DEED OF RESTRICTION

Revised 5/10/18 

1.    This lot shall not be subdivided and shall not in any way be used as an access or
roadway to any adjacent land outside of subdivision.
2.    This lot shall be used for residential purposes only, and not for any immoral or illegal
trade or activity. No commercial activity shall be allowed without the written consent of
the VENDOR and the Homeowner’s Association;
3.    No farm animals such as but not limited to cattle, pigs, sheep, goats, ducks, geese,
or rabbits shall be maintained in the lot except as pets, but not in commercial quantity.
4.    Ownership of the lot carries within it the absolute condition of the membership in the
________________  Homeowners Association by the lot owners and their successors
and assignee/s who must comply with the rules and regulation thereof;
5.    All buildings and other improvements which may be constructed at any time in the
said lot must be:
a.    Of strong materials, properly painted and should conform to the aesthetic and
architectural standards of the subdivision established by the VENDOR including
approved setbacks along boundaries;
b. Provided with modern sanitary installation and connected to an approved septic
tank;
c.  The required easement of the setback on the property should not be at distance
of less than:

i.        three (3) meters from the front boundary line,


                                                 
two (2) meters from either side boundary lines, and two (2) meters
from the rear boundary line for lots of measuring less than 150
square meters. A full firewall may be constructed on one side of the
property;
                                                 ii.        three (3) meters from the front boundary line,
two (2) meters from either side boundary lines, and two (2) meters
from the rear boundary line for lots measuring 151-300 square
meters. A firewall of at least fifty (50%) may be constructed on one
side of the property;
                                                iii.        four (4) meters from the front boundary line,
two (2) meters from either side boundary lines, and two (2) meters
from the rear boundary line for lots measuring more than 301
square meters. No firewall shall be allowed.
                                               iv.        BP220 Lots: 1.5 meters from its front
boundary line and 1.5 meters from either side and 2.0 meters back
boundary lines for lot size below 100 square meters. 100% firewall
on one side. 
d. That any firewall constructed must follow the guidelines set by the vendor.
e. Constructed in conformity with the National Building Code of the Philippines and
its implementing rules and regulations and any applicable and/or local
ordinances; and
f.  Not be more than two (2) storeys high, with a maximum building height of 9
meters.

6.    The said wall fences must be concrete with a maximum height of 2 meters. The front
wall/fence must be of painted concrete/CHB, not exceeding .8 meters, and/or iron grill
fences, not exceeding 1.2 meters, making the overall height of the front wall a maximum
of 2 meters from the top of the sidewalk.

7.    All engineering and architectural plans must be submitted and approved by the
administration of San Antonio Resort- Village / Ancor Dev’t Corp. prior to any
construction of building or improvements.
8.     In the event that construction is made on the land subject of this sale, which violates
any of the condition or regulation stated herein, the same may be demolished at the of
the VENDOR part without need for judicial processes, and the expenses of such
demolition shall be chargeable to the VENDEE or Second Party and shall constitute a
lien on the land; 
9.     No trucks larger than six (6) wheelers shall be used to haul any materials to and
from the construction site;
10.   Every house must be single detached, not using a firewall and not sharing a wall
with its neighbors.
11.  Only one house shall be allowed per lot. Conjoined lot owned by the owner will be
considered as one lot and shall follow the rules based on the total area of the conjoined
lot. If the owner chooses to consider the lot as separate, he may also do so and the
structures within the lots must also be separate.
12.  Any additional revision or modifications to the house, after the clearance to construct
has already be approved must be given clearance by ANCOR Development Corp. Thus,
revisions and modification to the house must also have clearance to construct with
corresponding bond;
13.  The breach of any restrictions, covenants, and conditions specified in the deed of
restriction shall be sufficient cause for the cancellation and rescission of this sale,
without the necessity of obtaining any judicial declaration to that effect thereafter, and
the vendor shall be free to sell the lot to any other party as well though this deed of sale
was never executed.
