1. Distinguish Factum probandum from Factum probans.


-a factum probans is a fact offered in evidence as proof of another fact,
while factum probandum  is a fact that needs to be proved.

2. What is the quantum of proof required in criminal cases? Explain.


-Criminal cases requires proof beyond reasonable doubt.
-according to Rule 133 sec.2 proof beyond reasonable doubt.- in a criminal
case, the accused is entitled to an acquittal, unless his guilt is shown beyond
reasonable doubt does not mean such a degree or proof, excluding possibility
of error, produces absolute certainly. Moral certainly only is required, or
that degree of proof which produces conviction in an unprejudiced
mind.
