The following Act of the West Bengal Legislature, having been assented to by the Governor, is hereby published for {general information” ‘The West Bengal Shops and Establishments (Amendment) Act, 1965 (West Bencat. Act VII of 1965) (Passed by the West Bengal Legislature) [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 31st May, 1965} ‘An Act to amend the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963). ‘Whereas itis expedient to amendthe West Bengal Shops & Establishments Act, 1963, for the purpose and the manner hereinafter appearing; It is hereby enacted in the Sixteenth Year of the Republic of India, by the Legislature of West Bengal, as follows: 1, Short title—This Act may be called the West Bengal Shops and Establishments (Amendment) Act, 1965. Amendment of Section 2 of West Bengal Act XIII of 1963 2. In clause (16) of Section 2 of the West Bengal Shops and Establishments Act, 1963, for the words ““beginning at midnight on Sunday", the words “beginning at midnight on Tuesday” shall be substituted. SCHEDULE Class of shops and establishments and provision of the Act— 1. Shops dealing mainly in medicines, surgical apparatus, bandages and other medical requisites—Clause (3) of subsection (1) of Section 5, and sub- section (1) of Section 6. 2. Consulting chambers of medical practitioners and of persons engaged in legal profession and the premises used for educational services—Clause (3) of sub-section (1) of Section 5, and sub-section (1) of Section 6. 3. Residential hotels and boarding houses—Sub-section (1) of Section 7. 4, Shops dealing exclusively in fresh (ie. non-tinned) vegetables, meat, fish, dairy products, bread, pastries, sweet-meats, flours and such other perishable commodities of daily consumption—Clause (a) of subsection (1) of Section ‘5 and sub-section (1) of Section 6, 5. Offices of shops dealing exclusively in daily newspapers-Clause (a) of ‘sub-section (1) of Section 5, and sub-section (1) of Section 6. 6. NOTIFICATION No. 3I7-LR. ‘25th January, 1965 [WHEREAS by this Department Notification No. 6117-IR/IR/LA/3 (B)/ 63 dated the 9th November, 1964, the Governor was pleased to exempt under sub-section (2) of Section 4 of the West Bengal Shops and Establishments Act, 1963 (West Bengal Act XIII of 1963), hereinafter referred to as the said Act, all classes of Shops and Establishments from the operation of the provisions of Section 16 ofthe said Act for a period of ninety days with effect from the 13th November, 1964 AND WHEREAS the said period of exemption is due to expire on the 10th February, 1964; Now, THEREFORE, in exercise of the power conferred by Clause (/) of sub- section (1) of Section 16 of the said Act, the Governor is pleased hereby to specify, in the case of shops and establishments in existence on the date on which the said Act applies, the 45th day following the 10th February, 1965, as the date within which the shopkeepers or employers, as the case may be, shall apply for registration under the said Act to the registering authority. NOTIFICATION No. 318-1R. 25th January, 1965 In exercise of the power conferred by clause (12) of Section 2 of the West Bengal Shops & Establishments Act, 1963 (West Bengal XIII of 1963), andin ‘supersession of this department notification No. 3204-IR/IR/LA-3(B)/63, dated the 27th July, 1964, the Governor is pleased hereby to appoint the persons mentioned in the entries in Column (1) of Schedule below as registering ‘authorities for the purposes of the said Act for the areas mentioned in the ‘corresponding entries in Column (2) of the said Schedule, Te SCHEDULE, Persons Areas 1, Chief Inspector of Shops and Establishments, West Bengal. 2. Whole of West Bengal joners, and Labour NOTIFICATION No. 1199-18, 25th March, 1965 In exercise of the power conferred by clause (1) of sub-section (1) Of Section 16 Of the West Bengal shops and Establishments Act, 1963 (West Bengal Act XIII of 1963) (he: etnafter referred to as the said Act), and in partial modification of this department notification No. 317-IR/IR/IA-3/65, dated the 25th January, 1965 published at page 278 of Part I of the Calcutta Gazette, Extraordinary, of the 9th February, 1965, the Governor is pleased hereby to specify, in case of shops and establishments In existence on the date on which the said Act applies, the 90th day following the 10th February, 1965, as the date within which the shopkeepers or employers, as the case may be, shall apply for registration under the said Act to registering authorities. NOTIFICATION No. 1693-LR. lth May, 1965 In exercise of the power conferred by clause (1) of sub-section (1) of Section 16 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963) (hereinafter referred to asthe said Act) and in partial modification of this department Notification No. 317-IR/IR/IA-3/65, dated the 25th January, 1965 and No. 1199-IR/IR/IA-3/65, dated the 25th March, 1965, published at page 278 of Part I of the Calcutta Gazette, Extraordinary-of the’ 9th February, 1965 and at page 763 of Parti of the Calcutta Gazette, Extraordinary of the 162 30th March, 1965 respectively, the Governor is pleased hereby to specify, in the ease of shops and establishments in existence on the date on which the sald ‘Act applies, the 120th day following the 10th February, 1965 as the date within which the shopkeeper or employers, as the case may be, shall apply for registration under the said Act to the Registering Authority. NOTIFICATION No. 1777-5. 18th May, 1965 ‘Wutreas the Governor thinks fit so to do in the public interest: Now, Triereroré, in exercise of the power conferred by subsection (2) of Scetion 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to exempt the classes of shops dealing exclusively in Chira, Muri, Khai, Bhuja or articles of confectionery, or in some or all of them, from the operation of the provisions of clause (a) of subsection (1) of Section 5 and sub-section (1) of Section 6 of the said Act, subject to the condition that before availing himself of the exemption hereby granted a shopkeeper shall give written notice of his intention to do $0 by registered post with acknowledgement due or by personal service after obtaining an acknowledgement of service— (a) Where the shop is situated in Calcutta as defined in the Calcutta Municipal Act, 1951, to the Chief Inspector of Shops and Establishments, or (b) Where the shop is situated in any other area, to an Inspector of Shops and Establishments other than the Chief Inspector, having jurisdiction over such other area, NOTIFICATION No. 1886-LR. 25th May, 1965 (Published in Calcutta Gazette, dated August 5,1965, p. 1620). ‘Wuexeas the Governor thinks fit so to do in the public interest; Now, THEREFORE, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to exempt all classes of shops situated within the municipal areas of Darjeeling, Kurseong and Kalimpong from the operation of clause (a) of sub-section (1) of Section 5 and sub-section (1) of Section 6 of the said Act for the periods from the fifteenth day of April tothe fourteenth day of June and from the fifteenth day of September to the fourteenth day of November every year on the occasion of tourist season, subject to the condition that before availing of the exemption hereby granted a shopkeeper shall intimate his intention so to do by notice served either personally 163 after obtaining an acknowledgement of service or by registered post with ‘acknowledgement due to the Inspector of Shops and Establishments of the areas. NOTIFICATION No, 2133-11 12th June, 1965 In exercise of the power conferred by sub-section (4) of Section 5 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to make the following amendment in this, department Notification No, 313-IR/ IR/75-10/64, dated the 2Sth January, 1965, Published at pages 271-277 of Part I of the Calcutta Gazette, Extraordinary of the 9th February, 1965 (hereinafter referred to as the said notification), namely: Amendment Inthe Schedule tothe said notification, in Column 2 under the heading “Classes of Shops” for the words “All classes of shops except ration/fair price and chakki shops” wherever they occur, substitute the words “All classes of shops except ration/fair price shops, chakki shops and barbers’ and hair dressers" shops” NOTIFICATION No, 2461-LR. 23rd June, 1965 ‘Wutreas the Governor thinks fit so to do so in the public interest; Now, Tuererore, in exercise of the power conferred by subsection (2) of Seetion4 of the West Bengal Shops and Establishments Act, 1963 (West Bengal Act XIII of 1963), (hereinafter referred to as the said Act) the Governor is pleased hereby to exempt all classes of banks situated in all the areas to which the said Act applies from the operation of sub-sections (2) and (4) of Section 7 of the said Act for the periods from the 28th June to 30th June and from the 29th December to 31st December every year on the occasions of half-yearly closing of Banks’ Accounts and yearly closing of Banks’ Accounts respectively, subject to the fbilowing conditions, namely:— Conditions (1) Before availing of the exemption hereby granted an employer shall intimate his intention so to do by notice served either personally after obtaining, ‘an acknowledgement of service or by registered post with acknowledgement due in case of banks situated within the Municipal areas of Calcutta, Howrah, ‘South Suburban Municipality and Baranagar, to the Chief Inspector of Shops and Establishments, West Bengal, and in case of banks situated in other area, to the local Inspector of Shops & Establishments. (2) The total period of overtime work in a year including the hours of ‘overtime work performed during the periods of exemption hereby granted shall 164 not exceed the limit laid down in clause (ii) of the proviso to sub-section (2) of Section 7 of the said Act. NOTIFICATION No, 2133-LR, 12th June, 1965 In exercise of the power conferred by sub-section (4) of Section 5 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to make the following amendment in this ‘department Notification No. 313-IR/ IR/75-10/64, dated the 25th January, 1965 published at pages 271-277 of Part I of the Calcutta Gazette, Extraordinary of the 9th February, 1965 (hereinafter referred to as the said notification), namely: Amendment Inthe Schedule to the said notification, in Column 2 under the heading “Classes (of Shops” for the words “All classes of shops except ration/fair price and chakki shops” wherever they occur, substitute the words “All classes of shops except ration/fair price shops, chakki shops and barbers” and hair dressers’ shops”. NOTIFICATION No. 2461-18. 23rd June, 1965 Waiteeas the Governor thinks fit so to do so in the public interest; Now, Titererore, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops and Establishments Act, 1963 (West Bengal Act XIII of 1963), (hereinafter referred to as the said Act) the Governor is, pleased hereby to exempt all classes of banks situated in all the areas to which the said Act applies from the operation of sub-sections (2) and (4) of Section 7 of the said Act for the periods from the 28th June to 30th June and from the 29th December to 31st December every year on the occasions of half-yearly closing of Banks’ Accounts and yearly closing of Banks’ Accounts respectively, subject to the fbilowing conditions, namely:— Conditions (1) Before availing of the exemption hereby granted an employer shall intimate his intention so to do by notice served either personally after obtaining an acknowledgement of service or by registered post with acknowledgement due in case of banks situated within the Municipal areas of Calcutta, Howrah, South Suburban Municipality and Baranagar, to the Chief Inspector of Shops and Establishments, West Bengal, and in case of banks situated in other area, to the local Inspector of Shops & Establishments. NOTIFICATION No. 4100-18. 8th September, 1965 |Wurxeas the Governor thinks fit so to do in the public interest in view of the present state of the emergency; Now, Tiererore, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops and Establishments Act, 1963 (West Bengal ‘Act XIII of 1963), (hereinafter referred to as the said Act), the Governor is pleased hereby to exempt all classes of banks situated in all areas to which the said Act applies from the operation of Clause (//) of the proviso to sub-section (2) of Section 7 of the said Act until further orders subject to the following conditions; namely: Conditions (1) Before availing of the exemption hereby granted an employer shall intimate his intention so to do by notice served either personally after obtaining ‘an acknowledgement of service or by registered post with acknowledgement ‘due in case of banks situated within the municipal areas of Caleutta, Howrah, 167 banette-12 South Suburban Municipality and Baranagar to the Chief Inspectors of Shops ‘and Establishments, West Bengal and in case of banks situated in other areas, to the local Inspectors of Shops and Establishments, (2) The total period of overtime work in a year shall not exceed 150 hours without the consent of the person employed. NOTIFICATION No. 4113-LR. 14th October, 1966 Whereas the Governor thinks fit so to do in the public interest; Now, Tiererore, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to exempt all classes of decorators” shops (Publication date-same as above) from the operation of the provisions of clause (a) of sub-section (1) of Section 5 and sub-section (1) of Section 6 of the said Act, subject to the condition that before availing himself of the exemption hereby granted shopkeeper shall give written notice of his intention to do so by registered post with acknowledgement due or by personal service after obtaining an acknowledge of service— (a) Where the shop is situated in Calcutta as defined in the Calcutta Municipal Act, 1951, to the Chief Inspector of Shops and Establishment, or (b) Where the shop is situated in any other area, to an Inspector of Shops and Establishments other than the Chief Inspector, having jurisdiction over such other area, NOTIFICATION No. 3822-LR. 19th September, 1966 Whereas the Governor thinks fit so to do in the public interest; Now, Tuexerore, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), (hereinafter referred to as the said Act) the Governor is pleased hereby to exempt all commercial establishments in so far as such establishments are engaged in the business of storage of articles or commodities in cold storages operated by them from the operation of the provision of clause (a) of sub-section (1) of Section 5 of the said Act, subject to the condition that 169 eS a ee before availing himself of the exemption hereby granted the employer concerned shall give written notice of his intention to do so by registered post with acknowledgement due or by personal service after obtaining an ‘acknowledgement of service— (a) where the commercial establishment is situated in Calcutta as defined in the Caleutta Municipal Act, 1951, to the Chief Inspector, Shops & Establishments. (b) where the commercial establishments are situated in any other area, to ‘an Inspector of Shops & Establishments other than the Chief Inspector, having jurisdiction over such other area. NOTIFICATION No. 625-1.R. 16th February, 1967 ‘WiteReas the Governor thinks fit so to do in the public interest; Now, THererore, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963) (hereinafter referred to as the said Act), the Governor is pleased hereby to exempt all classes of persons employed in establishments as watchmen from the operation of sub-sections (2) and (3) of Section 7 of the said Act, subject to the following conditions, namely;— Conditions (1) No person employed in an establishment as a watchman shall be required or permitted to work in such establishment for more than eight hours and a half in any one day or for more than forty-eight hours in any one week: Provided that a person employed in an establishment as a watchman ‘may be required or permitted to work overtime in such establishment 80, however, that— (® the total number of hours of his work including overtime work shall not exceed ten hours in any one day, and i) the total number of hours worked overtime by him shall not exceed one hundred and twenty hours in any one year. (2) No person employed in an establishment as a watchman between 6 am. and 10 a.m. shall be required or permitted to work in such establishment for more than six hours in any one day unless he has been allowed an interval for rest of at least one hour during that day. [Calcutta Gazete, dated March 16,1967, page 547], 170 NOTIFICATION No. 624-LR. 16th February, 1967 ‘Witereas the Governor thinks fit so to do in the public interest; Now, Turrerore, in exercise of the power conferred by sub-section (2) of Section 4 of the West Bengal Shops &. Establishments Act, 1963 (West Bengal Act XIII of 1963) (hereinafter referred to as the said Act), the Governor is pleased hereby to exempt the classes of persons employed in shops as watchman from the operation of the provisions of sub-sections (2) and (3) of Section6 of the said Act, subject to the following conditions, namely:— Conditions (1) No person employed in a shop as a watchman shall be required or permitted to work in such shop for more than eight hours and a half in any day or for more than forty-eight hours in any one week, provided. that in any day and in any week in which stock-taking, making up accounts or such other business operation as prescribed in the West Bengal Shops and Establishments Rule, 1964, takes place in any shop, a person employed in the shop as a watchman may be required or permitted to work overtime in such shop so, however, that— (the total number of hours of his work including overtime work shall not exceed ten hours in any one day, and. ) the total number of hours worked overtime by him shall not exceed one hundred any twenty hours in any year. (2) No person employed in a shop as a watchman between 6 a.m. and 10 p.m. shall be required or permitted to work in such shop for more than six hours in any one day, unless he has been allowed an interval for rest of atleast one hour. NOTIFICATION No. 4100-LR. 8th September, 1965 Wneereas the Governor thinks fit so to do in the public interest in view of the present state of the emergency; Now, Theerore, in exercise of the power conferred by subsection (2) of Scetion 4 of the West Bengal Shops and Establishments Act, 1963 (West Bengal ‘Act XIII of 1963), (hereinafter referred to as the said Act), the Governor is pleased hereby to exemptall classes of banks situated in all areas to which the said Act applies from the operation of Clause (/) of the proviso to sub-section (2) of Section 7 of the said Act until further orders subject to the following conditions; namely: Conditions (1) Before availing of the exemption hereby granted an employer shall intimate his intention so to do by notice served either personally after obtaining ‘an acknowledgement of service or by registered post with acknowledgement due in case of banks situated within the municipal areas of Calcutta, Howrah, 167 L Garette-t2 ‘South Suburban Municipality and Baranagar to the Chief Inspectors of Shops and Establishments, West Bengal and in case of banks situated in other areas, to the local Inspectors of Shops and Establishments. NOTIFICATION No. 4113-LR. 14th October, 1966 ‘Whereas the Governor thinks fit so to do in the public interest; Now, TheReFoRe, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal ‘Act XIII of 1963), the Governor is pleased hereby to exempt all classes of decorators’ shops (Publication date-same as above) from the operation of the provisions of clause (a) of sub-section (1) of Section 5 and sub-section (1) of Section 6 of the said Act, subject to the condition that before availing himself of the exemption hereby granted shopkeeper shall give written notice of his intention to do so by registered post with acknowledgement due or by personal service after obtaining an acknowledge of service— (a) Where the shop is situated in Calcutta as defined in the Calcutta ‘Municipal Act, 1951, to the Chief Inspector of Shops and Establishment, or (b) Where the shop is situated in any other area, to an Inspector of Shops and Establishments other than the Chief Inspector, having jurisdiction over such other area. NOTIFICATION No. 3822-LR. 19th September, 1966 ‘Waters the Governor thinks fit so to do in the public interest; Now, TueReroRe, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal ‘Act XIII of 1963), (hereinafter referred to as the said Act) the Governor is pleased hereby to exempt all commercial establishments in so far as such establishments are engaged in the business of storage of articles or commodities in cold storages operated by them from the operation of the provision of clause (@) of sub-section (1) of Section 5 of the said Act, subject to the condition that 169 bofore availing himself of the exemption hereby granted the employer concerned shall give written notice of his intention to do so by registered post with acknowledgement due or by personal service after obtaining an acknowledgement of service— (a) where the commercial establishment is situated in Calcutta as defined in the Calcutta Municipal Act, 1951, to the Chief Inspector, Shops & Establishments. (b) where the commercial establishments are situated in any other area, to an Inspector of Shops & Establishments other than the Chief Inspector, having jurisdiction over such other area. NOTIFICATION No. 625-1.R. 16th February, 1967 ‘Whirxeas the Governor thinks fit so to do in the public interest; Now, THeReFore, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963) (hereinafter referred to as the said Act), the Governor is Pleased hereby to exempt all classes of persons employed in establishments as watchmen from the operation of sub-sections (2) and (3) of Section 7 of the said Act, subject to the following conditions, namely;— Conditions (1) No person employed in an establishment as a watchman shall be required ‘or permitted to work in such establishment for more than eight hours and a half in any one day or for more than forty-eight hours in any one week: Provided that a person employed in an establishment as a watchman ‘may be required or permitted to work overtime in such establishment 80, however, that— (the total number of hours of his work including overtime work shall not exceed ten hours in any one day, and i) the total number of hours worked overtime by him shall not exceed one hundred and twenty hours in any one year. (2) No person employed in an establishment as a watchman between 6 am. and 10 a.m. shall be required or permitted to work in such establishment for more than six hours in any one day unless he has been allowed an interval for rest of at least one hour during that day. Establishments Act, 1963 (West Bengal Act XIII of 1963) (hereinafter referred to as the said Act), the Governor is pleased hereby to exempt the classes of persons employed in shops as watchman from the operation of the provisions of sub-sections (2) and (3) of Section 6 of the said Act, subject to the following conditions, namely:— Conditions (1) No person employed in a shop as a watchman shall be required oF permitted to work in such shop for more than eight hours and a half in any day or for more than forty-eight hours in any one week, provided that in any day and in any week in which stock-taking, making up accounts or such other business operation as prescribed in the West Bengal Shops and Establishments Rule, 1964, takes place in any shop, a person employed in the shop as a watchman may be required oF permitted to work overtime in such shop so, however, that— (the total number of hours of his work including overtime work shall not exceed ten hours in any one day, and. (2) of Section 4 of West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963) (hereafter referred to as the said Act), the Governor is hereby pleased to exempt all classes of motor and cycle repairing shops situated in all the areas to which the said Act applies from the operation of clause (a) of sub- section (1) of Section 5 of the said Act, subject to the condition that 171 in the case of a shop situated within the municipal areas of Calcutta, Howrah, ‘South Suburban Municipality and Baranagar to the Chief Inspector of Shops & Establishments, West Bengal and in the case of a shop situated in any other area, to the local Inspector of Shops & Establishments. NOTIFICATION No. 2851-LR. 27th June, 1967 In exercise of the power conferred by sub-section (4) of Section 1 of West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII1963), the Governor is pleased hereby to specify premises wholly or in the part for any kind of renovation or repairing service to be other classes of shops to which the said Act shall apply. NOTIFICATION No, 3568~IR/75-42/67 28th July, 1967 In exercise of the power conferred by sub-section (4) of Section 1 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to specify the Chakki Mills which are not factories as defined in the Factories Act, 1948 to be the other class of shops to which the said Act shall apply. NOTIFICATION No, 591 1-IR/IR-75-24/66 13th November, 1967 ‘Wuereas the Governor thinks fit so to do in the public interest; Now, THERerore, in exercise of the power conferred by subsection (2) of ‘Section 4 of the West Bengal Shops & Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to exempt all classes of shops dealing in paddy seeds, jute seeds and vegetable seeds situated in all the areas to which the said Act applies from clause (a) of sub-section (1) of Section 5 of the said Act for the period from January to February and from October to November every year for sale or rabi seeds and chaitali seeds subject to the condition’ that before availing of the exemption hereby granted a shopkeeper shall intimate his intention so to do by notice served either personally after obtaining an acknowledgement of service or by registered post with acknowledgement due with the Inspector of Shops & Establishments of the areas. im NOTIFICATION No. 6445-1.R. Ith December, 1967 Wutreas the Governor thinks fit so to do in the public interest; Now, Titererore, in exercise of the power conferred by subsection (2) of Section 4 of the West Bengal Shops and Establishments Act, 1963 (West Bengal Act XIII of 1963), the Governor is pleased hereby to exempt all classes of ‘commercial establishments concerned exclusively with the management of aerial ropeways, from the operation of the provisions of clause (a) of sub-section (1) of Section 5 of the said Act, subject to the condition that before availing himself of the exemption hereby granted an employer shall intimate his intention to do soy written notice served either personally after obtaining an acknowledgement of service, or by registered post with acknowledgement due— (a) where the commercial establishment is situated within the municipal areas of Calcutta, Howrah, South Suburban Municipality and Baranagar, to the Chief Inspector of Shops & Establishments, or (b) where the commercial establishment is situated in any other area, to the local Inspector of Shops and Establishments. Any shopkeeper who avails himself of such exemption shall in lieu of the weekly holidays, if any, falling on such days, grant to his employees, during the next two weeks following such days, compensatory holiday consecutively with the weekly holidays for the weeks eoncemed, 2. Press Note In the context of the present power shortage, it has become imperative to restrict consumption of electricity as much as possible in the interest of the community asa whole. Keeping this in view, the following arrangement has been made:— (1) In the case of Shops dealing mainly in groceries and exclusively in tobacco, cigars, cheroots, cigarettes, bidis, pan, liquid refreshments or ice sold retail for consumption in premises, the opening and closing hours remain ‘unaffected i.e. from 6 a.m. to 8 p.m. during summer months. 197 (2) ‘The latest hour of closing of all other classes of shops has been fixed at 7 pan, from Monday to Friday instead of 7-30 p.m. To compensate this the earliest hour of opening of the aforesaid shops has been fixed at 7 a.m. instead ‘of 7-30 a.m, as at present. (3) The opening and closing hours of all categories of shops on Saturday and Sunday remain 8-30 a.m. to 8-30 p.m. as at present. (4) Shops dealing in medicines, fresh vegetables, meat, dairy products, bread, sweetmeats, chira, muri, daily newspapers etc. and petrol pumps are not required to abide by the present notification as these are already exempt from the relevant statutory provisions providing closure of shops. Durr Deputy Secretary to the Govt. of West Bengal GOVERNMENT OF WEST BENGAL LABOUR DEPARTMENT NOTIFICATION No. 337-1.R. 22nd February, 2000 ‘Whereas the State Govt. thinks it fit as to do in the public interest; Now, Thererore, in exercise of the power conferred by subsection (2) of Section (4) of the West Bengal Shops & Establishments Act, 1963 (hereinafter referred to as the said Act), the Governor is hereby pleased to grant exemption (hereinafter referred to as the said exemption) to all multi-department-single establishment type retail stores located in the C.M.D.A. area under one roof, and under one employer employing not less than 25 (Twenty Five) persons as 4 class of shops from the operations of the provisions of sub-section (1) of Section (5) sub-section (1) of Section (6) of said Act subject to the following ‘conditions: — Conditions (2). Such retail stores shall not open earlier than 8.30 a.m, and shall not remain ‘open beyond 8.30 p.m. (2) Every person employed in such shop/retail stores shall be allowed holidays with wages at least for one and a half day in every week. (3) Normal working hours of the employees should not be more than 8 hours and a half on any one day or more than 48 hours in a week and the spread ‘over should not be more than 10 hours and a half on any one day, am ‘West Bengal Shops & Establishments Act, 1963 : Notifications (4)_ Every employee shall be paid wage for over-time work in accordance with Section 13 of the said Act, (5) No young persons as defined under section 2(17) of the said Act andl woman ‘employee shall be required or permitted to work beyond 6 p.m. (6) All other conditions will continue to be governed by other relevant provisions of the said Act, (1) The employees should be required to work by rotations. ‘The Governor is further pleased to order that while the said exemption granted to the class of shops mentioned hereinabove is general in nature, every individual employer intending to avail ofthe said exemption will have to apply to the Govt seeking permission for grant of the said exemption and government after consideration of the merit of such application, will grant or refuse to grant permission accordingly. (2) Every person employed in such banks shall be allowed continuous one and a half day's paid holiday in every week. (3). Employees who would be required to work on national holidays, festival holidays and holidays declared under N.I.
