WHEREAS, Section 458 (a}{5j{u) and (vi) of Republic Act No. 7160, otherwise known us “The Local Government Code of 1991?, provides for the Powers, Duties, Functions of the Sangguniang Paniungsod; “ju} Regulate the use of streets, avenues, alleys, sidewalks, bridges, parks and other public places and approve the construction, improvement, repair and maintenance of the same, 2x." "ui) Regulate traffic on all streets and bridges; prohibit encroachments or obstacles, thereon and, when necessary in the interest of public welfare, xxx.” WHEREAS, the Sangguniang Barangay of Barangay Kauntaran Passed Ordinance No. 008, 8-2017, entitled: “BARANGAY ORDINANCE PROHIBITING PUBLIC UTILITY VEHICLES (PUVs}, UV EXPRESS VEHICLES, TRUCK TAXt CABS AND ALL TRANSPORT VEHICLES FROM PARKING ALONG THE STREETS OF BARANGAY KAUNLARAN AND. DECLARING ONE-SIDE PARKING, NO PARKING, ONE-WAY TRAFFIC DIRECTION AND REGULATED PARKING ON CERTAIN STREETS OF THE BARANGAY’; 4 - ~S50" Regular Session Ord. No. sp.__2647 232017 Page -2- PO2Z0CC-332 WHEREAS, the burangay experiences massive complaints due 40 the continuous problem of vehicular traffie on a daily bavies WHEREAS, aside from illegal parking anc obstruction, there has been @ growing complaint from the residents of this Barangay regarding illegally parked vehicles such as trucks, taxi cabs, Uv Express vehicles and PUV's, which pose not only danger to passers by but most of the time causes unsanitary and unpleasant situation such as, drivers peeing thereat, sleeping inside the vehicles white feet are stretched out and others; WHEREAS, an orderly flow of traffic and orgunized parking of vehicles, per street is also necessary to give way quickly to emergency vesponse vehicles to arrive on time especially during fire and evacuation, as well as during emergency situations like sending a resident to the hospital; WHEREAS, it is meurmbent upon the City Goverament to regulate the traffic situation and road conditions within its jurisdiction NOW, THEREFORE, BI IT ORDAINED BY THE CITY COUNCIL OF QUEZON CiTY IN REGULAR SESSION ASSEMBLED: SECTION 1. PENALTY/VIOLATION - Vivlators of this Ordinance shall be metted with the following: First Offense: Violation ticket plus clamping Second Offense: Fine of 800 Pesos plus clamping Third Offense: Fine of 1500 Pesos pius towing SECTION 3.
