That more than one offense is charged except when a
single punishment for various offenses is prescribed
by lae;
That the criminal action or liability has been
extinguished;
That it contains averments which, if true, would
constitute a legal excuse or justification; and
That the accused has been previously convicted or
acquitted of the offense charged, or the case against
him was dismissed or otherwise terminated without his
express consent.
a. ARRAIGNMENT
Judge: “Where is the accused?”
The accused will stand up, identify himself by raising
his right hand.
After that, the judge will also ask:
Judge: “where is the complaining witness?”
He will also rise, identify himself by raising his
Judge: “Appearances”
The public prosecutor will enter his
appearance as follow:
“For the State, your Honor”; or
‘For the Government, your Honor”; or
“For the people, your Honor, ready”.
The private prosecutor (a lawyer hired by the
complaining witness (aggrieved party) who will assist the
public prosecutor in prosecuting the case) will enter his
appearance, as follows:
“Good morning, your Honor. Respectfully
appearing as private prosecutor under the direct
control and supervision of the public
prosecutor. My name is
