ‘amily sections having a common wal between each two adjeent sections. WELLING, TWO-FAMILY. A house or structure divded into two separate and independent living quarts by 2 wall extending from the floor to the ceiling, Each portion provides complete fvng facilties fora household, EASEMENT. Open space imposed on any land use/activites sited along ‘waterways, road-right-of-ways, cemeteriesimemorial parks and utites. ENVIRONMENTALLY CRITICAL AREAS. Refers to those projects which have high potental for negative environmental impacts and are listed in Presidential Proclamation 2146 dated December 14, 1981 EXGEPTION, A device which grants a property owner relief from certain provisions of a Zoning Ordinance subject to the terms and conditions set forth in the Ordinance. FAMILY, EXTENDED-FAMILY. A social unit consisting of parents, their children and their chikren's families, iving together in te same house. FAMILY, SINGLE-FAMILY. A social unit consisting of parents and the children that they rar. FLOOR AREA RATIO. The ratio between the gross foor area of a building ‘and me area ofthe lot on which it stands. GARAGE, COMMERCIAL A garage where automobile and other vehicies are housed, cared for. equipped. repaired or kept for remuneration. he or sale, ‘other than service permitted at an automobile siation defined herein. GARMENT FACTORY. A factory producing garment of cloth or plastic such as ready-made dresses, hats, shits, under clothes, children’s clothes, rain ‘coats, ete. of commercial quantity. GOVERNMENT INFRASTRUCTURE. Physical projets by the government in ‘support of socio-economic development such as road networks including ‘widening, reopening and recovery, bridges, structures for education, health, ‘welfare, police and fire protection, recreation, housing, rainage and ‘sewerage, water impoundments, iver bank ‘stabilization and similar Structures. for the protection of the environment and reduction of ‘vulnerability to disasters and calamities. Shall mean the Housing and Land Use Regulatory Board. HOME OCCUPATION. Occupation conducted within a dweling and not in any accessory building provided no person who is not a resident in the premises is employed, no mechanical equipment is used, except such as is permissible for purely domestic or household purposes; does not require Internal or external alteration, or involve constuction features or use of equipment not customary in dwellings. HOMETEL. Any establishment offering room and board usually for tourists and transients on a daly or monthly basis. HORTICULTURAL NURSERY. A large tract of public land for the purpose of ‘cutivating and raising cooperative specimen and exotc trees, shrubs and plants, whether native or foreign, for sale to the puble, or for the use of street plantings and landscaping of public plazas, parks and the ike INNOVATIVE DESIGN. Introduction and/or application of new/eeative designs and techniques in development projects, e.g, Newiown, URAS, ec. INSTITUTIONAL ZONES. Characterized by Government and protective uses as wall 28 institutional and social services ‘or the entire community and shall, be characterized further by speciaized governmental agencies ‘roviding institutional, protective, security ané social services forthe region or the country as @ whole, and which are governed by speciaized ‘regulators, including mental hosptals, rehabilitation and training centers and security services. A neighborhood or community level of commercial use or occupancy, characterized mainly as a low-rise bbulding/structure for low intensity commerciaVArade, service and business activites, eg. 1 tD 5 slorey shopping centers, small offices or mixed ‘use/orcupancy bultfings and the tke LOW DENSITY RESIDENTIAL ZONE (At). Characterized mainly by single family, single detached dwelings with the usual community ancilary uses ‘on a neighborhood scale, such 25 executive subdivisions and retativey ‘exclusive residential communities which are not subdivisions. MEDIUM DENSITY COMMERCIAL ZONE (C-2). A city level of commercial use or o¢cupancy, chracterized mainly as a medium—rise bulding/structure for _medum to high intensity commerciatrade, service ané business activities @.9 3 to 6 storey shopping centers, medium to large office of ‘mixed use/ozeupancy buidings/structure and the like. MEDIUM DENSITY RESIDENTIAL ZONE (R-2). Caractoized mainly as a low-rise singleattached, duplex or mut-evel building/structure for exclusive use as muttile family dwellings. (MIXED-USE DEVELOPMENT. IVedium to high rse buildings predominanty used for residential purposes and with limited provisions for commercial use. MITIGATING DEVICE. A mears to grant raliet in complying with certan provisions ofthe Ordinance. NON-CONFORMING USE.
