Q.1 Two examples of quasi contract

Answer: Quasi means almost or apparently but not really and contract means an agreement enforceable
by the law.

A quasi contract is not a contract at all, because the essential element for the formulation of a contract
is absent.

It is an obligation imposed by the law upon a person for the benefit of another even in the absence of a
contract.

It is based on principle of equity

Examples of Quasi contract are:

1. A mechanic changed the oil of the wrong car


Will the car owner held liable to pay for oil?
Yes, if the car owner knows that the oil was changed mistakenly. The court will make him pay
because of the quasi contract.
No, he would not be liable if that could not be proven.
2. A ordered a pizza with 3 special toppings. The pizza is delivered to B, already A had done
payment for pizza and he could not enjoy the pizza because the pizza was delivered to some
other house. Now the pizzeria could get a court order to reimburse the full amount to A.
