1. Give the definition of law by Sanchez Roman

According to Sanchez Roman, a law is a rule of conduct, just, obligatory, promulgated by


legitimate authority, and of common observance and benefit.

2. Give the rules on the effectivity of the following:

a. an ordinary law

Under the New Civil Code, an ordinary law shall take effect after fifteen days following
completion of their publication in the Official Gazette, or in a newspaper of general circulation in
the Philippines, unless it is otherwise provided.

b. the Civil Code

Under the law, the Civil Code shall take effect one (1) year after publication.

3. Give the date of effectivity of the Civil Code in the case of Askay v. Casalan and explain the
same.

The date of effectivity of the Civil Code was on August 30, 1950, this date is exactly one year
after the Official Gazette publishing the code was released for circulation, the release having
been made on August 30, 1949.

4. True or False

a. A law which was enacted by Congress with a specific of approval of September 8.

The ratio decidendi of a final judgment states the reasons for such judgment. An obiter dictum is
an opinion not necessary to the determination of the case.
