AFFIDAVIT OF UNDERTAKING

I MARY MHEL V. ERILLO of legal age, TREASURER as evidenced by the Board Resolution and Secretary’s
Certificate attached herewith as Annexes A and B, respectively, acting as the duly authorized
representative of DATAGEN FACILITIES,OPC after having been sworn in accordance with the law, hereby
declare that:

1. The aforementioned company with business address at 5F 3216 KALAYAAN AVE BRGY
PINAGKAISAHAN MAKATI CITY is not a gaming company, it is not engaging in any gaming-related
activities nor operating in support of any gaming related activity whatsoever.

2. In the event the City Government of Makati finds any violation and/or falsification pf sworn
documents and any public documents attached herewith, the City or it’s duly authorized agents
are hereby authorized to immediately revoke all permits and clearances issued in favor of the
company to operate business at the specified location above, without prejudice to the final
results of a subsequent investigation to be conducted by the City Government of Makati or any
of its designated department, agency or instrumentality regarding the falsity. Further, without
prejudice to any subsequent charges that may be filed by the City government of Makati against
the company and its board of directors and officers responsible for the violation and/or
falsification;

3. The city of any of its duly authorized agents are hereby authorized to immediately and
unilaterally close the establishment and/or business without need of any judicial or formal
declaration in case the city finds us engaged in any gaming-related activities or in violation of
any laws, city ordinances, city resolutions, rules and regulations, without prejudice to the final
results of a subsequent investigation to be conducted by the City Government of Makati or any
of its designated department, agency or instrumentality regarding the falsity. Further, without
prejudice to any subsequent charges that may be filed by the City Government of Makati against
the company and its board of directors and officers responsible for the violation and/or
falsification;

4. The subject company/establishment, its officers and employees shall hold the City of Makati, its
agents and representatives free and harmless from any and all liabilities; and

5. I am executing this affidavit to attest to the truth of the foregoing facts an in compliance with
the requirements of the City Government of Makati and for whatever legal intents and purposes
this may serve.
