BACKGROUND The DILG, through its monitoring teams, remained steadfast in carrying out its oversight role over LGUs nationwide, specifically in the implementation of Locally- funded Projects through the years. The Department has organized monitoring teams and devised tools and procedures to ensure that the implementation of the same is in accordance with the national standards, and that the allocated funds are used for the intended purpose. This year, the abrupt changes in work arrangements, restrictions in mobility, and health risks brought by the pandemic has partially affected the DILG monitoring deliverables and similar undertakings. In response, the Department has modified and innovated strategies to pave the way for the new normal in monitoring, for sustained performance of roles and responsibilities. Continuous effort to ensure quality and effective project implementation among local governments is critical in setting the course of local development and improved service delivery. 2. PURPOSE This Circular is issued to provide guidance for all DILG personnel involved in the conduct of regular monitoring of OPDS-administered Locally-funded Projects amid the COVID-19 situation. Itis specifically intended for the DILG to continuously comply with the roles and responsibilities stipulated under DILG Memorandum Circular (MC) No. 2018-104: Policy Guidelines in Monitoring of the FY 2017 Assistance to Disadvantaged Municipalities (ADM), FY 2018 Assistance to Municipalities (AM), FY 2018 SAGANA at Ligtas na Tubig para sa Lahat (SALINTUBIG) Programs under the Local Government Support Fund (LGSF), and thereafter, as well as relevant provisions under DILG MC No. 2020-094: Policy Guidelines and Procedures in the Implementation of Conditional Matching Grant to Provinces (CMGP), pending issuance of revised Monitoring Guidelines. 3. LEGAL COMPLIANCE 3.4 3.2 agi 34. 3.5, DILG MC No. 2018-104: Policy Guidelines in Monitoring of the FY 2017 Assistance to Disadvantaged Municipalities (ADM), FY 2018 Assistance to Municipalities (AM), FY 2018 SAGANA at Ligtas na Tubig para sa Lahat (SALINTUBIG)Programs under the Local Government Support Fund (LGSF), and thereafter. DILG MC No. 2020-094: Policy Guidelines and Procedures in the Implementation of Conditional Matching Grant to Provinces (CMGP) For Road and Bridge Rehabilitation, Upgrading and Improvement under the Local Government Support Fund. The Inter-Agency Task Force for the Management of Emerging Infectious Diseases (|ATF-MEID) - Revised Omnibus Guidelines, dated 15 May 2020, which allowed government construction activities to continue with proper safety protocols in place. Department of Public Works and Highways Department Order no. 39, which provided the Revised Construction Safety Guidelines for the Implementation of Infrastructure Projects. Government Procurement Policy Board Resolution 09-2020: Approving Measures for the Efficient Conduct of Procurement Activities During a State of Calamity, or Implementation of Community Quarantine or Similar Restrictions. 4, SCOPE/COVERAGE This poli 44 4.2, 43, 5. POLICY C 54 icy shall cover: All DILG Regional and Field Offices (DILG-RO and FO), primarily involved in the implementation of OPDS-administered Locally-funded Projects; ‘All units under Office of Project Development Services including Project Management Offices (CMGP, AM-LAR, AM-DRROI, WSSPMO); and OPDS-administered Locally-funded Projects at implementation stage from FY 2012 to 2020, and thereafter. SONTENT AND GUIDELINES Operational Prerequisites 5.1.1. Taking into account inter-LGU travel restrictions and to minimize human physical intervention, only DILG-Provincial Office Engineers are encouraged to field for project inspection at a ratio of one (1) engineer per one (1) project site/LGU. CO and RO engineers shall monitor virtually. However, the RO Engineer may substitute the PO Engineer if one of the following conditions are met: 5.1.1.1 5.1.1.2 Co-location of DILG Regional Office/current place of residence of the RO engineer and location of project (within the same LGU); or Inter-boundary travel between DILG Regional Office/place of residence of the RO engineer and location of project is allowed per prevailing quarantine guidelines. 5.1.2. For safety purposes, PO/RO Engineers assigned for physical monitoring shall abide by the set minimum health standards and protocols. As such, each Engineer is required to comply with the basic new normal project monitoring checklist - before, during, and after deployment (Annex B) 5.1.3. Only priority/shortlisted projects are subject for physical monitoring Projects not included in the priority list shall be continuously monitored through the SubayBayan system, in accordance with DILG MC No. 2018-108, DILG MC No, 2018-114, and DILG MC No. 2020-084 sec 6.11.4 5.1.3.1, For projects under the Conditional Matching Grant to Provinces (CMGP) program included on the list for physical monitoring and data capture report validation for projects not included in the priority list, CMGP PMO, RO, and PO engineers assigned shall be guided in the Online Monitoring & Reporting System as shown in Annex C of this MC. 5.1.4. Structures and Compositions 5.1.4.1 5.1.4.2. The OPDS Technical Working Group (OPDS-TWG) on Monitoring, headed by the Monitoring and Evaluation Section, is composed of the Infrastructure Development Section of the Project Monitoring and Evaluation Division (PMED); a representative from the Project Capacity Development Division (PCDD); and select Engineers/Technical staff from PMOs (CMGP, AM-DRROI, AM-LAR, WSSPMO). The OPDS-TWG is primarily tasked to oversee and monitor the compliance of all concerned to the herein stipulated roles and responsibilities. The TWG shall also be responsible in recommending the initial list of projects subject for physical monitoring and regular updating of the criteria to be used for shortisting. The Regional Technical Working Group (RTWG) on Monitoring, to be organized by the DILG-Regional Offices and headed by the POMU Chief, consists of all RO and PO Engineers, and PO Program Managers. The RTWG shall verify and conform to the 5.1.4.3. initial list of projects subject for physical monitoring, and prepare the monthly monitoring schedule and assignments. The Virtual Monitoring Teams, to be organized by the OPDS, are composed of assigned Engineers from PMED, PMOs, and/or PDMUs. They are tasked to provide technical assistance and recommendations virtually to deployed Regional/Provincial Engineers. 5.1.5, Operational Platforms 5.1.5.1. 5.1.5.2. 5.1.5.3. The Subaybayan ang Proyektong Bayan (SubayBayan) system shall be the main platform for the online submission and updating of status and progress reports for Locally-funded Projects. ‘The OPDS-PMED google drive shalll serve as the storage facility for all additional Means of Verification (MOVs) needed for the conduct of virtual validation, and databases for monitoring of activities. Teleconferencing platforms such as Zoom, Cisco Webex Meeting, Google Meet, Facebook Messenger and others shall be used for the conduct of virtual validation, exit conferences, and coordination meetings, whichever alternative is applicable and appropriate. 5.2. Phases of Implementation, Indicative Schedules and Responsibilities 5.2.1. Sub-framework/process flow for project monitoring Py ntervetion This sub-framework is supplementary to the Risk-based Operational Framework provided in the Monitoring Guidelines. However, it hall cater only to DILG Monitoring Teams and procedures. They shall be guided by the following sub-processes: 5.2.1.1, Risk Assessment — Identification/prioritization of ongoing projects for physical monitoring based on the SubayBayan data on Projects-at-Risk and analysis of risks associated with the conduct of on-site monitoring to facilitate safe deployment. The detailed procedure is discussed in subsection 5.2.2.1 5.2.1.2. Sate Monitoring - Streamlined and combined physical and virtual monitoring mechanisms to minimize human physical intervention. The detailed procedure is discussed in subsection 5.2.2.2. 5.2.1.3, Data Processing — Conduct of virtual validation, virtual exit conference, facilitation of updating of Projects-at-Risk through encoding of monitoring results to the SubayBayan portal, and provision of virtual coaching assistance. The detailed procedure is discussed in subsection 5.2.2.3. 5.2.2. Roles and Responsibilities 5.2.2.1. Risk Assessment DILG MC No, 2018-114 or the SubayBayan Guidelines prescribes the timeline and protocols in ensuring the accuracy and integrity of reported data on the status and progress of implemented projects. The SubayBayan platform shall be the source of data in determining Projects-at-Risk. Central Office 5,2.2.1.1. PMOs shall provide the initial list of projects based on the Guide for Shortlisting of Projects for On-site Inspection (Annex A) every 7% working day of the month to the OPDS- TWG. §.2.2.1.2, The OPDS-TWG shall convene to come up with a regional list of projects for on-site monitoring and provide said list to ROs for confirmation every 10" working day of the month through OPDS-PMED google drive (https://tinyurl.com/OPDSshortlist) 5.2.2.1.3. After the confirmation of the list from the ROs, OPDS shall issue a Memorandum to ROs containing the (i) final list of projects subject for physical monitoring and (ii) composition of Virtual Monitoring Teams every 15% day of the month using template provided in Table 1 Table 1. Issue the Memorandum to POs containing the final list of projects for monitoring and coordinate the schedule of visit upon receipt of the Memorandum from DILG-CO. Provincial Office §.2.2.1.7. Inform respective MLGOOs on the list of projects subject for onsite monitoring and the schedule of the field visit through a Memorandum 8. Inform the concemed LGU on the scheduled onsite monitoring of project/s. 5.2.2.2. Safe Monitoring Central Office 5.2.2.2.1. 522.28. 5.2.2.23, 5.2.2.2.4, 5.22.25. Assigned CO-Engineers per Virtual Monitoring Team shall provide coaching assistance before, during, and after deployment of PO/RO Engineers. They shall monitor the compliance of deployed engineers with the set safety protocols for deployment based on the new normal project monitoring checklist — before and during deployment (Annex B) They shall track and coordinate with deployed field Engineers, open all communication lines, and respond to queries. Ensure that reports are submitted on time. In case of incomplete reports and/or reports that need further validation, the concerned PMO shall prompt the field engineer assigned. Consolidate submitted reports from ROs and provide necessary policy recommendations. Regional Office 5.2226, 5.2.2.2.7. 5.2228, 5.2229, 5.2.2.2.10. Ensure adequate supply of PPEs to be used by Provincial Engineers, Monitor the deployment of Provincial Engineers, open all communication lines, and join the virtual validation. Facilitate timely and complete submission of reports. Assess submitted reports of PO engineers and provide necessary recommendations. Issue communication letters to the concerned LGU on the findings and recommendations. §.2.2.2.11. If the RO Engineer is permitted to travel per conditions set under subsection 5.1.1, they shall be guided by subsections 5.2.2.2.12 to §.2.2.2.17. Provincial Office 5.2.2.2.12. Assigned provincial engineer shall comply with the new normal project monitoring checklist — before, during, and after deployment (Annex B). §.2.2.2.13. Monitor the compliance of LGUs with DPWH DO-39 or the Revised Construction Safety Guidelines (Annex D). 5.2.2.2.14. Conduct onsite monitoring using the required monitoring tool, devices, and equipment. 5.2.2.2.15. Document the monitoring thru video or picture, to be included in the report. If necessary or as required by the assigned CO/RO engineer, documentations are to be used in the virtual validation. 5.2.2.2.16. Submit monitoring report to RO within 5 days from the last day of monitoring, §.2.2.2.17. Inform the LGUs regarding the use of e-procurement procedures in the GPPB Resolution 09-2020 "Approving Measures for the Efficient Conduct of Procurement Activities During a State of Calamity, or Implementation of Community Quarantine or Similar Restrictions” (annex D). MLGOO §.2.2.2.18. The MLGOO shall join the assigned PO/RO engineer during the monitoring. 5.2.2.2.19. The MLGOO shall comply with the new normal project monitoring checklist - before and during deployment (Annex B) 5.2.2.3. Data Processing Central Office 5.2.2.3.1. The Assigned CO engineer shall join the initial virtual discussion based on the result of the monitoring and assessment of the project prior to the conduct of the exit conference. §.2.2.3.2. PMED to establish a platform for the uploading of additional Means of Verification (photos, videos, etc.) to be used for virtual validation by CO/RO engineers. 5.2.2.3.3, Attend the virtual exit conference, provide recommendations, and document findings thru Aide Memoires. 5.2.2.3.4. In case virtual conferencing is not available, CO Engineers may still provide additional recommendations on the issues and concerns based on the submitted photos or videos of the RO/PO Engineers and issue a Memorandum to the concerned LGU, thru the DILG RO/PO. 5.2.2.3.5. Assist in the updating of the Projects-at-Risk (PAR) database by vetting project milestones in the SubayBayan system. 5.2.2.3.6, Organize and manage virtual coaching assistance with LGUs based on the result of monitoring Regional Office 5.2.2.3.7. Join the initial virtual discussion based on the result of on- site monitoring and assessment of the project prior to the conduct of exit conference. 5.2.2.3.8. Attend the virtual exit conference, provide recommendations, and document findings thru Aide Memoires. 5.2.2.3.9, Facilitate the uploading of additional Means of Verification (photos, videos, etc.) by provincial engineers. 5.2.2.3.10. Assist in the updating of the PAR database by approving project milestones updated in the SubayBayan system. §.2.2.3.11. Organize and manage virtual coaching assistance with LGUs based on the result of monitoring, 5.2.2.3.12. If the RO Engineer is permitted to travel per conditions set under subsection 5.1.1, they shall be guided by subsections §.2.2.3.13 to §.2.2.3.16. Provincial Office §.2.2.3.13. Facilitate initial virtual discussion based on the result of the monitoring and assessment of the project prior to the conduct of the exit conference. 5.2.2.3.14. Provide shared document reports and QASH Tool to the assigned CO/RO Engineers for discussion and verification prior to the scheduled exit conference. §.2.2.3.15. Upload photos or videos as required by CO/RO engineers. 5.2.2.3.16. Provide a schedule for the virtual exit conference with the concerned LGUs and share the invitation / link to the assigned RO and CO Engineers. 5.2.2.3.17. Assist in the updating of the PAR database by validating new entries and updates on the project milestones in the SubayBayan system 5.2.2.3.18. Join virtual coaching assistance with LGUs based on the result of monitoring. MLGOO, 5.2.2.3.1. Join the initial virtual discussion based on the result of the monitoring and assessment of the project prior to the conduct of the exit conference. §.2.2.3,20. Coordinate the schedule for the virtual exit conference with LGUs and ensure attendance of the concerned LGU personnel (Kindly note that conduct of exit conferences with LGUs shall be done with a maximum of 10 persons. Proper wearing of PPEs and physical distancing shall be observed. CO/RO engineers shall join virtually) 5.2.2.3.21. Assist in the updating of the PAR database by updating project milestones and uploading photos in the SubayBayan system based on monitoring reports. §.2.2.3.22. Join virtual coaching assistance with LGUs based on the result of monitoring 6. No. 112, 8. 2020 was issued imposing an Enhanced Community Quarantine (ECQ) in high-risk geographic areas of the Philippines and a General Community Quarantine (GCQ) in the rest of the country from 01 to (OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 1 REPUBLIC OF THE PHILIPPINES fines f INTER-AGENCY TASK FORCE 7’ FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES 15 May 2020, adopting the Omnibus Guidelines on the Implementation thereof, and for other Purposes; ‘WHEREAS, the IATF approved the Guidelines on the Implementation of the Modified Enhanced Community Quarantine (MECQ) and the zoning concept and corresponding qualification and its phased response or intervention. WHEREAS, there is a need to revise existing guidelines on community quarantine to streamline rules which will be applicable to transitional community quarantine classifications; WHEREAS, Section 3 of E,O. 112 authorizes the IATF to amend or modify the Omnibus Guidelines on the Implementation of Community Quarantine in the Philippines. NOW, THEREFORE, in consideration of the premises set forth herein, the IATF issues these amended Omnibus Guidelines to harmonize and codify existing policies of the IATF and member-agencies pertaining to community quarantine, which shall be applied to all regions, provinces, cities, municipalities and barangays placed under community quarantine. SECTION [1] DEFINITION OF TERMS. For purposes of these Guidelines, the following shall be defined as follows: 1. Comorbidity - refers to the presence of a pre-existing chronic disease condition. 2. Community Quarantine - refers to the restriction of movement within, into, or out of the area of quarantine of individuals, large groups of people, or communities, designed to reduce the likelihood of transmission of COVID-19 among persons in and to persons outside the affected area, 3. COVID-19 - refers to the Coronavirus Disease 2019 which is caused by the virus known as the severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2. 4, Enhanced Community Quarantine - refers to the implementation of temporary measures imposing stringent limitations on movement and transportation of people, strict regulation of operating industries, provision of food and essential services, and heightened presence of uniformed personne! to enforce community quarantine protocols. )DELINES ON COMMUNITY QUARANTINE] 2 10. REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES Essential goods and services - covers health and social services to secure the safety and well-being of persons, such as but not limited to, food, water, medicine, medical devices, public utilities, energy and others as may be determined by the IATF. General Community Quarantine - refers to the implementation of temporary measures, limiting movement and transportation, regulation of operating industries, and presence of uniformed personnel to enforce community quarantine protocols Health and emergency frontline services - refers to services provided by public health workers (all employees of the Department of Health (DOH), DOH Hospitals, Hospitals of LGUs, and Provincial, City, and Rural Health Units, and Drug Abuse Treatment and Rehabilitation Centers including those managed by other government agencies (e.g. police and military hospitals/clinics, university medical facilities), uniformed medical personnel], private health workers, such as but not limited to medical professionals, hospital and health facility administrative and maintenance staff, and aides from private health facilities, as well as their service providers, health workers and volunteers of the Philippine Red Cross and the World Health Organization, and employees of Health Maintenance Organizations (HMOs), the Philippine Health Insurance Corporation (PHIC), health insurance providers, disaster risk reduction management officers, and public safety officers. Interzonal movement - the movement of people, goods and services across areas under different community quarantine classifications. Modified Enhanced Community Quarantine - refers to the transition phase between ECQ and GCQ, when the following temporary measures are relaxed and become less necessary: stringent limits on movement and transportation of people, strict regulation of ‘operating industries, provision of food and essential services, and heightened presence of uniformed personnel to enforce community quarantine protocols. 12, Modified General Community Quarantine - refers to the transition phase between GCQ and New Normal, when the following temporary measures are relaxed and become less necessary: limiting movement and transportation, the regulation of operating industries, and the presence of uniformed personnel to enforce community quarantine protocols . 13. New Normal - refers to the emerging behaviors, situations, and minimum public health standards that will be institutionalized in common or routine practices and remain even after the pandemic while the disease is not totally eradicated through means such as widespread immunization. These include actions that will become second nature to the general public as well as policies such as bans on large gatherings that will continue to remain in force. 14, Operational capacity - refers to such a number of employees or workers who can be permitted or required to physically report to work on-site in a particular office or establishment. 15. Skeleton workforce - refers to the operational cap: h utilizes the smallest number of people needed for a business or organization to maintain its basic functions. SECTION [2] GUIDELINES FOR AREAS PLACED UNDER ENHANCED COMMUNITY QUARANTINE. Areas placed under ECQ shall observe the following protocols: ‘OMNIBUS GUIDELINES ON COMMUNFTY QUARAX REPUBLIC OF THE PHILIPPINES fur) i INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES 1. Minimum public health standards shall be complied with at all times for the duration of the ECQ. 2. Strict home quarantine shall be observed in all households, and the movement of all residents shall be limited to accessing essential goods and services, and for work in permitted offices or establishments as well as activities listed hereunder. 3. Any person below twenty-one (21) years old, those who are sixty (60) years old and above, those with immunodeficiency, comorbidity, or other health risks, and pregnant women, including any person who resides with the aforementioned, shall be required to remain in their residences at all times, except when indispensable under the circumstances for obtaining essential goods and services, or for work in industries and offices or such other activities permitted in this Section. 4, The following activities/persons/establishments are allowed to work ot operate during ECQ: 8. With full operational capacity i. Public and private hospitals; ii, Health, emergency and frontline services, including dialysis centers, chemotherapy centers and the like; iii, Manufacturers of medicines, medical supplies, devices and equipment, including suppliers of input, packaging, and distributi iv. Industries involved in agriculture, forestry, and fishery and their workers, including farmers, Agrarian Reform Beneficiaries (ARBs), fisherfolk, and agri-fishery stores, and such other components of the food value chain; and Vv. Delivery and courier services, whether in-house or outsourced, transporting food, medicine, or other essential goods, including clothing, accessories, hardware, housewares, school and office supplies, as well as pet food and other veterinary products. b. Ata maximum of fifty percent (50%) operational capacity, without prejudice to the adoption of work-from-home or other alternative work arrangements and without diminution of the existing operational capacity previously allowed: OMIBUS GUIDELINES ON COMMUNITY QUARANTINE] 5 &, iii, REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES Private establishments and their employees involved in the provision of essential goods and services, and activities in the value chain related to food, medicine and vitamins production, medical supplies, devices and equipment, and other essential products such as but not limited to soap and detergents, diapers, feminine hygiene products, toilet paper and wet wipes, and disinfectants. Such establishments shall include, but shall not be limited to, public markets, supermarkets, grocery stores, convenience stores, laundry shops, food preparation establishments insofar as take-out and delivery services, and water-refilling stations, unless otherwise authorized by the Department of Trade and Industry (DTI); Media establishments and their total permanent staff complement, inclusive of reporters and other field employees, as registered with the Department of Labor and Employment (DOLE) and accredited by the Presidential Communications Operations Office; and Workers accredited by the Department of Transportation (DOTr) to work on utility relocation works, and specified limited works across thirteen (13) railway projects, including replacement works for the Manila Metro Rail Transit System Line 3. Provided that where applicable, on-site or near-site accommodations and/or point-to-point shuttle services should be arranged. ©. With skeleton workforce: Other medical, dental, rehabilitation, and optometry clinics; pharmacies or drug stores: Provided, there is strict observance of infection prevention and control protocols. Provided, further, that dental procedures shall be limited to emergency cases only and that the wearing of full Personal Protective Equipment (PPEs) by dentists and attendants shall be mandatory. Provided finally that home service therapy for Persons With Disabilities (PWDs) shall be allowed; Veterinary clini Banks, money transfer services, including pawnshops only insofar as performing money transfer functions, microfinance institutions, and credit cooperatives, including their armored vehicle services, if any; OMNIHUS GUIDELINES ON COMMUNITY QUARANTINE] 6 we Sans Wy "Shane vi vii viii, xi xii REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES Capital markets, including but not limited to the Bangko Sentral ng Pilipinas, Securities and Exchange Commission, Philippine Stock Exchange, Philippine Dealing and Exchange Corporation, Philippine ‘Securities Settlement Corporation, and Philippine Depository and Trust Corporation; Water supply and sanitation services and facilities, including waste disposal services, as well as property management and building utility services; Energy and power companies, their third-party contractors and service providers, including employees involved in electric transmission and distribution, electric power plant and line maintenance, electricity market and retail suppliers, as well as those involved in the exploration, operations, trading and delivery of coal, oil, crude or petroleum and by-products (gasoline, diesel, liquefied petroleum gas, jet oil, kerosene, lubricants), including gasoline stations, refineries and depots or any kind of fuel used to produce electricity; Telecommunications companies, internet service providers, cable television providers, including those who perform indirect services such ‘as the technical, sales, and other support personnel, as well as the employees of their third-party contractors doing sales, installation, maintenance and repair works; Airline and aircraft maintenance, pilots and crew, and employees of aviation schools for purposes of the pilot's recurrent training for proficiency and type rating using simulator facilities; and ship captains and crew, including shipyard operations and repair; Manufacturing companies and suppliers of equipment or products necessary to perform construction works, such as cement and steel; ‘The Philippine Postal Corporation, at an operational capacity necessary to maintain the prompt delivery of services to its clients; The Philippine Statistics Authority, at an operational capacity necessary to conduct data gathering and survey activities related to COVID-19 and the registration and implementation of the national identification (ID) system; Business process outsourcing establishments (BPOs) and export-oriented businesses, including mining and quarrying, with work-from-home, on-site or near site accommodation, or point-to-point shuttling ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 7 Sian REPUBLIC OF THE PHILIPPINES ue J INTER-AGENCY TASK FORCE FOR THI xiii, xiv. xv. xvi, xvii IE MANAGEMENT OF EMERGING INFECTIOUS DISEASES arrangements. For this purpose, BPOs and export-oriented businesses, and their service providers, shall be allowed to install, transport and maintain the necessary on-site and work-from-home equipment, deploy their workers under on-site or near-site accommodation arrangements, or provide point-to-point shuttle services from their _near-site accommodations to their offices; Essential projects, whether public or private, such as but not limited to quarantine and isolation facilities for Persons under Monitoring (PUMs), and suspect and confirmed COVID-19 patients, facilities for the health sector including those dealing with PUMs, and suspect and confirmed COVID-19 patients, facilities for construction personnel who perform emergency works, flood control, and other disaster risk reduction and rehabilitation works, sewerage projects, water service facilities projects, and digital works. Priority public and private construction projects, defined as those that refer to food production, agriculture, fishery, fishport development, energy, housing, communication, water utilities, manufacturing, and Business Process Outsourcing (BPOs), shall likewise be allowed to operate in accordance with guidelines issued by the DPWH; Funeral and embalming services. Provided, there is shuttling service and/or housing accommodation for their personnel and staff; Humanitarian assistance personnel from civil society organizations (CSOs), non-government organizations (NGOs), and United ‘Nations-Humanitarian Country Teams, as well as individuals performing relief operations to augment the government's response against COVID-19 and other disasters or calamities that may occur. Provided that they are authorized by the appropriate government agency or LGU; Pastors, priests, rabbis, imams or such other religious ministers whose movement shall be related to the conduct of necrological or funeral rites. In this connection, immediate family members of the deceased who died from causes other than COVID-19 shall be allowed to move from their residences to attend the wake or interment of the deceased upon satisfactory proof of their relationship with the latter and social distancing, measures; Security personnel; ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 8 = REPUBLIC OF THE PHILIPPINES uit } INTER-AGENCY TASK FORCE \ J; FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES nie xviii, Printing presses authorized by the Bureau of Internal Revenue or other appropriate agencies to print official receipts and other accountable forms; xix, Companies engaged in repair and maintenance of machinery and equipment, including those engaged in the repair of computers and household fixtures and equipment; and xx, Real estate activities limited to leasing only; For purposes of the foregoing, transit by permitted persons to and from the above establishments anywhere within the area covered by ECQ shall be allowed. 5, Agencies and instrumentalities of the government, including GOCCs, as well as LGUs, may operate at skeleton workforce in combination with other alternative work arrangements as approved by the head of agency unless a different operational capacity is required in agencies providing health and emergency frontline services, border control, and other critical services. 6. Agencies and their regional offices in the executive branch shall issue accreditation, office or travel orders, to identify their respective skeleton workforces for critical services operating for the duration of the ECQ. Bona fide IDs issued by the respective agencies shall be sufficient for movement within the contained areas. Skeleton workforces may use official agency vehicles. 7. ‘The co-equal or independent authority of the legislature (Senate and the House of Representatives), the judiciary (the Supreme Court, Court of Appeals, Court of Tax ‘Appeals, Sandiganbayan, and the lower courts), the Office of the Ombudsman, and the Constitutional Commissions to operate and accredit their skeleton workforces, or implement any other alternative work arrangements, is recognized. 8. Officials and employees of foreign diplomatic missions and international organizations accredited by the Department of Foreign Affairs (DFA), whenever performing diplomatic functions and subject to the guidelines issued by the DFA, may operate with askeleton workforce. 9. No hotels or similar establishments shall be allowed to operate, except those accommodating the followi ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 9 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES a. For guests who have existing booking accommodations for foreigners as of 17 March 2020 for Luzon and 01 May 2020 for other areas; Guests who have existing long-term bookings; Distressed Overseas Filipino Workers (OFWs) and stranded Filipinos or foreign nationals; 4. Repatriated OFWs in compliance with approved quarantine protocols; e. Non-OFWs who may be required to undergo mandatory facility-based ‘quarantine; and £. Health care workers and other employees from exempted establishments under these Omnibus Guidelines and applicable Memoranda from the Executive Secretary. Provided that in all of the foregoing, hotel operations shall be limited to the provision of basic accommodation services to guests through an in-house skeleton workforce Ancillary establishments within the premises, such as restaurants, cafés, bars, gyms, spas, and the like, shall not be allowed to operate or to provide room service; Provided further, that accommodation establishments may prepare: (a) packed meals for distribution to guests who opt for the same; and (b) food orders for take-out and delivery only. 10, Mass gatherings such as but not limited to, movie screenings, concerts, sporting events, and other entertainment activities, community assemblies, religious gatherings, and non-essential work gatherings shall he prohibited. However, gatherings that are essential for the provision of government services or authorized humanitarian activities shall be allowed, 11, Face-to-face or in-person classes at all levels shall be suspended. 12, Public transportation shall be suspended. This notwithstanding, commissioned shuttle services for employees of permitted offices or establishments, as well as point-to-point transport services provided by the government shall be allowed to operate, giving priority to healtheare workers 13, Law enforcement agencies shall recognize any of the following IDs: (i) IATF IDs issued by the regulatory agencies with jurisdiction over permitted establishments or persons, (OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 10, K. ~ REPUBLIC OF THE PHILIPPINES ie INTER-AGENCY TASK FORCE J; FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES Shormtcet™ (ii) bona fide IDs issued by establishments exempted from the strict home quarantine requirement, or (iii) RapidPass IDs. No other IDs or passes specifically exempting persons from community quarantine shall be required of workers of permitted establishments andor offices without prejudice to requiring the presentation of other documents establishing the nature of their work. 14. The movement of cargo vehicles shall be unhampered. Cargo vehicles as well as vehicles used by public utility companies, BPOs, and export-oriented establishments shall not be subject to an ID system. 15, Government offices and private corporations are encouraged to process payrolls online. Payroll managers, and such other employees shall be allowed to travel to process and print payrolls during ECQ. 16, Other exemptions from the home quarantine requirement through previous IATF resolutions or issuances by the Office of the President shall be honored. SECTION [3] GUIDELINES FOR AREAS PLACED UNDER MODIFIED ENHANCED COMMUNITY QUARANTINE. Areas placed under MECQ shall observe the following protocols: 1. Minimum public health standards shall be complied with at all times for the duration of the MECQ. 2. Strict home quarantine shall be observed in all households, and the movement of all residents shall still be limited to accessing essential goods and services, and for work in permitted offices or establishments or such other activities listed hereunder. 3. Any person below twenty-one (21) years old, those who are sixty (60) years old and above, those with immunodeficiency, comorbidity, or other health risks, and pregnant women, including any person who resides with the aforementioned, shall be required to remain in their residences at all times, except when indispensable under the circumstances for obtaining essential goods and services, for work in industries and offices or such other activities permitted in this Section. (OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE) 11 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES 4, All the following shall be allowed to operate at full operational capacity: a. All establishments or activities permitted to operate or be undertaken under Section 2(4) of these Guidelines; b. Media establishments, without need of PCOO accreditation; c. BPOs and export-oriented establishments, without need to set up onsite or near-site accommodation arrangements; 4. E-commerce companies; ¢. Other postal and courier services, as well as delivery services for articles or products not mentioned under Section 2 of these Omnibus Guidelines; £ Rental and leasing, other than real estate, such as vehicles and equipment for permitted sector: ‘g. Employment activities that involve the recruitment and placement for permitted sectors; and h. Housing services activities, such as but not limited to plumbing, roofing, and electrical works. 5. The following offices, establishments or individuals conducting or providing the following activities or services are allowed to operate at fifty percent (50%) operational capacity, while encouraging work-from-home and other flexible work arrangement, where applicable: 4. Other manufacturing industries classified as beverages, including alcoholic drinks; electrical machinery; wood products and furniture; non-metallic products; textiles and clothing/wearing apparels; tobacco products; paper and paper products; rubber and plastic products; coke and refined petroleum products; other non-metallic mineral products; computers, electronic and optical products; clectrical equipment; machinery and equipment; motor vehicles, trailers and semi-trailers; other transport equipment; and others; ities; b. Flower, jewelry, novelty, antique and perfume shops; and 2. Provided that proper protocols shall be observed, such as social distancing, wearing of face masks and the like. PORE RTT ERS reserene 6. Agencies and instrumentalities of the government, including GOCCs, as well as LGUs may operate at skeleton workforce in combination with other alternative work arrangements as approved by the head of agency unless a different operational capacity is required in agencies providing health and emergency frontline services, border control, and other critical services. ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 13 it 1 REPUBLIC OF THE PHILIPPINES wl Wy J INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES Sanne” 7. Accredited diplomatic missions and international organizations shall be advised to operate under a skeleton workforce, without prejudice to alternative work arrangements as the said missions or organizations may deem proper. 8. Hotels or similar establishments shall not be allowed to operate, except those accommodating the following: a, For guests who have existing booking accommodations for foreigners as of 17 ‘March 2020 for Luzon and 01 May 2020 for other areas; Guests who have existing long-term bookings; Distressed OFWs and stranded Filipinos or foreign nationals; Repatriated OFWs in compliance with approved quarantine protocols; Non-OFWs who may be required to undergo mandatory facility-based quarantine; and £ Health care workers and other employees, whether private or public, from exempted establishments under these Omnibus Guidelines and applicable Memoranda from the Executive Secretary. Provided that in all of the foregoing, hotel operations shall be limited to the provision of basic accommodation services to guests through an in-house skeleton workforce, Ancillary establishments within the premises, such as restaurants, cafés, bars, gyms, spas, and the like, shall not be allowed to operate or to provide room service; Provided farther, that accommodation establishments may prepare: (a) packed meals for distribution to guests who opt for the same; and (b) food orders for take-out and delivery only. 9, Mass gatherings such as but not limited to, movie screenings, concerts, sporting events, and other entertainment activities, community assemblies, and non-essential work gatherings shall be prohibited. Gatherings that are for the provision of critical goverment services and authorized humanitarian activities while adhering to the prescribed minimum health standards shall be allowed. Religious gatherings shall be limited to not more than five (5) persons until otherwise modified through subsequent issuances of the IATF. 10, Face-to-face or in-person classes at all levels shall be suspended. ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 14 INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES KN REPUBLIC OF THE PHILIPPINES &, 11. Public transportation shall be suspended. This notwithstanding, commissioned shuttle services for employees of permitted offices or establishments, as well as point-to-point transport services provided by the government shall be allowed to operate, giving priority to healthcare workers. 12, Private transportation such as company shuttles and personal vehicles utilized by persons authorized outside their residences are allowed subject to the guidelines provided by DOTr. The use of bikes and other non-motorized transportation is strongly encouraged 13. Limited operations in malls and shopping centers shall be allowed, except for leisure establishments and services which shall continue to be closed. Provided, that establishments and services allowed to operate in malls and shopping centers may only operate at a capacity consistent with items (4) and (5) of this Section. Provided, further, those below twenty-one (21) years old, and those sixty (60) years old and above and those with immunodeficiency, comorbidity, or other health risks, and pregnant women, including any person who resides with the aforementioned, may not enter malls and shopping centers except when indispensable under the circumstances for obtaining essential goods and services or for work in establishments located therein. Provided, ‘finally, that such operations must comply with the guidelines of the DTI until otherwise ‘modified through subsequent issuances of the IATF. 14, In addition to those allowed and enumerated construction projects under Section 2 of these Guidelines, other essential and priority public and private construction projects shall be allowed, subject to compliance with the DPWH construction safety guidelines: Provided, however, that small scale-projects as defined by the DPWH shall not be allowed, 15. The following shall not be allowed to operate within an area under MECQ: ‘a, Tourist destinations such as water parks, reservation service and related services; b. Entertainment industries such as cinemas, theaters, and karaoke bars; c. Kid amusement industries such as playroom and kiddy rides; 4. Libraries, archives, museums and cultural centers; Gyms, fitness studios and sports facilities; and Personal care services such as massage parlors, sauna, facial care and waxing ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 18 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES 16. The provisions relative to processing of payrolls, the RapidPass system, use of government owned or hired vehicles and identification cards for humanitarian assistance actors and public and private employees in areas under ECQ shall likewise apply in areas under MECQ, 17 Individual outdoor exercise such as outdoor walks, jogging, running or biking are allowed within MECQ areas. Provided, that the minimum health standards and precautions such as the wearing of masks and the maintenance of social distancing protocols are observed. 18, Other exemptions from the ECQ through previous IATF resolutions or issuances by the Office of the President shall also be applied in MECQ. SECTION [4] GUIDELINES FOR AREAS UNDER GENERAL COMMUNITY QUARANTINE, Areas placed under GCQ shall observe the following protocols: 1. Minimum public health standards shall be complied with at all times for the duration of the GCQ. 2. The movement of all persons in areas placed under GCQ shall be limited to accessing essential goods and services, and for work in the offices or industries permitted to ‘operate hereunder. Provided, that movement for leisure purposes shall not be allowed. 3. Any person below twenty-one (21) years old, those who are sixty (60) years old and above, those with immunodeficiency, comorbidities, or other health risks, and pregnant ‘women, including any person who resides with the aforementioned, shall be required to remain in their residences at all times, except when indispensable under the circumstances for obtaining essential goods and services or for work in permitted industries and offices. 4, Work in all government offices may be at full operational capacity or under such altemative work arrangements as agencies may deem proper in accordance with the relevant rules and regulations issued by the Civil Service Commission (CSC). Provided OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 16 Ci} REPUBLIC OF THE PHILIPPINES. ‘ XS INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES that for offices requiring employees to report physically, commissioned shuttle services ‘as well as point-to-point transport services may be provided. 5. Accredited diplomatic missions and intemational organizations may operate at fifty percent (50%) capacity. Alternative work arrangements such as flexible work ‘arrangements, compressed work week, telework, and telecommuting is strongly ‘encouraged. 6. All permitted establishments and activities under Section 2(4) shall be allowed to operate or be undertaken at full operational capacity: In addition, the following sectors or industries shall be allowed to operate at an operational capacity provided herein: a. Category I Industries - Power, energy, water, and other utilities, agriculture, fishery, and forestry industries, food manufacturing and food supply chain businesses, including food retail establishments such as supermarkets, grocery stores, and food preparation establishments insofar as take-out and delivery services, food delivery services, health-related establishments, the logistics sector, information technology and telecommunication companies, the media, at full operational capacity; b. Category If Industries - Mining and other manufacturing, and electronic commerce companies, as well as other delivery, repair and maintenance, and housing and office services, at anywhere between fifly percent (50%) up to full operational capacity, and without prejudice to work-from-home and other altemative work arrangements; and ¢. Category III Industries - Financial services, legal and accounting, and auditing services, professional, scientific, technical, and other non-leisure services, and other non-leisure wholesale and retail establishments, at fifty percent (50%) operational capacity, and without prejudice to work-from-home and other alternative work arrangements. Specific industries under each category are reflected in a separate document issued by the DTI. 7. Limited operations in malls and shopping centers shall be allowed, except for leisure establishments and services which shall continue to be closed. Provided, that establishments and services allowed to operate in malls and shopping centers may only ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 17 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES operate at a capacity consistent with Section 2(4) of these Omnibus Guidelines. Provided, further, those below twenty-one (21) years old, and those sixty (60) years old and above and those immunodeficiency, comorbidity, or other health risks, and pregnant women, including any person who resides with the aforementioned, may not center malls and shopping centers except when indispensable under the circumstances for ‘obtaining essential goods and services or for work in establishments located therein until otherwise modified through subsequent issuances of the IATF, Provided, finally, that ‘operations of malls and shopping centers are subject to the guidelines of the DTI. 8. All public and private construction projects shall be allowed, but with strict compliance to the construction safety guidelines issued by the DPWH for the implementation of infrastructure projects during the COVID-19 pandemic. 9. Amusement, gaming, and fitness establishments, as well as those in the kids and the tourism industries, and all Category IV industries may not operate. Industries in Category IV are reflected in the DTT issuance mentioned above. 10. No hotels or similar establishments shall be allowed to operate, except those accommodating the following: a, For guests who have existing booking accommodations for foreigners as of 17 March 2020 for Luzon and 01 May 2020 for other areas; Guests who have existing long-term bookings; Distressed OFWs and stranded Filipinos or foreign nationals; Repatriated OFWs in compliance with approved quarantine protocols; Non-OFWs who may be required to undergo mandatory facility-based quarantine; and f, Healthcare workers and other employees from exempted establishments under these Omnibus Guidelines and applicable Memoranda from the Executive Secretary. Provided that in all of the foregoing, hotel operations shall be limited to the provision of basic accommodation services to guests through an in-house skeleton workforce Ancillary establishments within the premises, such as restaurants, cafés, bars, gyms, spas, and the like, shall not be allowed to operate or to provide room service; Provided further, that accommodation establishments (OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 18 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES may prepare: (a) packed meals for distribution to guests who opt for the same; and (b) food orders for take-out and delivery only. 11. Face-to-face or in-person elasses shall he suspended. For Academic Year 2020-201, the following shall be observed for the conduct of classes: For basic education, the Basic Education Learning Continuity Plan of the Department of Education (DepEd) shall be adopted, as follows: i, Opening of classes for the basic education shall be on 24 August 2020 and shall end on 30 April 2021; ii, Opening of private schools will be allowed within the period provided by law, Provided, that school learning continuity plan shall be submitted; no face-to-face classes will be allowed earlier than 24 August 2020; and, from 24 August, face-to-face learning shall only be allowed when the local risk severity grading permits, and subject to compliance with ‘minimum public health standards; iii, Adoption of various learning delivery options such as but not limited to face-to-face, blended leanings, distance learnings, and homeschooling and other modes of delivery shall be implemented depending on the local COVID Risk Severity Classification and compliance with minimum public health standards; and iv. Conduct of curricular and co-curricular activities involving gatherings such as science fairs, showcase of portfolios, trade fairs, school sports, campus journalism, festival of talents, job fairs, and other similar activities is cancelled, except those conducted online. b. For higher education, the recommendations of the Commission on Higher Education (CHED) for higher education institutions (HEIs) shall be adopted, as follows: i. The rolling opening of classes will be based on education delivery mode, compliance with minimum health standards and the situation on the ‘ground: 1. HEIs using full online education can open anytime; 2. HEIs using flexible learning can open anytime in August 2020; ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 19 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES 3. HEls using significant face-to-face or in-person mode can open not earlier than 01 September 2020; 4, No face-to-face or in-person classes until 31 August 2020. Private HEIs are encouraged to change their academic calendar and open in August 2020. 12, Mass gatherings such as but not li and other entertainment acti «to, movie screenings, concerts, sporting events, s, community assemblies, and non-essential work gatherings shall be prohibited. Gatherings that are for the provision of critical govemment services and authorized humanitarian activities while adhering to the prescribed minimum health standards shall be allowed. Religious gatherings shall be limited to not more than ten (10) persons, until otherwise modified through subsequent issuances of the IATF. 13. Outdoor non-contact sports and other forms of exercise such as but not limited to walking, jogging, running, biking, golf, swimming, tennis, badminton, equestrian, and skateboarding are allowed. Provided, that the minimum public health standards such as ‘the wearing of masks and the maintenance of social distancing protocols, and no sharing, ‘of equipment where applicable, are observed. Provided, further, that operations of the relevant clubhouses or similar establishments, if any, shall be limited to basic operations. For this purpose, the prohibition in Section 4(3) does not apply. 14, The road, rail, maritime, and aviation sectors of public transportation shall operate at a reduced operational and vehicle capacity in accordance with guidelines issued by the DOTr. Provided, that in all public transports, a strict one (1) meter distance between passengers shall be observed and appropriate engineering controls shall be in place. SECTION [5] GUIDELINES FOR AREAS PLACED UNDER MODIFIED GENERAL COMMUNITY QUARANTINE. Areas placed under MGCQ shall observe the following protocols: 1, Minimum public health standards shall be complied with at all times for the duration of the MGCQ. 2. All persons shall now be allowed to go outside their residences. (OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 20 REPUBLIC OF THE PHILIPPINES. fur} ; INTER-AGENCY TASK FORCE (a FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES 3. Indoor and outdoor non-contact sports and other forms of exercise such as but not limited to walking, jogging, running, biking, golf, swimming, tennis, badminton, ‘equestrian, and skateboarding are allowed. Provided, that the minimum public health standards such as the wearing of masks and the maintenance of social distancing protocols, and no sharing of equipment where applicable, are observed. 4, Mass gatherings such as but not limited to, movie screenings, concerts, sporting events, and other entertainment activities, community assemblies, and non-essential work gatherings shall be allowed provided that participants shall be limited to fifty percent (50%) of the venue or seating capacity. Religious gatherings shall be allowed under such guidelines as may be declared through subsequent issuances of the IATF. 5. Face-to-face or in-person classes may be conducted in HEIs provided there is strict compliance with minimum public health standards, consultation with local government units, and compliance with guidelines set by CHED. HEI activities that involve mass gathering of students shall continue to be prohibited. For K-12 Basic Education, the Basic Education Learning Continuity Plan of the DepEd shall be adopted. 6. Work in all public and private offices may be allowed to resume physical reporting to work at full operating capacity, with altemative work arrangements for persons who are sixty (60) years old and above, those with immunodeficiency, comorbidity, or other health risks, and pregnant women. 7. The road, rail, maritime, and aviation sectors of publie transportation shall be allowed to operate at the capacity in accordance with guidelines issued by the DOTr. Provided, that in all public transports, a strict one (1) meter distance between passengers shall be observed and appropriate engineering controls shall be in place. 8. Private transportation shall be allowed subject to the guidelines provided by DOTr. 9. All public and private construction projects shall be allowed subject to strict compliance with the construction safety guidelines issued by the DPWH for the implementation of infrastructure projects during the COVID-19 pandemic. ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 21 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES 10. Except as otherwise provided below, all permitted establishments and activities under Category I-IV of Section 4(6) and in pertinent Sections of these Orm shall be allowed to operate or be undertaken at full operational capacity: 1s Guidelines a, Barber shops, salons, and other personal care service establishments, at a maximum of fifty percent (50%) of venue capacity; b, Dine-in service in food retail establishments such as supermarkets, grocery stores, and food preparation establishments, at a maximum of fifty percent (50%) of seating capacity ©. Other Category IV and all other establishments not permitted to operate under previous Sections of these Guidelines, at a maximum of fifty percent (50%) operational capacity. 11, Work in government offices may be at full operational capacity, or under such alternative work arrangements as agencies may deem appropriate in accordance with the relevant rules and regulations issued by the CSC. 12. Accredited diplomatic missions and international organizations may resume full operations, SECTION [6] POST-COMMUNITY QUARANTINE SCENARIO. Areas where no community quarantine is in place can be considered as being under the New Normal. SECTION [7| GUIDELINES FOR INTERZONAL AND INTRAZONAL MOVEMENT, |. The movement of all types of cargoes by land, air, or sea within and across areas placed under any form of community quarantine shall be unhampered. Workers in the logistics sector, such as cargo, trucking, courier delivery and port operations shall likewise be allowed to transit across areas placed under any form of community quarantine. All LGUs are directed to strictly abide by this national policy. Provided, that only a maximum of five (5) personnel may operate cargo and delivery vehicles by land, with or without load. LGUs and local health units (LHUs) are hereby enjoined not to issue orders contrary to or inconsistent with said directive, such as, but not limited to, requiring asymptomatic ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 22 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES drivers and crew of cargo or service delivery vehicles to undergo mandatory fourteen (14)-day home quarantine. Provided, further, that strict social distancing measures must be observed, which may include, if necessary, the putting up of additional safe and humane seats or space in the vehicles. Provided, finally, that the PNP retains its authority to conduct inspection procedures in checkpoints for the purpose of ensuring that protocols on strict home quarantine are observed. 2. The movement as such of the following persons within and across areas placed under any form of community quarantine shall be permitted: (1) health and emergency frontline services personnel, (2) government officials and goverment frontline personnel, (3) duly-authorized humanitarian assistance actors (HAAs), (4) persons ‘traveling for medical or humanitarian reasons, (4) persons going to the airport for travel abroad, (5) returning or repatriated OFWs and other Overseas Filipinos (OFs) returning to their places of residence, (6) other persons transported through the efforts of the national government upon observance of the necessary quarantine protocols and with the concurrence of the receiving LGUs, and (7) anyone crossing zones for work permitted in the zone of destination, and going back home. Authorized shuttle services shall be allowed to travel within and across areas placed under any form of community quarantine, with priority given to persons rendering health and emergency frontline services. Land, air or sea travel by uniformed personnel, government officials and employees for official business with the corresponding travel authority, and authorized HAAs, especially those transporting medical supplies and laboratory specimens related to COVID-19, and other relief and humanitarian assistance, shall be allowed. OFWs, students enrolled abroad and participants accepted in exchange visitor programs, permanent residents of foreign jurisdictions, and stranded foreign nationals, or those leaving for medical and other humanitarian reasons may leave for abroad through any of the airports or seaports in the country. Provided that this provision shall not be interpreted to allow outbound travel by Filipinos to countries where travel restrictions are in place. Provided, further, that departing passengers may be accompanied by not ‘more than one (1) person when traveling to any international port, who shall be allowed to return to his/her point of origin. ‘OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 28 i. ‘i REPUBLIC OF THE PHILIPPINES iy j INTER-AGENCY TASK FORCE \ »/ FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES Misco? ‘OFWs whether land-based or sea-based shall be allowed to be deployed abroad upon the execution of a Declaration signifying their knowledge and understanding of the risks involved as advised by the Philippine Government. For this purpose, recruitment and placement agencies shall likewise be allowed to operate in areas under MECQ, GCQ or MGCQ, subject to the observance of minimum health standards. Further, goverment offices and agencies involved in the processing of their deployment are hereby directed to establish “Green Lanes” to enable their prompt processing and deployment. Further still, to facilitate the ease of deployment, the OFWs and employees of these recruitment and placement agencies shall be allowed unhampered transit to and from appropriate government offices during MECQ, GCQ or MGCQ for the processing of their requirements and facilities such as airports, ferries, bus terminals, etc., notwithstanding any Local Government Unit pronouncement to the contrary. The said free access shall extend to the vehicles carrying the aforementioned individuals in order for them to reach their final destination. No fee or any other requirement shall be imposed by LGUs in this regard, Repatriated OFWs or returning non-OFWs who have been issued a DOH or LGU certificate of completion of fourteen (14)-day facility-based quarantine, those who may be required to undergo a mandatory fourteen (14)-day home quarantine, or those who are issued with travel authority upon testing negative for COVID-19 whichever is earlier, shall be granted unhampered transit across zones en route to their final destination in the Philippines. For this purpose, LGUs are enjoined to allow maritime vessels or aircraft transporting the aforementioned OFWs and non-OFWs to dock or land at their ports of destination. No other requirement shall be imposed by LGUs in this, regard. ‘The interzonal movement of persons between areas placed under GCQ and MGCQ for any purpose other than leisure shall be permitted. 4. Movement to and from an area placed under GCQ to an area where no community quarantine is in place shall be permitted, except for the sole purpose of leisure. The movement of persons for any purpose across areas placed under MGCQ and areas where no community quarantine is in place shall be permitted. SECTION [8] GENERAL PROVISIONS (OMNIBUS GUIDELINES ON COMMUNITY QUARANTINE] 24 INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES San REPUBLIC OF THE PHILIPPINES wd Wagan 1. LGUs are enjoined to enact the necessary ordinances to enforce curfew only for non-workers in jurisdictions placed under MECQ, GCQ and MGCQ to penalize, in a fair and humane manner, violations of the restrictions on the movement of people as provided under these Omnibus Guidelines. Law enforcement agencies, in implementing and enforcing said curfew ordinances, are likewise strongly enjoined to observe fair and human treatment of curfew violators, 2. As a matter of declared national policy and pursuant to paragraphs (aa) and (bb), Section 4 of the Republic Act No. 11469, all banks, quasi-banks, financing companies, lending companies, and other financial institutions, public and private, including the Goverment Service Insurance System, Social Security System and Pag-ibig Fund, are directed to implement a minimum of a thirty (30)-day grace period from due date or until such time that the ECQ or MECQ is lifted, whichever is later, for the payment of all loans, including but not limited to salary, personal, housing, and motor vehicle loans, as well as credit card payments, falling due within the period of ECQ and MECQ, and without incurring interests, penalties, fees, or other charges. Persons with multiple loans shall likewise be given a minimum thirty (30)-day grace period from due date o until such time that the ECQ or MECQ is lifted, whichever is later, for every loan. For residential and commercial rents falling due within the duration of the ECQ, MECQ, and GCQ, on residential lessees and micro-, small, and medium enterprises (MSMES) and sectors not permitted to operate during said period, a grace period of thirty (30) days from the last due date or until such time that the community quarantine is lifted, shall be observed, whichever is longer, without incurring interests, penalties, fees, or other charges. ‘The foregoing rules on grace periods shall have retroactive effect starting 17 March 2020 in areas where the applicable community quarantine had been declared. 3. The operation of industries and establishments identified in preceding sections are subject to the visitorial and enforcement powers of the Department of Labor and Employment and Department of Trade and Industry and other appropriate agencies to censure compliance with these Omnibus Guidelines especially the compliance with the provisions on maximum allowable operational capacity in establishments, as well as mum public health standards and protocols 4, National govemment agencies and instrumentalities including GOCCs and LGUs shall adopt measures lawful and necessary to implement and enforce the minimum public ‘OMNIS GUIDELINES ON COMMUNITY QUARANTINE] 25 REPUBLIC OF THE PHILIPPINES INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF EMERGING INFECTIOUS DISEASES health standards as defined herein. Such measures shall be in accordance with the minimum health standards set by DOH and other relevant national agencies, and shall not be unreasonable or unduly burdensome. However, the private sector is encouraged to adopt stricter health standards concerning their own operations. Compliance of private sector establishments with the Joint DTI-DOLE Return-to-Work Guidelines, DOH Retun-to-Work Guidelines, and guidelines issued by the aforementioned appropriate sector-relevant national government agency, including their future amendments, shall be considered sufficient compliance with minimum public health standards. In accordance with DOH Department Memorandum No. 2020-0220, the testing of all returning employees of a private sector entity shall not be required as a condition precedent for their operation. In no case shall the testing of all returning workers be construed as @ condition precedent for his/her return, 5. All persons are mandated to wear face masks, earloop masks, indigenous, reusable, do-it-yourself masks, or face shields, handkerchiefs, or such other protective equipment ‘or any combination thereof, which can effectively lessen the transmission of COVID-19, whenever they go out of their residences, pursuant to existing guidelines issued by the national government subject to fair and humane penalties or punishments that may be imposed by LGUs or implemented by law enforcement agencies, respectively. LGUs are hereby enjoined to use IATF-endorsed contact tracing and contact: monitoring applications (StaySafeph and TenodCOVID) where they are available, or use ‘community-based contact tracing and contact monitoring. Concemed LGUs are hereby enjoined to issue the necessary executive order or ordinance to this effect. 6. Supermarkets, public and private wet markets, grocery stores, agri-fishery supply stores, veterinary supply stores, pharmacies, drug stores, and other retail establishments ‘engaged in the business of selling essential goods are strongly encouraged to extend their store operations to a maximum of twelve (12) hours. LGUs are directed to allow such establishments to operate pursuant to the foregoing. Provided that in the operation of wet markets, LGUs are encouraged to adopt reasonable schemes to ensure compliance with strict social distancing measures, such as, but not limited to, providing for specific daily schedules per sector, barangay, or purok, as the case may be. Smalt-scale projects are defined as those construction projects which are intended for private and personal use, and because of scale, would not be able to or would impractically be unable to comply with the herein Revised Construction Safety Guidelines in areas under ECQ, MECQ, GCQ, and MGCQ. ©. Areas under General Community Quarantine (GCQ) or Modified General Community Quarantine (M6CQ) All public and private construction projects shall be allowed, subject to strict compliance with the herein Revised Construction Safety Guidelines. III. REVISED CONSTRUCTION SAFETY GUIDELINES FOR THE IMPLEMENTATION OF INFRASTRUCTURE PROJECTS DURING THE COVID-19 PUBLIC HEALTH CRISIS A. Prior to Deployment 1, Any person below twenty-one (21) years old, those who are sixty (60) years old and above, those with immune deficiencies, comorbidities, or other health risks, and pregnant women, including those who reside with the aforementioned, shall not be part of the workforce for construction projects except as may be allowed under the Revised Omnibus Guidelines issued by the IATF. 2. Construction personnel shall undergo quarantine for fourteen (14) days prior to deployment; or in the altemative, the employee may undergo any available Food and Drug Administration (FDA) - approved COVID-19 test, as may be prescribed by the Department of Health (DOH), and be retested as the need arises. In this regard, consultation with medical doctors (duly accredited by DOH, if possible) prior to the conduct of COVID-19 test shall be made. Further, COVID-19 test procedures and return-to-work policies of the contractors should comply with DOH Circular No. 2020-0160 dated 31 March 2020, Department Memorandum No. 2020-0220 dated 11 May 2020, and other pertinent issuances of the DOH on the matter. Concessionaires, contractors, and subcontractors shall provide disinfection facilities at their respective project sites in compliance with pertinent DOH and IATF Guidelines, to be placed at strategic locations to ensure the safety and welfare of all personnel. 6. Proper information dissemination regarding COVID-19 construction protocols, on top of existing construction safety practices, shall be conducted by Safety Officers to all personnel. . During Deployment 1. Conduct an inventory of works for the construction sequencing to be followed and undertaken to uphold the required social distancing. Break times shall be conducted in a staggered manner. 2. Employees shall be housed in their respective quarters for the entire duration of the project covered by the ECQ, MECQ, GCQ, and MGCO. In case there is a need to leave the said quarters during the project duration, “Prior to Deployment” procedures shall be Conducted at every instance of re-entry, 3. Errands to be conducted outside the construction site premises shall be kept to a minimum. Number of personnel running errands shall be limited and shall be properly disinfected and closely monitored for symptoms within fourteen (14) days upon re-entry. 4, Field offices, employees’ quarters, and other common areas shall be regularly maintained, including the daily disinfection of such facilities. 5. Adequate food, safe/potable drinking water, disinfectants, and hand soaps shall be made available by the concessionaires, contractors, subcontractors, and suppliers to their in- house personnel. 6. Daily monitoring of the pre and post-work health conditions of workers shall be undertaken by the concessionaires, contractors, subcontractors, and suppliers, including but not limited to temperature, health, and exposure monitoring, as preventive measures. No. 13, Series of 1998 and the DTI and DOLE Interim Guidelines on Workplace Prevention and Control of COVID-19 with regard to the wearing of additional personal protective equipment (PPE) required such as, but not limited to, face masks, safety glasses/goggles, face shields, and long sleeve T-shirts, and other measures to contain the. spread of COVID-19 in the workplace, as provided in these Guidelines. 9. For off-site employees’ quarters, transport service, duly disinfected before and after use, shall be provided, and social distancing shall ikewise be observed therein at all times in accordance with DOTr guidelines. 10. Sharing of construction and office equipment is discouraged. However, if necessary, the shared equipment must be disinfected in between transfers amongst personnel. 11, All material and equipment delivery and disposal shall be conducted by a specific team of personnel on an isolated loading/unloading zone while limiting contact with the delivery/disposal personnel. All material and/or equipment entering the construction site shall be duly disinfected as much as possible, 12, Non-essential personnel, visitors, and the general public shall be restricted to enter the construction site, employees’ quarters, and field offices. Otherwise, all personnel entering the construction site premises on a temporary basis (e.g. delivery truck drivers, inspectors, etc.) shall be properly logged and checked for symptoms. Gatherings, liquors, and/or merry-making are strictly prohibited within the construction site premises. 13, Clustered and staggered deployment of employees within the construction site shall be observed to minimize personnel contact and for easier contact tracing. 14, Proper waste disposal shall be provided for infectious waste such as PEs and other waste products coming from outside the construction premises. MONITORING and ENFORCEMENT: A. For infrastructure projects implemented by other national government agencies, Government-Owned and Controlled Corporations (GOCC), and other government instrumentalities, the head or representative of the agency, GOCC, or government instrumentality concerned shall monitor compliance with these Guidelines and issue QPs to the individual qualified personnel of the concessionaires, contractors, subcontractors, and suppliers based on the list submitted and certified by the said concessionaires, contractors, subcontractors, and suppliers. . For monitoring purposes, personal records and health report of all personne! necessary for contact tracing shall be submitted by the concessionaires, contractors, subcontractors, and suppliers to the DPWH 10, LGU, or Implementing Government Agency, Instrumentality or GOCC, as the case may be, and shall be resubmitted and updated monthly, or as the need arises (Copies of the monitoring forms are attached hereto as Annexes “B” and "C”). . Termination of contract for breach thereof resulting to default pursuant to Item III (A) (2) (©) (i), Annex I of the Implementing Rules and Regulations of Republic Act No, 9184 in relation to Section 37.2.3 of the same, which provides that bidding documents requiring bidders to know and be familiar with all existing laws, decrees, ordinances, acts, and regulations, including the Department Orders of DPWH, shall form part of the contract awarded, and refusal or failure to comply with the valid instruction of DPWH, as the procuring entity, shall justify the contract's termination; B, Contract termination/rescission under Section 12.21 (b) of the Implementing Rules and Regulations of Republic Act No. 6957, as amended by Republic Act No. 7718 (BOT Law); C. No: __; Page No.__; Book No.__; Series of 2020. cpp RESOLUTION NO. 09-2020 APPROVING MEASURES FOR THE EFFICIENT CONDUCT OF PROCUREMENT ACTIVITIES DURING A STATE OF CALAMITY, OR IMPLEMENTATION OF COMMUNITY QUARANTINE OR SIMILAR RESTRICTIONS WHEREAS, Republic Act (RA) No. 9184, otherwise known as the “Government Procurement Reform Act’, took effect on 26 January 2003, while its 2016 revised Implementing Rules and Regulations (IRR) took effect on 28 October 2016; WHEREAS, Section 63 of RA No. 9184 and its 2016 revised IRR authorizes the Government Procurement Policy Board (GPPB) to formulate public procurement policies, tules and regulations, and amend its IRR, whenever necessary; WHEREAS, Sections 37 and 38 of RA No. 9184 provides that the Head of the Procuring Entity (HoPE) has a fifteen-day (15 day) period to approve the recommendation of the award by the Bids and Awards Committee (BAC) as well as issue the Notice of Award and has a three-month (3-month) period within which to complete the procurement process from the opening of bids up to the award of contract, respectively; WHEREAS, the recommended earliest possible time and maximum period allowed for the procurement of goods and services, infrastructure projects and consulting services are in Annex “C’ of the 2016 revised IRR of RA No. 9184 pursuant to the specific provisions on each procurement activity provided for by the foregoing law and rules; WHEREAS, the Supreme Court held in the case of Reynaldo M. Jacomille v. Hon. Joseph Emilio A. Abaya, et al,’ that the different periods provided by RA No. 9184 within which certain stages of the procurement process must be completed is not merely directory but mandatory; Whereas, Section 39 of RA No. 9184, requires the winning bidder to post a performance security prior to the signing of the contract as a measure of guarantee for the faithful performance of and compliance with his obligations under the contract. Section 39.2 of its IRR prescribes that the allowable forms of performance security shall be: (i) Cash or cashier'sImanager's check issued by @ Universal or Commercial Bank; (ji) Bank draftiguarantee or irrevocable letter of credit issued by @ Universal or Commercial Bank; or (ii) Surety bond; Whereas, Section 25.1 of the 2016 revised IRR of RA No. 9184 provides that bidders shall submit their bids through their duly authorized representative using the forms specified in the Bidding Documents in two (2) separate sealed bid envelopes, and which shall be submitted simultaneously, The first shall contain the technical component of the bid, including the eligibility requirements and the second shall contain the financial component of the bid; Whereas, Section 8.1.1 of the 2016 revised IRR of RA No. 9184 provides that the Philippine Government Electronic Procurement System (PhilGEPS) shall serve as the primary and definitive source of information on government procurement while the GPPB is authorized to approve changes in the procurement process to adapt to improvements in modern technology pursuant to Section 8.3.2 of the same IRR; "GR, No, 212861, Api 22, 2015 GPPB Resolution No. 09-2020, dated 7 May 2020 page 1 of 17 WHEREAS, on 8 March 2020, the President signed Proclamation No. 922 declaring a State of Public Health Emergency throughout the Philippines following the confirmed local transmission of the novel coronavirus disease (COVID-19). Consequently, a Memorandum from the Office of the Executive Secretary’ was issued implementing community quarantine over the entire National Capital Region and implementing alternative work arrangements, among others; WHEREAS, given the COVID-19 pandemic, the GPPB issued Resolution No. 03- 2020* allowing Procuring Entities (PEs) to apply the rules on Negotiated Procurement (Emergency Case) during a State of Calamity and simplifying the process therefor. This was followed by more issuances such as GPPB Resolution No. 05-2020* and GPPB-TSO Non- Policy Matter Opinion (NPM) No. 03-2020° which enable PES to efficiently and expediently undertake procurement during a State of Calamity; WHEREAS, on 16 March 2020, due to the rapid increase of cases of infection in the country, the President signed Proclamation No. 929 declaring a State of Calamity throughout the Philippines for a period of six (6) months or up to 12 September 2020, unless lifted earlier or extended as circumstances may warrant, and further providing for the implementation of “Enhanced Community Quarantine (ECQ)" over the entire Luzon until 12 April 2020. Following this, a Memorandum Ciroular® was issued by the Executive Secretary implementing, among ‘others, work from home arrangement for the Executive Branch and the suspension of mass public transport services and other businesses that do not render critical services; ‘WHEREAS, on 24 March 2020, the President signed RA No. 11469 or the Bayanihan to Heal as One Act, which granted the President temporary emergency powers to address the national emergency brought about by the COVID-19 pandemic. Afterwards, this was superseded by Executive Order No. 112,"* wherein the President specifically identified areas under ECQ and General Community Quarantine and announced that no LGU shall declare its own community quarantine without observing the procedures set forth by the IATF; WHEREAS, the GPPB-TSO recognizes that apart from conducting emergency procurement, PEs are likewise undertaking the procurement of Goods, Infrastructure and Consulting Services not related to the COVID-19 pandemic through public bidding or any of alternative modes of procurement, the conduct of which are equally important to ensure Continuous delivery of public services and support the government during the State of Calamity; WHEREAS, given the exceptional circumstances brought about by the COVID-19 pandemic, particularly the ECQ and the suspension of mass public transport services, both the PEs and Bidders are finding it hard to continue with the conduct of procurement activities and thus, PEs are at risk of exceeding the maximum calendar days allowed for specific procurement activities; WHEREAS, in consideration of the foregoing and after careful review and deliberations, the Board resolved, upon recommendation of the GPPB-TSO, to adopt the below-described measures for the efficient conduct of procurement activities during a State of Calamity, or implementation of community quarantine or similar restrictions; NOW, THEREFORE, for and in view of all the foregoing, We, the Members of the Government Procurement Policy Board, by virtue of the powers vested on Us by law and other executive issuances, hereby RESOLVE to confirm, adopt, and approve, as We hereby confirm, adopt, and approve the following measures, as recommended by the GPPB-TSO, for the efficient conduct of all procurement activities, regardless of procurement modality, during a nationally or locally declared State of Calamity arising from natural or human-induced hazard that may cause loss of life, injury or other health effects or impacts, property damage, loss of livelihood and services, social and economic disruption, or environmental damage, or implementation of community quarantine, or similar restrictions where movement of people and mass public and private transport are limited: 1, PEs to ASSESS AND REVIEW all of their planned and ongoing procurement for the fiscal year 2020 and identify which shall be discontinued or terminated pursuant to the DBM NBC No. 580 and other subsequent similar issuances. ENJOIN PEs to maximize the use of existing rules under RA No. 9184, its IRR and related issuances on the conduct of procurement activities, particularly those meant to streamline, simplify and expedite the conduct of procurement and address the challenges and disruptions brought by calamities and crisis such as the COVID-19 pandemic, such as use of videoconferencing, webcasting and similar technology in the conduct of any of the meetings and determination of quorum by the BAC"® and use of digital signatures in procurement related documents;"° 3. In order to complement these, ALLOW the (i) submission of procurement related documents, except for the submission and receipt of bids, through electronic mail or facsimile subject to the submission of the printed copies as soon as practicable, as determined by the Bids and Awards Committee (BAC); and (ji) use of other forms of digital or electronic signature in all procurement related documents, For this purpose, PEs shall establish their respective internal rules to ensure the security, integrity and authenticity of the documents electronically submitted and the use of digital or electronic signature. ‘These measures shall be allowed at any time, not just during a State of Calamity, or implementation of community quarantine or similar government restrictions. 4, Inlight of the unavailability of the online bidding facility under the modemized Philippine Government Electronic Procurement System (mPhilGEPS), AUTHORIZE the online or electronic submission and receipt of bids for procurement modalities where a two- envelope procedure or sealed price quotation is required. The BAC shall decide whether to allow the online or electronic submission and receipt of bids based on the PE's procurement needs and capabilities 4.1 The GPPB Online Portal established under Item 9.0 of the GPPB Circular No. 41-2020" shall be further developed to allow for the online submission and receipt of bids. The GPPB Online Portal shall ensure the security, integrity and confidentiality of the bids submitted and generate an audit trail of transactions for the security, integrity and authenticity of the bid submissions. The GPPB-TSO shall issue the procedure for the use of the GPPB Online Portal for the online submission and receipt of bids, once it becomes operational. 4.2 Bid submission may be done through any electronic means available to the PEs, provided that the same: @. uses a two-factor security procedure consisting of an archive format compression and password protection to ensure the security, integrity and confidentiality of the bids submitted; b. allows access to a password-protected Bidding Documents on opening date and time. The passwords for accessing the file will be disclosed by the Bidders only during the actual bid opening which may be done in person or face-to-face through videoconferencing, webcasting or similar technology; and "© GPPB Resolution No. 24.2018 dated 4 December 2018 ° GPPS Resolution No. 16-2019 dated 17 July 2019. For this purpose, the highest official managing the Information Technology system of the agency shall issue a Certification describing the electronic system or procedure to be used by the PE for the electronic submission and receipt of bids and a statement that the same is compliant with the foregoing requirements. The said Certification shall be submitted to the GPPB-TSO through ITcertification@gppb.gov.oh prior to posting of the Bidding Documents allowing for electronic submission and receipt of bids. 5. Moreover, PEs shall ensure ADOPTION of the following procedure for online or electronic bid submission: 5.1 The Invitation to Bid, including the Bidding Documents shall clearly state whether the PE shall allow the submission and receipt of bids through electronic means; 5.2 Bidders shall submit their Bids through any of the abovementioned online or electronic facilities at any time before the closing date and time specified in the Bidding Documents; 5.3 Upon receipt of the first and second envelopes, PEs shall generate a Bid receipt page for the official time of submission which can be saved or printed by the bidder; and 5.4 As with manual submission, Bidders may modify or withdraw their Bid at any time before the deadline for the submission and receipt of bids. Where a bidder modifies its Bid, it shall not be allowed to retrieve its original Bid and shall only be allowed to submit another. For electronic bid submission, Bidders shall send another Bid equally secured, properly identified, and labelled as a “modification” of the one previously submitted. The time indicated in the latest Bid receipt page generated shall be the official time of submission. Bids submitted after the deadline shall not be accepted. The use of the aforesaid online or electronic bid submission shall be allowed until such time as the online bidding facility under the mPhiIGEPS becomes fully operational. For this purpose, the PhilGEPS shall submit to the GPPB-TSO the proposed guidelines for the use of the online bidding facility during its testing stage to ensure the timely review and approval of the Board. 6. In consideration of the limited access to financial institutions, regulatory and other offices, as well as the implementation of government restrictions on transport and travel, ALLOW PEs to accept the following alternate documentary requirements for procurement activities during a State of Calamity, or implementation of community ‘quarantine or similar restrictions declared or being implemented either in the locality of the PE or of the Bidder: 6.1 Unnotarized Bid Securing Declaration; 6.2 Expired Business or Mayor's permit with Official Receipt of renewal application, subject to submission of Business or Mayor's permit after award of contract but before payment; GPPB Resolution No. 09-2020, dated 7 May 2020 page 5 of 17 6.3 Unnotarized Omnibus Sworn Statement subject to compliance therewith after award of contract but before payment; and 6.4 Performance Securing Declaration (PSD) in lieu of a performance security to guarantee the winning bidder's faithful performance of obligations under the contract, subject to the following: a. Similar to the PSD used in Framework Agreement, such declaration shall state, among others, that the winning bidder shall be blacklisted from being qualified to participate in any government procurement activity for one (1) year, in case of first offense or two (2) years, if with prior similar offense, in the event it violates any of the conditions stated in the contract. A copy of the PSD form is attached hereto as Annex "A"; b. Anunnotarized PSD may be accepted, subject to submission of a notarized PSD before payment, unless the same is replaced with a performance security in the prescribed form, as stated below; and ©. The end-user may require the winning bidder to replace the submitted PSD with a performance security in any of the prescribed forms under Section 39.2 of the 2016 revised IRR of RA No. 9184 upon lifting of the State of Calamity, or community quarantine or similar restrictions, as the case may be. The BAC shall determine or validate the existence of the State of Calamity, or implementation of community quarantine or similar restrictions and may require the submission of documentary proof for this purpose. 7. ALLOW the BAC to suspend the conduct of procurement activities adversely affected or interrupted by the declaration of a State of Calamity, or implementation of community quarantine or similar restrictions at any time during the existence of such calamity, or quarantine or similar restrictions, and when it has assessed or determined that: 7.1. No Bidder will be able to submit a Bid or comply with the requirements of the procurement rules due to the limitations resulting from the declaration of a State of Calamity, or implementation of a community quarantine or similar restrictions; or 7.2 The conduct of procurement activities cannot be undertaken without endangering the health and welfare of its personnel despite the work from home or other alternative work arrangements. In case of suspension, the BAC shall notify all prospective bidders and post a notice on the PE’s website, if any. The notice shall include the suspension of the conduct of procurement activities for a specific Procurement Project,"® its estimated date of resumption and all the implications of such suspension which shall include, but not limited to the fixed price rule in procurement, extension of the bid validity and security, validity of the eligibility requirements prior to the award of contract, conditions of award, and revised date of delivery. ‘As dotined under GPPB Circular No, 06-2019 dated 17 July 2019, a Procurement Project shall refer toa spect or identified procurement covering goods, infrastructure projector consulting services. GPPB Resolution No. 09-2020, dated 7 May 2020 page 6 of 17 Given the COVID-19 pandemic, PEs may retroactively suspend the conduct of procurement activities beginning 9 March 2020 following the declaration by the President of a State of Public Health Emergency throughout the Philippines, subject to the determination by the BAC of the existence of any of the grounds for the suspension of the conduct of procurement activities and compliance with the notice requirement. ALLOW the subsequent tolling of the periods for the Procurement Projects covered by the suspension, including the running of the 3-month period to award the contract and terminate the procurement process under Section 38 of RA No. 9184, during the suspension of the conduct of procurement activities, as determined by the BAC. The suspension of the conduct of procurement activities shall be lifted upon determination of the BAC that the basis for the suspension no longer exists or upon the lifting of the State of Calamity, or implementation of community quarantine or similar restrictions, as the case may be. In which case, the BAC shall notify all affected bidders of the lifting of the suspension and post a notice on the PE’s website, if any. The period for the conduct of procurement activities shall run again upon posting of the notice of resumption of procurement activities on the website of the PE, if any, or in the absence thereof, any conspicuous place in the premises of the PE. The PE shall likewise inform the affected bidders of the resumption of procurement activities for the participation and/or compliance, as the case may be. ‘The period of action on procurement activities shall not commence anew but rather, grants the PE the balance of the remaining period available for the conduct of procurement activities which has been tolled or suspended. Without prejudice to Section 35.1 of the 2016 revised IRR of RA No. 9184, ALLOW the BAC, upon consultation with the end-user unit, to cancel or terminate the conduct of procurement activities for any justifiable reason, such as but not limited to: 9.1. the physical and economic conditions have significantly changed so as to render the project no longer economically, financially, or technically feasible, as determined by the end-user unit; 9.2. the project is no longer necessary as determined by the end-user unit; 9.3 the source of funds for the project has been withheld or reduced through no fault of the PE; or 9.4 brought about by the declaration of a State of Calamity, or implementation of community quarantine or similar restrictions. The cancellation or termination authorized herein shalll be allowed at any time, not just during a State of Calamity, or implementation of community quarantine or similar government restrictions. A copy of the relevant provisions and guidelines on submission and receipt of bids as well as on suspension and termination that are amended as a consequence of the foregoing is attached as Annex “B” and made an integral part hereof. Submission and Receipt of Bids 25.1. Bidders shall submit their bids through their duly authorized representative using the forms specified jin the Bidding Documents in two (2) separate sealed bid envelopes, or two (2) password-protected Bidding Documents in compressed archive folders, in case of electronic bid submission, and which shall be submitted simultaneously. The first shall contain the technical component of the bid, including the eligibility requirements under Section 23.1 of this IRR for the procurement of Goods and Infrastructure Projects, and the second shall contain the financial component of the bid, 25.6 Bids, including the eligibility requirements under Section 23.1 of this IRR, submitted after the deadline shall not be accepted by the BAC. The BAC shall declare the bidding a failure when: a) No bids are received; b) All prospective bidders are declared ineligib ¢) All bids fail to comply with all the bid requirements or fail post- qualification, or, in the case of Consulting Services, there is no successful negotiation; or The bidder with the LCRB, HRRB, SCRB or SRRB refuses, without justifiable cause, to accept the award of contract, and no award is made in accordance with Section 40 of the Act and this IRR. a) Section 35. Failure of Bidding (NEW) Section 35.6 Without prejudice to Sec. 35.1 hereof, the BAC is authorized, upon consultation with the end-user unit, to cancel or terminate the conduct of procurement activities, for any justifiable reason, such as but not limited to: a) the physical and economic conditions have significantly changed so as to render the project no longer economically, financially, or technically feasibi as determined by the end-user unit; the project is no longer necessary determined by the end-user unit; the source of funds for the project has been withheld or reduced through no fault of the PE; or brought about by the declaration of a State of Calamity, or implementation of community quarantine or similar restrictions. Section 38. Period of Action on Procurement Acti 38.1. The procurement process from the opening of bids up to the award of contract shall not exceed three (3) months, or a shorter period to be determined by the Procuring Entity concerned. The period of action on procurement activities shall not commence anew but rather, grants the PE the balance of the remaining period available for the conduct of procurement activities which has been tolled or suspended.
